貫徹落實黨的十九大和十九屆二中(zhong)(zhong)、三(san)中(zhong)(zhong)全會關于完(wan)善國有(you)資(zi)產管理(li)體制的決策部署,各(ge)地圍繞以管資(zi)本(ben)為主積極(ji)推進(jin)(jin)職能轉(zhuan)變,不(bu)斷深(shen)化國有(you)資(zi)本(ben)投資(zi)、運營(ying)公(gong)司試(shi)點,持續(xu)推進(jin)(jin)經營(ying)性(xing)國有(you)資(zi)產集中(zhong)(zhong)統一(yi)監(jian)管,各(ge)項重點工作取得積極(ji)進(jin)(jin)展。
一(yi)、國資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)職(zhi)(zhi)(zhi)能(neng)轉(zhuan)變(bian)(bian)取得(de)階段性(xing)成效(xiao)。一(yi)是持續向以管(guan)(guan)資(zi)(zi)(zi)本(ben)為(wei)(wei)主轉(zhuan)變(bian)(bian)。準確把(ba)握(wo)出(chu)資(zi)(zi)(zi)人代表職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)定位(wei),依法厘清(qing)(qing)(qing)出(chu)資(zi)(zi)(zi)人履(lv)職(zhi)(zhi)(zhi)邊界(jie),以管(guan)(guan)資(zi)(zi)(zi)本(ben)為(wei)(wei)主調(diao)整優(you)化(hua)監(jian)(jian)(jian)(jian)管(guan)(guan)職(zhi)(zhi)(zhi)能(neng)和(he)(he)方(fang)式。目(mu)前已(yi)有(you)(you)16個地方(fang)出(chu)臺(tai)了(le)(le)(le)(le)職(zhi)(zhi)(zhi)能(neng)轉(zhuan)變(bian)(bian)方(fang)案。四(si)川對以管(guan)(guan)資(zi)(zi)(zi)本(ben)為(wei)(wei)主的(de)(de)原(yuan)則進行了(le)(le)(le)(le)細(xi)(xi)化(hua),強(qiang)化(hua)了(le)(le)(le)(le)對國有(you)(you)資(zi)(zi)(zi)本(ben)運(yun)營質量、企業(ye)財務(wu)狀況(kuang)和(he)(he)產權(quan)流轉(zhuan)環節(jie)監(jian)(jian)(jian)(jian)管(guan)(guan)。二是調(diao)整優(you)化(hua)內設(she)機構。通(tong)過整合、新設(she)等方(fang)式科學(xue)設(she)置內設(she)機構和(he)(he)職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze),著(zhu)力(li)優(you)化(hua)監(jian)(jian)(jian)(jian)管(guan)(guan)流程。深圳先后2次調(diao)整機構設(she)置,強(qiang)化(hua)綜(zong)合研究(jiu)、資(zi)(zi)(zi)本(ben)運(yun)作(zuo)(zuo)(zuo)、股東事務(wu)等出(chu)資(zi)(zi)(zi)人職(zhi)(zhi)(zhi)能(neng)。貴州(zhou)和(he)(he)重(zhong)慶整合董(dong)(dong)事會(hui)職(zhi)(zhi)(zhi)能(neng),成立董(dong)(dong)事會(hui)監(jian)(jian)(jian)(jian)事會(hui)工(gong)(gong)作(zuo)(zuo)(zuo)處(chu),履(lv)行對企業(ye)董(dong)(dong)事會(hui)、監(jian)(jian)(jian)(jian)事會(hui)規范運(yun)作(zuo)(zuo)(zuo)和(he)(he)履(lv)職(zhi)(zhi)(zhi)管(guan)(guan)理(li)(li)職(zhi)(zhi)(zhi)能(neng)。三(san)是修訂(ding)完善權(quan)責(ze)(ze)(ze)(ze)清(qing)(qing)(qing)單。截至(zhi)目(mu)前,已(yi)有(you)(you)33個省級國資(zi)(zi)(zi)委出(chu)臺(tai)了(le)(le)(le)(le)權(quan)責(ze)(ze)(ze)(ze)清(qing)(qing)(qing)單,其(qi)中福建、西藏等10個地方(fang)根據實際情況(kuang),結合職(zhi)(zhi)(zhi)能(neng)轉(zhuan)變(bian)(bian)要(yao)求,對已(yi)公布的(de)(de)權(quan)責(ze)(ze)(ze)(ze)清(qing)(qing)(qing)單進行修訂(ding)與完善,進一(yi)步(bu)增強(qiang)了(le)(le)(le)(le)權(quan)力(li)配置的(de)(de)科學(xue)性(xing)和(he)(he)規范性(xing)。廣東以現有(you)(you)權(quan)責(ze)(ze)(ze)(ze)清(qing)(qing)(qing)單為(wei)(wei)基點,編制印發(fa)了(le)(le)(le)(le)權(quan)責(ze)(ze)(ze)(ze)清(qing)(qing)(qing)單服務(wu)指南(nan),增強(qiang)了(le)(le)(le)(le)清(qing)(qing)(qing)單管(guan)(guan)理(li)(li)的(de)(de)可操作(zuo)(zuo)(zuo)性(xing)和(he)(he)指引性(xing)。