國務院關于大力發展電子商務加快培育經濟新動力的意見

各省、自治區、直轄市人(ren)民政府,國務院各部(bu)委(wei)、各直屬(shu)機構:

  近年(nian)來我國電(dian)(dian)子商(shang)務(wu)(wu)發(fa)展(zhan)(zhan)(zhan)迅(xun)猛,不(bu)僅創造(zao)了新(xin)(xin)的(de)(de)消費需求,引(yin)發(fa)了新(xin)(xin)的(de)(de)投資熱潮,開辟了就業增收新(xin)(xin)渠道(dao),為大眾創業、萬眾創新(xin)(xin)提(ti)供了新(xin)(xin)空(kong)間,而且電(dian)(dian)子商(shang)務(wu)(wu)正加速(su)與制造(zao)業融合,推動服(fu)務(wu)(wu)業轉型升(sheng)級,催生新(xin)(xin)興業態,成(cheng)為提(ti)供公共產品、公共服(fu)務(wu)(wu)的(de)(de)新(xin)(xin)力(li)量,成(cheng)為經(jing)濟發(fa)展(zhan)(zhan)(zhan)新(xin)(xin)的(de)(de)原(yuan)動力(li)。與此同時(shi),電(dian)(dian)子商(shang)務(wu)(wu)發(fa)展(zhan)(zhan)(zhan)面臨管理方式不(bu)適(shi)應、誠信體(ti)系不(bu)健全(quan)、市場秩序不(bu)規范等問題(ti),亟(ji)需采(cai)取(qu)措(cuo)施(shi)予以解決。當前,我國已進入全(quan)面建成(cheng)小康社會(hui)的(de)(de)決定(ding)性階(jie)段,為減少束(shu)縛電(dian)(dian)子商(shang)務(wu)(wu)發(fa)展(zhan)(zhan)(zhan)的(de)(de)機制體(ti)制障(zhang)礙,進一步發(fa)揮電(dian)(dian)子商(shang)務(wu)(wu)在(zai)培育經(jing)濟新(xin)(xin)動力(li),打造(zao)“雙引(yin)擎”、實(shi)現(xian)“雙目標”等方面的(de)(de)重(zhong)要作用,現(xian)提(ti)出(chu)以下意見:

  一、指導思想、基本原(yuan)則和(he)主要目標

  (一(yi))指導(dao)思想。全面貫徹黨的十八(ba)大和十八(ba)屆二中(zhong)、三(san)中(zhong)、四中(zhong)全會精神,按(an)照(zhao)黨中(zhong)央、國務(wu)院決(jue)策部署,堅持依靠(kao)改革推動(dong)科學發(fa)(fa)(fa)展,主(zhu)動(dong)適應(ying)和引領經(jing)濟(ji)發(fa)(fa)(fa)展新(xin)常態,著力(li)(li)解(jie)決(jue)電子(zi)商務(wu)發(fa)(fa)(fa)展中(zhong)的深層次矛(mao)盾和重大問(wen)題,大力(li)(li)推進政策創(chuang)(chuang)新(xin)、管(guan)理創(chuang)(chuang)新(xin)和服務(wu)創(chuang)(chuang)新(xin),加(jia)快建立開放、規范(fan)、誠信、安全的電子(zi)商務(wu)發(fa)(fa)(fa)展環(huan)境,進一(yi)步激發(fa)(fa)(fa)電子(zi)商務(wu)創(chuang)(chuang)新(xin)動(dong)力(li)(li)、創(chuang)(chuang)造潛力(li)(li)、創(chuang)(chuang)業活力(li)(li),加(jia)速推動(dong)經(jing)濟(ji)結構戰(zhan)略性調(diao)整,實現經(jing)濟(ji)提質(zhi)增效(xiao)升級。

