國有資產監(jian)管(guan)大格局(ju)的指導意(yi)見
為(wei)深(shen)入(ru)貫徹落實黨的十(shi)八大和(he)十(shi)八屆三中全(quan)會精神,進(jin)一步完善全(quan)區(qu)(qu)國(guo)(guo)有(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)管(guan)(guan)體制,提高全(quan)區(qu)(qu)國(guo)(guo)有(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)管(guan)(guan)水平,根據《中華人民共和(he)國(guo)(guo)企(qi)業國(guo)(guo)有(you)(you)(you)資(zi)(zi)產法(fa)》、《企(qi)業國(guo)(guo)有(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)督管(guan)(guan)理暫行條例》、《地方(fang)國(guo)(guo)有(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)管(guan)(guan)工作(zuo)指導(dao)監(jian)(jian)(jian)(jian)督辦法(fa)》(國(guo)(guo)務院國(guo)(guo)資(zi)(zi)委令第25號)等(deng)法(fa)律法(fa)規,結合實際(ji),現(xian)就加(jia)(jia)強市、縣(xian)(市、區(qu)(qu),以(yi)下簡(jian)稱縣(xian))國(guo)(guo)有(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)管(guan)(guan)工作(zuo)、加(jia)(jia)快構建(jian)全(quan)區(qu)(qu)國(guo)(guo)有(you)(you)(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)管(guan)(guan)大格局,提出(chu)如下指導(dao)意見。
一、重要意義
市、縣(xian)(xian)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)工(gong)作是(shi)全(quan)(quan)區國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)工(gong)作的(de)重(zhong)要組(zu)成部分。經過(guo)多(duo)年的(de)改革發(fa)展,全(quan)(quan)區市、縣(xian)(xian)兩(liang)級(ji)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)體制機制不(bu)(bu)斷完(wan)善,國(guo)(guo)(guo)(guo)有(you)(you)(you)經濟布(bu)局結構(gou)不(bu)(bu)斷優(you)化,國(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)業規模質量不(bu)(bu)斷提升,市、縣(xian)(xian)兩(liang)級(ji)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)企(qi)成為推動(dong)本地(di)區經濟社會發(fa)展的(de)骨(gu)干力量。但(dan)是(shi),部分市、縣(xian)(xian)面臨著國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)體制不(bu)(bu)夠完(wan)善、履行國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)出資(zi)(zi)(zi)人職(zhi)責不(bu)(bu)夠到位、國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)工(gong)作進展不(bu)(bu)夠平(ping)衡(heng)、企(qi)業國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)基礎性管(guan)理(li)工(gong)作與形勢任務要求不(bu)(bu)適應,以及國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)機構(gou)與有(you)(you)(you)關部門(men)的(de)關系尚(shang)未(wei)完(wan)全(quan)(quan)理(li)順、縣(xian)(xian)級(ji)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)出資(zi)(zi)(zi)人制度(du)尚(shang)未(wei)完(wan)全(quan)(quan)落實、各級(ji)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)聯合(he)互動(dong)的(de)工(gong)作機制尚(shang)未(wei)真正建立等亟待解決的(de)問題,影響國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)工(gong)作和(he)國(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)業改革的(de)深入推進,需要引(yin)起高度(du)重(zhong)視(shi)。