四(si)是大力(li)推進簡(jian)政(zheng)放(fang)(fang)權(quan)。按照“放(fang)(fang)管(guan)(guan)服”要(yao)求,加大簡(jian)政(zheng)放(fang)(fang)權(quan)力(li)度,取消、下放(fang)(fang)和(he)(he)授權(quan)一(yi)批與管(guan)(guan)資(zi)(zi)(zi)本(ben)要(yao)求不符(fu)的(de)(de)職(zhi)(zhi)(zhi)能(neng),把(ba)該放(fang)(fang)的(de)(de)以及(ji)細(xi)(xi)、小、散工(gong)(gong)作(zuo)(zuo)(zuo)事項放(fang)(fang)下去、放(fang)(fang)到位(wei)。江蘇堅(jian)持“四(si)個一(yi)律精簡(jian)”的(de)(de)原(yuan)則,對出(chu)資(zi)(zi)(zi)人審批事項開展了(le)(le)(le)(le)4輪清(qing)(qing)(qing)理(li)(li)規范工(gong)(gong)作(zuo)(zuo)(zuo),累計取消、下放(fang)(fang)17項,精簡(jian)幅(fu)度達到50%。
二、國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)方式方法(fa)(fa)(fa)進一步優(you)化。一是(shi)注重分類監(jian)(jian)管(guan)(guan)(guan)(guan)和(he)(he)(he)(he)分類考(kao)核。針(zhen)對(dui)企(qi)業(ye)(ye)不同戰略(lve)定(ding)位和(he)(he)(he)(he)發展(zhan)目標,研究制(zhi)定(ding)差異化的監(jian)(jian)管(guan)(guan)(guan)(guan)目標、監(jian)(jian)管(guan)(guan)(guan)(guan)重點和(he)(he)(he)(he)監(jian)(jian)管(guan)(guan)(guan)(guan)措施(shi),實施(shi)更加(jia)精準有(you)(you)效(xiao)的分類監(jian)(jian)管(guan)(guan)(guan)(guan)。甘肅將監(jian)(jian)管(guan)(guan)(guan)(guan)企(qi)業(ye)(ye)考(kao)核結(jie)果(guo)與薪酬(chou)分配(pei)聯(lian)動掛鉤,省(sheng)屬企(qi)業(ye)(ye)負責人薪酬(chou)差距(ju)達(da)(da)到4.86倍。二是(shi)加(jia)強國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)信(xin)息化建設(she)。創新(xin)監(jian)(jian)督(du)工作方式方法(fa)(fa)(fa),運(yun)用信(xin)息化手(shou)段(duan)提升監(jian)(jian)管(guan)(guan)(guan)(guan)效(xiao)率和(he)(he)(he)(he)有(you)(you)效(xiao)性(xing)。河南在已(yi)(yi)有(you)(you)的“一個專網、三(san)個系統(tong)”國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)平臺基(ji)礎(chu)上(shang),籌建全省(sheng)統(tong)一的智(zhi)能化國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)平臺,通(tong)過云計算、大(da)(da)(da)數(shu)據、人工智(zhi)能等(deng)技術手(shou)段(duan)實現(xian)全省(sheng)國有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)管(guan)(guan)(guan)(guan)理信(xin)息系統(tong)互(hu)聯(lian)、共(gong)享、實時監(jian)(jian)管(guan)(guan)(guan)(guan)。三(san)是(shi)提高國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)法(fa)(fa)(fa)治化水平。結(jie)合國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)國企(qi)改革進程(cheng),不斷加(jia)強國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)立法(fa)(fa)(fa)工作。內蒙(meng)(meng)古制(zhi)定(ding)的《內蒙(meng)(meng)古自治區企(qi)業(ye)(ye)國有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)督(du)管(guan)(guan)(guan)(guan)理條例》已(yi)(yi)經(jing)自治區人大(da)(da)(da)常委會審(shen)議通(tong)過,是(shi)繼(ji)湖北、山東(dong)后出臺的第3個國資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)地(di)方性(xing)法(fa)(fa)(fa)規(gui)。重慶全年對(dui)14件規(gui)范性(xing)文件和(he)(he)(he)(he)121項涉(she)法(fa)(fa)(fa)議題(ti)進行合法(fa)(fa)(fa)性(xing)審(shen)查,審(shen)查率達(da)(da)100%。把合法(fa)(fa)(fa)性(xing)審(shen)查作為重大(da)(da)(da)決策前置程(cheng)序,做到“決策先問法(fa)(fa)(fa)、違法(fa)(fa)(fa)不決策”,法(fa)(fa)(fa)律審(shen)核機制(zhi)更加(jia)完(wan)善。