  (二)基本原則(ze)。一(yi)(yi)(yi)是(shi)積極推動(dong)。主(zhu)動(dong)作為(wei)、支持發(fa)(fa)(fa)展(zhan)。積極協調(diao)解決電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)發(fa)(fa)(fa)展(zhan)中(zhong)的(de)(de)(de)(de)各種矛(mao)盾與問題。在(zai)政府資(zi)源開(kai)放(fang)(fang)、網(wang)絡安全保障、投融資(zi)支持、基礎設施和誠信體系建設等方面加(jia)(jia)大服務(wu)(wu)(wu)力(li)度(du)。推進(jin)(jin)電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)企(qi)業稅費合理化,減輕(qing)企(qi)業負擔。進(jin)(jin)一(yi)(yi)(yi)步釋放(fang)(fang)電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)發(fa)(fa)(fa)展(zhan)潛力(li),提(ti)升電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)創(chuang)新(xin)發(fa)(fa)(fa)展(zhan)水平(ping)。二是(shi)逐(zhu)步規范(fan)。簡政放(fang)(fang)權(quan)、放(fang)(fang)管結合。法(fa)無禁止的(de)(de)(de)(de)市(shi)場(chang)主(zhu)體即可(ke)為(wei),法(fa)未(wei)授權(quan)的(de)(de)(de)(de)政府部門不能為(wei),最大限度(du)減少(shao)對電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)市(shi)場(chang)的(de)(de)(de)(de)行政干預。在(zai)放(fang)(fang)寬市(shi)場(chang)準(zhun)入的(de)(de)(de)(de)同時,要在(zai)發(fa)(fa)(fa)展(zhan)中(zhong)逐(zhu)步規范(fan)市(shi)場(chang)秩(zhi)序,營(ying)造公(gong)平(ping)競爭的(de)(de)(de)(de)創(chuang)業發(fa)(fa)(fa)展(zhan)環境,進(jin)(jin)一(yi)(yi)(yi)步激發(fa)(fa)(fa)社會創(chuang)業活(huo)力(li),拓(tuo)寬電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)創(chuang)新(xin)發(fa)(fa)(fa)展(zhan)領域。三是(shi)加(jia)(jia)強(qiang)引(yin)導。把(ba)握趨勢(shi)、因勢(shi)利導。加(jia)(jia)強(qiang)對電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)發(fa)(fa)(fa)展(zhan)中(zhong)前瞻(zhan)性、苗頭性、傾向性問題的(de)(de)(de)(de)研究,及時在(zai)商(shang)(shang)(shang)(shang)(shang)業模式創(chuang)新(xin)、關(guan)鍵技術研發(fa)(fa)(fa)、國際(ji)市(shi)場(chang)開(kai)拓(tuo)等方面加(jia)(jia)大對企(qi)業的(de)(de)(de)(de)支持引(yin)導力(li)度(du),引(yin)領電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)向打造“雙(shuang)(shuang)引(yin)擎”、實現“雙(shuang)(shuang)目標”發(fa)(fa)(fa)展(zhan),進(jin)(jin)一(yi)(yi)(yi)步增強(qiang)企(qi)業的(de)(de)(de)(de)創(chuang)新(xin)動(dong)力(li),加(jia)(jia)速電(dian)子(zi)(zi)商(shang)(shang)(shang)(shang)(shang)務(wu)(wu)(wu)創(chuang)新(xin)發(fa)(fa)(fa)展(zhan)步伐。

  (三)主(zhu)要目標。到2020年(nian),統(tong)一開(kai)放、競爭有序、誠信守(shou)法、安全可靠的(de)(de)電子商(shang)務大(da)市場基本建(jian)成。電子商(shang)務與其他產業(ye)深度融合,成為促進創業(ye)、穩定就業(ye)、改善民生(sheng)服務的(de)(de)重要平臺,對工業(ye)化(hua)、信息(xi)化(hua)、城鎮(zhen)化(hua)、農業(ye)現代化(hua)同步發(fa)展起到關鍵(jian)性作用。

  二、營(ying)造(zao)寬松發展環境(jing)