上級國(guo)(guo)(guo)有資(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)機構(gou)對(dui)下級政府國(guo)(guo)(guo)有資(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)工作(zuo)進(jin)(jin)行指導監(jian)(jian)督,是(shi)維護(hu)國(guo)(guo)(guo)有資(zi)產(chan)(chan)“國(guo)(guo)(guo)家所有、分級代表”的(de)(de)(de)一(yi)(yi)項重要制度(du)安(an)排。加強指導監(jian)(jian)督工作(zuo),是(shi)加快完善(shan)國(guo)(guo)(guo)有資(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)體制和制度(du)的(de)(de)(de)內(nei)在(zai)要求,也是(shi)進(jin)(jin)一(yi)(yi)步加強國(guo)(guo)(guo)有資(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)機構(gou)建設的(de)(de)(de)重要措施,對(dui)于切實解決好(hao)市、縣國(guo)(guo)(guo)有資(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)工作(zuo)存(cun)在(zai)的(de)(de)(de)不(bu)(bu)到位、不(bu)(bu)平衡、不(bu)(bu)適應等問題,提高國(guo)(guo)(guo)有資(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)機構(gou)履職(zhi)能(neng)力,加快構(gou)建整合(he)協調、開放合(he)作(zuo)的(de)(de)(de)國(guo)(guo)(guo)有資(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)大格局,實現(xian)各(ge)級國(guo)(guo)(guo)資(zi)融合(he)發展、聯動發展,更(geng)好(hao)地營(ying)造(zao)國(guo)(guo)(guo)有企業改革發展的(de)(de)(de)良(liang)好(hao)環境,做(zuo)強做(zuo)優國(guo)(guo)(guo)有企業,促進(jin)(jin)全區經濟社會穩中求進(jin)(jin)、穩中向好(hao)發展具(ju)有十分重要的(de)(de)(de)意(yi)義。
二、總體要求
市、縣兩級(ji)政府要加(jia)強對國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)工(gong)(gong)作(zuo)的(de)(de)(de)領(ling)導,按照(zhao)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)分級(ji)管(guan)(guan)理(li)(li)的(de)(de)(de)原則,進(jin)一步明確(que)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)的(de)(de)(de)責任主體(ti)。全區各級(ji)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)機(ji)(ji)構(gou)(gou)要在本(ben)級(ji)黨委(wei)、政府的(de)(de)(de)領(ling)導下,堅持(chi)以(yi)鄧小平(ping)(ping)理(li)(li)論、“三(san)個代表”重要思想和(he)科學(xue)發展(zhan)觀為指(zhi)導,深(shen)入貫徹落實(shi)黨的(de)(de)(de)十八(ba)大、十八(ba)屆(jie)三(san)中全會(hui)精神(shen),緊緊圍繞推(tui)動(dong)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)上(shang)(shang)水平(ping)(ping)、國(guo)(guo)(guo)企發展(zhan)上(shang)(shang)臺階的(de)(de)(de)“兩新(xin)目標”,以(yi)加(jia)強地方國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)機(ji)(ji)構(gou)(gou)建設、推(tui)進(jin)經營性(xing)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)集中統一監(jian)(jian)(jian)管(guan)(guan)、強化企業(ye)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)基礎(chu)管(guan)(guan)理(li)(li)為重點(dian),按照(zhao)以(yi)管(guan)(guan)資(zi)(zi)(zi)(zi)本(ben)為主加(jia)強國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)的(de)(de)(de)要求,充分發揮國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)本(ben)運營平(ping)(ping)臺作(zuo)用,努(nu)力(li)提(ti)高國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)資(zi)(zi)(zi)(zi)本(ben)化、市場化、證券化水平(ping)(ping)。