三(san)、國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)試點效(xiao)果逐步顯現(xian)。一(yi)是探索完(wan)善國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)授(shou)權(quan)(quan)經營(ying)(ying)(ying)(ying)體(ti)制(zhi)(zhi)。將(jiang)改(gai)(gai)建(jian)(jian)組建(jian)(jian)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)作為改(gai)(gai)革(ge)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)授(shou)權(quan)(quan)經營(ying)(ying)(ying)(ying)體(ti)制(zhi)(zhi),構建(jian)(jian)“以管資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)為主”國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)監管模式的(de)關鍵措施(shi)。截至目前,各地(di)完(wan)成(cheng)改(gai)(gai)組組建(jian)(jian)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)104家,在體(ti)制(zhi)(zhi)設計(ji)上均明(ming)確國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委作為出資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)人(ren),對(dui)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)履行(xing)出資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)人(ren)職責。二是促進國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)源優化(hua)配置。推(tui)動(dong)(dong)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)向(xiang)關系國(guo)(guo)家安全、國(guo)(guo)民經濟命脈和(he)國(guo)(guo)計(ji)民生的(de)重(zhong)(zhong)要行(xing)業(ye)(ye)(ye)(ye)和(he)關鍵領域、重(zhong)(zhong)點基礎設施(shi)集中,向(xiang)前瞻性戰略性產業(ye)(ye)(ye)(ye)集中,向(xiang)具有(you)核心競爭(zheng)力(li)的(de)優勢企(qi)(qi)業(ye)(ye)(ye)(ye)集中。引(yin)導(dao)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)立足功(gong)能定位,通過(guo)市(shi)場(chang)化(hua)手(shou)段盤活存量資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)、優化(hua)增(zeng)量資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)。陜西(xi)積極推(tui)動(dong)(dong)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)通過(guo)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)設立、股權(quan)(quan)收購等方式,進入(ru)航空、新材料和(he)半導(dao)體(ti)激光芯片產業(ye)(ye)(ye)(ye)。貴州指導(dao)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)規范發行(xing)企(qi)(qi)業(ye)(ye)(ye)(ye)債(zhai)(zhai)券(quan),盤活存量資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben),推(tui)進資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)產證券(quan)化(hua)。三(san)是助(zhu)力(li)企(qi)(qi)業(ye)(ye)(ye)(ye)“處(chu)(chu)僵(jiang)治困(kun)”。通過(guo)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)推(tui)進國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)源整合和(he)“僵(jiang)尸企(qi)(qi)業(ye)(ye)(ye)(ye)”處(chu)(chu)置,推(tui)動(dong)(dong)困(kun)難企(qi)(qi)業(ye)(ye)(ye)(ye)實現(xian)扭虧為盈。