  (四)降低(di)準(zhun)入門檻。全面清理電(dian)(dian)(dian)子商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)領域現有(you)前(qian)置審(shen)批事項,無法律法規依據(ju)的(de)一律取消,嚴(yan)禁違法設(she)定(ding)行政許可(ke)、增加行政許可(ke)條件(jian)和程序。(國務(wu)(wu)(wu)院審(shen)改(gai)辦,有(you)關(guan)部門按職責分工(gong)分別負(fu)責)進一步簡(jian)化注冊(ce)資(zi)(zi)本(ben)(ben)登(deng)記(ji),深(shen)入推進電(dian)(dian)(dian)子商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)領域由“先證(zheng)(zheng)后照”改(gai)為(wei)“先照后證(zheng)(zheng)”改(gai)革(ge)。(工(gong)商(shang)(shang)(shang)(shang)總(zong)局、中央(yang)編辦)落實《注冊(ce)資(zi)(zi)本(ben)(ben)登(deng)記(ji)制(zhi)度(du)改(gai)革(ge)方案》,放寬電(dian)(dian)(dian)子商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)市場主體住所(suo)(經營場所(suo))登(deng)記(ji)條件(jian),完善相關(guan)管理措施。(省級人(ren)民(min)政府)推進對快遞(di)(di)企業(ye)設(she)立非法人(ren)快遞(di)(di)末(mo)端網點實施備案制(zhi)管理。(郵(you)政局)簡(jian)化境(jing)(jing)內電(dian)(dian)(dian)子商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)企業(ye)海外(wai)上市審(shen)批流程,鼓勵電(dian)(dian)(dian)子商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)領域的(de)跨境(jing)(jing)人(ren)民(min)幣直接投資(zi)(zi)。(發展改(gai)革(ge)委(wei)、商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)部、外(wai)匯(hui)局、證(zheng)(zheng)監會、人(ren)民(min)銀行)放開外(wai)商(shang)(shang)(shang)(shang)投資(zi)(zi)電(dian)(dian)(dian)子商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)業(ye)務(wu)(wu)(wu)的(de)外(wai)方持(chi)股比例限制(zhi)。(工(gong)業(ye)和信息化部、發展改(gai)革(ge)委(wei)、商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)部)探索建立能源(yuan)、鐵路、公(gong)共事業(ye)等行業(ye)電(dian)(dian)(dian)子商(shang)(shang)(shang)(shang)務(wu)(wu)(wu)服務(wu)(wu)(wu)的(de)市場化機制(zhi)。(有(you)關(guan)部門按職責分工(gong)分別負(fu)責)

  (五)合理降稅(shui)(shui)(shui)減負。從事電子商務(wu)活動的企業(ye),經(jing)認(ren)定為高新技(ji)術企業(ye)的,依法享受(shou)高新技(ji)術企業(ye)相關優(you)惠政(zheng)(zheng)(zheng)策,小微企業(ye)依法享受(shou)稅(shui)(shui)(shui)收優(you)惠政(zheng)(zheng)(zheng)策。(科(ke)技(ji)部(bu)、財(cai)政(zheng)(zheng)(zheng)部(bu)、稅(shui)(shui)(shui)務(wu)總局)加(jia)快推進(jin)“營(ying)改增”,逐步(bu)將旅游電子商務(wu)、生活服(fu)務(wu)類電子商務(wu)等相關行業(ye)納入“營(ying)改增”范圍(wei)。(財(cai)政(zheng)(zheng)(zheng)部(bu)、稅(shui)(shui)(shui)務(wu)總局)

  (六)加大金(jin)融(rong)服(fu)務(wu)支(zhi)(zhi)持(chi)。建立健全適應(ying)電子(zi)商(shang)務(wu)發(fa)展(zhan)(zhan)的(de)多(duo)元化、多(duo)渠(qu)道投融(rong)資(zi)(zi)機(ji)制。(有(you)關部門按職責(ze)分(fen)工分(fen)別負責(ze))研(yan)究鼓勵符合條件的(de)互聯網企業(ye)(ye)在境內上(shang)市等相(xiang)關政策。(證監(jian)會(hui))支(zhi)(zhi)持(chi)商(shang)業(ye)(ye)銀(yin)行、擔保存(cun)貨管理(li)機(ji)構(gou)及電子(zi)商(shang)務(wu)企業(ye)(ye)開(kai)展(zhan)(zhan)無形(xing)資(zi)(zi)產、動產質(zhi)押等多(duo)種形(xing)式的(de)融(rong)資(zi)(zi)服(fu)務(wu)。鼓勵商(shang)業(ye)(ye)銀(yin)行、商(shang)業(ye)(ye)保理(li)機(ji)構(gou)、電子(zi)商(shang)務(wu)企業(ye)(ye)開(kai)展(zhan)(zhan)供應(ying)鏈金(jin)融(rong)、商(shang)業(ye)(ye)保理(li)服(fu)務(wu),進一步拓展(zhan)(zhan)電子(zi)商(shang)務(wu)企業(ye)(ye)融(rong)資(zi)(zi)渠(qu)道。(人(ren)民銀(yin)行、商(shang)務(wu)部)引(yin)導和推(tui)動創業(ye)(ye)投資(zi)(zi)基(ji)金(jin),加大對電子(zi)商(shang)務(wu)初創企業(ye)(ye)的(de)支(zhi)(zhi)持(chi)。(發(fa)展(zhan)(zhan)改革委)