牢(lao)固樹立(li)各級(ji)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)“一盤棋”的(de)(de)(de)理(li)(li)念,立(li)足“指(zhi)導、溝(gou)通、交流、服務(wu)”,加(jia)快健全緊密聯(lian)系、深(shen)度融合、有(you)(you)(you)效整合的(de)(de)(de)工(gong)(gong)作(zuo)系統,不斷完善(shan)指(zhi)導監(jian)(jian)(jian)督有(you)(you)(you)效、互相支持(chi)有(you)(you)(you)力(li)、溝(gou)通協調(diao)順暢的(de)(de)(de)工(gong)(gong)作(zuo)機(ji)(ji)制(zhi),推(tui)動(dong)構(gou)(gou)建國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)大格局,努(nu)力(li)提(ti)升國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)機(ji)(ji)構(gou)(gou)依法(fa)履行(xing)出資(zi)(zi)(zi)(zi)人職責的(de)(de)(de)能(neng)力(li)和(he)水平(ping)(ping),為完善(shan)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)體(ti)制(zhi)機(ji)(ji)制(zhi)、促進(jin)國(guo)(guo)(guo)有(you)(you)(you)企業(ye)改革發展(zhan)作(zuo)出新(xin)貢獻。
三、基本原則
(一)堅(jian)持國(guo)有(you)資產(chan)屬于國(guo)家所有(you)原(yuan)則,落(luo)實國(guo)有(you)資產(chan)監管責任,保障國(guo)有(you)資產(chan)監管政策(ce)法(fa)規的貫徹實施。
(二)堅(jian)持各級政(zheng)府(fu)分(fen)別代表國(guo)(guo)(guo)(guo)家(jia)履行(xing)出(chu)資(zi)(zi)(zi)(zi)(zi)人(ren)職責原則,各級國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)管(guan)機構(gou)應當(dang)根(gen)據本(ben)級政(zheng)府(fu)授權(quan),按照法定職責和程序指導監(jian)督下級國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)管(guan)機構(gou)的工(gong)作,尊重(zhong)和維護下級國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)管(guan)機構(gou)的出(chu)資(zi)(zi)(zi)(zi)(zi)人(ren)權(quan)利,不得代替或(huo)者干預下級國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)管(guan)機構(gou)履行(xing)出(chu)資(zi)(zi)(zi)(zi)(zi)人(ren)職責。
(三(san))堅持政(zheng)企分(fen)(fen)開(kai)、政(zheng)資(zi)分(fen)(fen)開(kai)、所有(you)權(quan)和(he)經營(ying)權(quan)分(fen)(fen)離、政(zheng)府的(de)(de)社會公共管(guan)(guan)(guan)理職能與國(guo)(guo)有(you)資(zi)產(chan)(chan)出資(zi)人職能分(fen)(fen)開(kai)的(de)(de)原則,完善(shan)經營(ying)性國(guo)(guo)有(you)資(zi)產(chan)(chan)監管(guan)(guan)(guan)體(ti)制機(ji)制,積極(ji)探索國(guo)(guo)有(you)資(zi)產(chan)(chan)監管(guan)(guan)(guan)和(he)運營(ying)的(de)(de)有(you)效(xiao)途徑(jing)和(he)方式。
(四)堅(jian)持依法合規(gui)原(yuan)則,加(jia)強分類指導(dao),突出監督重點,增(zeng)強地方國有資產監管(guan)工(gong)作的規(gui)范(fan)性(xing)和有效性(xing)。
四、重點任務
(一(yi))繼續深(shen)化(hua)(hua)國(guo)資國(guo)企(qi)改(gai)革(ge)(ge)。要認(ren)真貫徹落實黨(dang)的十(shi)八大、十(shi)八屆(jie)三中(zhong)全(quan)會(hui)、自治區黨(dang)委十(shi)屆(jie)四次全(quan)會(hui)精神,全(quan)面深(shen)化(hua)(hua)國(guo)資國(guo)企(qi)改(gai)革(ge)(ge),各市、縣要相應(ying)成立深(shen)化(hua)(hua)國(guo)資國(guo)企(qi)改(gai)革(ge)(ge)領(ling)導小(xiao)組,負責整體統籌推(tui)進改(gai)革(ge)(ge)工作(zuo),研究制(zhi)定相關方(fang)案措施,協調解決存在的問題(ti),全(quan)力做(zuo)好本級(ji)政府(fu)深(shen)化(hua)(hua)國(guo)資國(guo)企(qi)改(gai)革(ge)(ge)工作(zuo)。
(二)健(jian)全(quan)(quan)完善國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)管(guan)組織體系(xi)。市、縣政(zheng)府要進一步加強國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)管(guan)機構(gou)建(jian)設(she),堅持(chi)市級國(guo)資(zi)(zi)委政(zheng)府直(zhi)屬特設(she)機構(gou)性質不變,明(ming)確(que)縣級國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)管(guan)責任主體,積極探索(suo)符(fu)合(he)改革要求和本地(di)實際的(de)國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)管(guan)有(you)(you)效方式和途徑,努力實現經營(ying)性國(guo)有(you)(you)資(zi)(zi)產(chan)監(jian)管(guan)和明(ming)確(que)縣級國(guo)資(zi)(zi)監(jian)管(guan)責任主體的(de)“全(quan)(quan)覆蓋”。