天津將(jiang)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)作為供(gong)給側(ce)結構性改(gai)(gai)革(ge)平臺,為企(qi)(qi)業(ye)(ye)(ye)(ye)債(zhai)(zhai)務提供(gong)增(zeng)信支(zhi)持,推(tui)動(dong)(dong)市(shi)管企(qi)(qi)業(ye)(ye)(ye)(ye)化(hua)解債(zhai)(zhai)務風(feng)險。重(zhong)(zhong)慶組建(jian)(jian)渝康資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)產管理公(gong)(gong)司(si)作為國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)(yun)營(ying)(ying)(ying)(ying)公(gong)(gong)司(si)中專司(si)不良(liang)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)產處(chu)(chu)置的(de)專業(ye)(ye)(ye)(ye)公(gong)(gong)司(si)。
四、經營(ying)性(xing)國(guo)(guo)(guo)有資(zi)(zi)產(chan)集(ji)中(zhong)統(tong)(tong)(tong)一(yi)(yi)監(jian)(jian)管(guan)(guan)成效明顯。一(yi)(yi)是(shi)加強頂層(ceng)設計和組織推動。將推進(jin)經營(ying)性(xing)國(guo)(guo)(guo)有資(zi)(zi)產(chan)集(ji)中(zhong)統(tong)(tong)(tong)一(yi)(yi)監(jian)(jian)管(guan)(guan)作為本(ben)地(di)區國(guo)(guo)(guo)資(zi)(zi)國(guo)(guo)(guo)企改革文件的重(zhong)要內容,進(jin)一(yi)(yi)步明確政(zheng)企分(fen)開、政(zheng)資(zi)(zi)分(fen)開原則(ze)。安徽、江(jiang)蘇等19個(ge)地(di)方出臺了(le)關(guan)于推進(jin)經營(ying)性(xing)國(guo)(guo)(guo)有資(zi)(zi)產(chan)集(ji)中(zhong)統(tong)(tong)(tong)一(yi)(yi)監(jian)(jian)管(guan)(guan)的實施意(yi)見或專(zhuan)門文件。二是(shi)積極擴大(da)監(jian)(jian)管(guan)(guan)范圍(wei)。截至2017年(nian)底(di),全(quan)國(guo)(guo)(guo)省(sheng)(sheng)級國(guo)(guo)(guo)資(zi)(zi)委(wei)經營(ying)性(xing)國(guo)(guo)(guo)有資(zi)(zi)產(chan)監(jian)(jian)管(guan)(guan)覆蓋面已(yi)經達到90%左右,較(jiao)2012年(nian)提高了(le)20個(ge)百分(fen)點。其中(zhong)天(tian)津(jin)、山(shan)東、上(shang)海(hai)、陜西、福建、新疆兵團、大(da)連、青(qing)島(dao)、深圳已(yi)基本(ben)實現省(sheng)(sheng)級經營(ying)性(xing)國(guo)(guo)(guo)有資(zi)(zi)產(chan)全(quan)部納(na)(na)入國(guo)(guo)(guo)資(zi)(zi)委(wei)監(jian)(jian)管(guan)(guan),23個(ge)省(sheng)(sheng)市(shi)將金融類企業(ye)(ye)納(na)(na)入國(guo)(guo)(guo)資(zi)(zi)委(wei)監(jian)(jian)管(guan)(guan)范圍(wei)。三是(shi)發揮國(guo)(guo)(guo)資(zi)(zi)委(wei)專(zhuan)業(ye)(ye)化監(jian)(jian)管(guan)(guan)優勢。在(zai)推進(jin)集(ji)中(zhong)統(tong)(tong)(tong)一(yi)(yi)監(jian)(jian)管(guan)(guan)過程中(zhong),注(zhu)重(zhong)制度規則(ze)的統(tong)(tong)(tong)一(yi)(yi),國(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)(guan)專(zhuan)業(ye)(ye)化、規范化水平不斷提升。北京、海(hai)南(nan)等地(di)將其他部門管(guan)(guan)理的企業(ye)(ye)納(na)(na)入國(guo)(guo)(guo)資(zi)(zi)委(wei)統(tong)(tong)(tong)一(yi)(yi)的基礎管(guan)(guan)理體系(xi),實現了(le)國(guo)(guo)(guo)家出資(zi)(zi)企業(ye)(ye)統(tong)(tong)(tong)一(yi)(yi)產(chan)權登記、統(tong)(tong)(tong)一(yi)(yi)資(zi)(zi)產(chan)統(tong)(tong)(tong)計、統(tong)(tong)(tong)一(yi)(yi)考核評價。

●中央(yang)企業法治工作硬措(cuo)施(shi)
1、中林集團:完善企(qi)業領(ling)導班子(zi)知識結構,在相同(tong)條(tiao)件下,優先提拔使用法(fa)治素養好、依法(fa)辦(ban)事能力強(qiang)的干部(bu)。落實問(wen)責(ze)制度,企(qi)業重大經(jing)營活(huo)動因未經(jing)法(fa)律審核(he),或者雖經(jing)審核(he)但未采納(na)正確(que)法(fa)律意(yi)見而造成重大損(sun)失的,要追(zhui)究企(qi)業相關領(ling)導人員責(ze)任。