  (七)維(wei)護(hu)(hu)公平競(jing)(jing)(jing)(jing)(jing)爭(zheng)(zheng)(zheng)。規范電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)市場(chang)競(jing)(jing)(jing)(jing)(jing)爭(zheng)(zheng)(zheng)行(xing)為(wei),促進(jin)(jin)建立(li)開放、公平、健康的(de)(de)(de)電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)市場(chang)競(jing)(jing)(jing)(jing)(jing)爭(zheng)(zheng)(zheng)秩序。研究制(zhi)(zhi)(zhi)(zhi)定電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)產品(pin)(pin)質(zhi)(zhi)量(liang)監督(du)管理(li)辦法(fa),探索建立(li)風險監測、網上抽查、源(yuan)頭追溯、屬地查處(chu)的(de)(de)(de)電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)產品(pin)(pin)質(zhi)(zhi)量(liang)監督(du)機制(zhi)(zhi)(zhi)(zhi),完善部(bu)門間(jian)、區域(yu)(yu)間(jian)監管信息共享(xiang)和(he)(he)職能銜接機制(zhi)(zhi)(zhi)(zhi)。依法(fa)打擊網絡虛假(jia)宣傳(chuan)、生(sheng)產銷售假(jia)冒偽劣(lie)產品(pin)(pin)、違(wei)反國家出(chu)口(kou)管制(zhi)(zhi)(zhi)(zhi)法(fa)規政(zheng)(zheng)策跨境(jing)銷售兩用(yong)品(pin)(pin)和(he)(he)技術(shu)、不(bu)正當競(jing)(jing)(jing)(jing)(jing)爭(zheng)(zheng)(zheng)等違(wei)法(fa)行(xing)為(wei),組織開展電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)產品(pin)(pin)質(zhi)(zhi)量(liang)提(ti)升行(xing)動,促進(jin)(jin)合法(fa)、誠信經營。(工(gong)(gong)商總(zong)局、質(zhi)(zhi)檢(jian)總(zong)局、公安部(bu)、商務(wu)(wu)(wu)(wu)部(bu)按職責分(fen)(fen)工(gong)(gong)分(fen)(fen)別負(fu)責)重點查處(chu)達成壟(long)(long)斷(duan)(duan)協(xie)議和(he)(he)濫(lan)(lan)用(yong)市場(chang)支配地位的(de)(de)(de)問題,通(tong)過(guo)經營者(zhe)集中(zhong)反壟(long)(long)斷(duan)(duan)審查,防(fang)止(zhi)排除(chu)、限制(zhi)(zhi)(zhi)(zhi)市場(chang)競(jing)(jing)(jing)(jing)(jing)爭(zheng)(zheng)(zheng)的(de)(de)(de)行(xing)為(wei)。(發展改革委、工(gong)(gong)商總(zong)局、商務(wu)(wu)(wu)(wu)部(bu))加(jia)強電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)領域(yu)(yu)知識(shi)產權保護(hu)(hu),研究進(jin)(jin)一步加(jia)大網絡商業方法(fa)領域(yu)(yu)發明專利保護(hu)(hu)力(li)度。(工(gong)(gong)業和(he)(he)信息化部(bu)、商務(wu)(wu)(wu)(wu)部(bu)、海關總(zong)署、工(gong)(gong)商總(zong)局、新聞出(chu)版廣電(dian)(dian)總(zong)局、知識(shi)產權局等部(bu)門按職責分(fen)(fen)工(gong)(gong)分(fen)(fen)別負(fu)責)進(jin)(jin)一步加(jia)大政(zheng)(zheng)府利用(yong)電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)平臺進(jin)(jin)行(xing)采(cai)購的(de)(de)(de)力(li)度。(財政(zheng)(zheng)部(bu))各級政(zheng)(zheng)府部(bu)門不(bu)得(de)通(tong)過(guo)行(xing)政(zheng)(zheng)命令指(zhi)定為(wei)電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)提(ti)供公共服務(wu)(wu)(wu)(wu)的(de)(de)(de)供應商,不(bu)得(de)濫(lan)(lan)用(yong)行(xing)政(zheng)(zheng)權力(li)排除(chu)、限制(zhi)(zhi)(zhi)(zhi)電(dian)(dian)子(zi)(zi)(zi)(zi)商務(wu)(wu)(wu)(wu)的(de)(de)(de)競(jing)(jing)(jing)(jing)(jing)爭(zheng)(zheng)(zheng)。(有關部(bu)門按職責分(fen)(fen)工(gong)(gong)分(fen)(fen)別負(fu)責)