(三)健全(quan)完善(shan)國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)制(zhi)(zhi)度(du)(du)體系(xi)。市、縣國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)機構(gou)要依據(ju)《中華人民共(gong)和(he)國(guo)(guo)(guo)(guo)企(qi)(qi)業國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)法》和(he)《企(qi)(qi)業國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)監(jian)(jian)督(du)(du)管(guan)(guan)(guan)(guan)(guan)理(li)暫行條例》,在國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)出資人制(zhi)(zhi)度(du)(du)、國(guo)(guo)(guo)(guo)家出資企(qi)(qi)業制(zhi)(zhi)度(du)(du)和(he)國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)統一(yi)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)制(zhi)(zhi)度(du)(du)三大制(zhi)(zhi)度(du)(du)框架(jia)下,健全(quan)完善(shan)本地區具體規章(zhang)制(zhi)(zhi)度(du)(du),形成監(jian)(jian)督(du)(du)有(you)(you)力、管(guan)(guan)(guan)(guan)(guan)理(li)科學、運作高效的國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)制(zhi)(zhi)度(du)(du)體系(xi)。要切實加(jia)強國(guo)(guo)(guo)(guo)有(you)(you)資產(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)(guan)法律、行政法規和(he)規章(zhang)的執行力度(du)(du),強化監(jian)(jian)督(du)(du)檢查(cha),確保各項制(zhi)(zhi)度(du)(du)落(luo)實到位。
(四)健(jian)全(quan)完善(shan)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)體系。市、縣國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)機構要深入(ru)探(tan)索國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)規(gui)律,進(jin)一步(bu)充實(shi)(shi)完善(shan)以(yi)發展戰(zhan)(zhan)略(lve)制(zhi)(zhi)定、主業(ye)核定、業(ye)績考核、薪酬分(fen)配(pei)、企業(ye)領導人員任(聘)免、財務(wu)監督與評價、產(chan)(chan)權管(guan)(guan)(guan)理、監事會監督、風險管(guan)(guan)(guan)控等(deng)為主線(xian)的(de)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)閉環(huan),加快健(jian)全(quan)全(quan)區規(gui)則(ze)統一、分(fen)類分(fen)層、權責明確、運轉高效(xiao)和(he)(he)規(gui)范(fan)透明的(de)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)工(gong)(gong)作(zuo)(zuo)體系。建立完善(shan)經營性(xing)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)集中統一監管(guan)(guan)(guan)制(zhi)(zhi)度,推進(jin)全(quan)面實(shi)(shi)現政企分(fen)開、政資(zi)(zi)(zi)分(fen)開。根據基礎支(zhi)撐、戰(zhan)(zhan)略(lve)引導、公(gong)益產(chan)(chan)品和(he)(he)服務(wu)、一般競爭性(xing)領域等(deng)不同功(gong)能定位(wei),探(tan)索實(shi)(shi)行國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)分(fen)類監管(guan)(guan)(guan),提(ti)高國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)的(de)針對(dui)性(xing)有(you)(you)(you)(you)(you)效(xiao)性(xing),全(quan)面落(luo)實(shi)(shi)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)(zi)產(chan)(chan)保值增值責任。