  三、促進就業創業

  (八)鼓勵電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)領域(yu)就業(ye)(ye)(ye)創(chuang)(chuang)業(ye)(ye)(ye)。把發(fa)展電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)促進就業(ye)(ye)(ye)納入各(ge)地(di)(di)就業(ye)(ye)(ye)發(fa)展規劃和電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)發(fa)展整(zheng)體(ti)規劃。建(jian)立電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)就業(ye)(ye)(ye)和社會保障(zhang)指(zhi)(zhi)標統計制度。經(jing)工(gong)商(shang)(shang)登(deng)記注冊的網(wang)(wang)絡(luo)商(shang)(shang)戶從業(ye)(ye)(ye)人(ren)員(yuan)(yuan),同(tong)等享受各(ge)項(xiang)就業(ye)(ye)(ye)創(chuang)(chuang)業(ye)(ye)(ye)扶持政(zheng)策。未進行工(gong)商(shang)(shang)登(deng)記注冊的網(wang)(wang)絡(luo)商(shang)(shang)戶從業(ye)(ye)(ye)人(ren)員(yuan)(yuan),可認定(ding)為靈活(huo)就業(ye)(ye)(ye)人(ren)員(yuan)(yuan),享受靈活(huo)就業(ye)(ye)(ye)人(ren)員(yuan)(yuan)扶持政(zheng)策,其中在網(wang)(wang)絡(luo)平臺實名注冊、穩定(ding)經(jing)營且信(xin)譽良好(hao)的網(wang)(wang)絡(luo)商(shang)(shang)戶創(chuang)(chuang)業(ye)(ye)(ye)者,可按規定(ding)享受小(xiao)額擔(dan)保貸(dai)款及(ji)貼(tie)息政(zheng)策。支持中小(xiao)微企(qi)業(ye)(ye)(ye)應用電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)、拓展業(ye)(ye)(ye)務(wu)(wu)領域(yu),鼓勵有條件的地(di)(di)區建(jian)設電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)創(chuang)(chuang)業(ye)(ye)(ye)園(yuan)區,指(zhi)(zhi)導各(ge)類(lei)創(chuang)(chuang)業(ye)(ye)(ye)孵(fu)化基地(di)(di)為電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)創(chuang)(chuang)業(ye)(ye)(ye)人(ren)員(yuan)(yuan)提(ti)供場地(di)(di)支持和創(chuang)(chuang)業(ye)(ye)(ye)孵(fu)化服務(wu)(wu)。加(jia)強電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)企(qi)業(ye)(ye)(ye)用工(gong)服務(wu)(wu),完善電(dian)(dian)(dian)(dian)(dian)子(zi)(zi)商(shang)(shang)務(wu)(wu)人(ren)才供求(qiu)信(xin)息對接(jie)機制。(人(ren)力資源社會保障(zhang)部(bu)、工(gong)業(ye)(ye)(ye)和信(xin)息化部(bu)、商(shang)(shang)務(wu)(wu)部(bu)、統計局,地(di)(di)方各(ge)級人(ren)民(min)政(zheng)府)