(五)健全完善(shan)指導(dao)(dao)(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)(zuo)機(ji)制(zhi)。自治區和(he)市(shi)級國(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)機(ji)構要(yao)嚴格按照《地方國(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)工(gong)(gong)作(zuo)(zuo)指導(dao)(dao)(dao)監(jian)督(du)(du)辦法》(國(guo)(guo)務院國(guo)(guo)資(zi)(zi)委令第25號)的(de)規(gui)(gui)定,進(jin)一步明確指導(dao)(dao)(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)(zuo)的(de)主要(yao)職責和(he)要(yao)求,充分發揮好指導(dao)(dao)(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)(zuo)的(de)引(yin)導(dao)(dao)(dao)、規(gui)(gui)范(fan)、提(ti)高和(he)促進(jin)作(zuo)(zuo)用。要(yao)加(jia)快(kuai)完善(shan)上(shang)下聯動、規(gui)(gui)范(fan)有(you)序、全面覆(fu)蓋的(de)指導(dao)(dao)(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)(zuo)機(ji)制(zhi),始終堅持(chi)指導(dao)(dao)(dao)寓于服(fu)務之(zhi)中,把指導(dao)(dao)(dao)監(jian)督(du)(du)下級國(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)工(gong)(gong)作(zuo)(zuo)的(de)重點放在(zai)加(jia)強監(jian)管(guan)(guan)機(ji)構建設與提(ti)高監(jian)管(guan)(guan)機(ji)構依法履職的(de)能力和(he)水平、指導(dao)(dao)(dao)地方國(guo)(guo)有(you)經濟布(bu)局結構調整、指導(dao)(dao)(dao)和(he)支持(chi)國(guo)(guo)有(you)企業改革發展(zhan)、加(jia)強國(guo)(guo)有(you)資(zi)(zi)產(chan)(chan)(chan)基礎管(guan)(guan)理等(deng)重點環節上(shang),確保指導(dao)(dao)(dao)監(jian)督(du)(du)及(ji)時(shi)有(you)效(xiao)。
五、主要措施
(一)切(qie)實加強組(zu)織(zhi)領導。市(shi)、縣政(zheng)府要(yao)(yao)高(gao)度重(zhong)視國(guo)(guo)有資產監管工作(zuo),充分(fen)認識在新形勢下加強和完善(shan)國(guo)(guo)有資產監管工作(zuo)的(de)重(zhong)要(yao)(yao)意義,為(wei)開展監管工作(zuo)創造必(bi)要(yao)(yao)條件(jian)。市(shi)、縣國(guo)(guo)有資產監管機構要(yao)(yao)把加強國(guo)(guo)資監管工作(zuo)列入重(zhong)要(yao)(yao)議事日程(cheng),研究制訂切(qie)實可行的(de)工作(zuo)計劃(hua)和實施(shi)方(fang)案,落實工作(zuo)職(zhi)責,加強督促檢查。條件(jian)成熟的(de)市(shi)可將對縣級國(guo)(guo)有資產監管工作(zuo)列入政(zheng)府績效考(kao)評范圍。
(二(er))進一(yi)步明確(que)國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)責(ze)任主體(ti)。市、縣政府要(yao)建(jian)立(li)(li)和完善本級(ji)國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)機(ji)構,做到機(ji)構、人員、職(zhi)能、責(ze)任“四(si)到位(wei)”。國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)數量較大、具備(bei)條(tiao)件(jian)的縣應設立(li)(li)獨立(li)(li)的國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)機(ji)構,暫不(bu)具備(bei)設立(li)(li)獨立(li)(li)監(jian)管(guan)(guan)(guan)機(ji)構的縣應明確(que)一(yi)個履(lv)行國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)職(zhi)責(ze)的部門(men)或組建(jian)國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)經營管(guan)(guan)(guan)理公(gong)司授權統一(yi)監(jian)管(guan)(guan)(guan)。要(yao)認真落(luo)實以管(guan)(guan)(guan)資(zi)(zi)本為主加(jia)強國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)的要(yao)求,調整(zheng)優(you)化(hua)國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監(jian)管(guan)(guan)(guan)職(zhi)能,突出履(lv)行出資(zi)(zi)人職(zhi)責(ze)的重點環節,做到監(jian)管(guan)(guan)(guan)不(bu)缺位(wei)、不(bu)錯位(wei)、不(bu)越(yue)位(wei)。
(三)推動經營(ying)性(xing)國有資(zi)產(chan)集中(zhong)統一(yi)監管(guan)。要切實轉變政(zheng)府職能,加快政(zheng)企(qi)分(fen)開步伐,對(dui)仍(reng)由(you)黨(dang)政(zheng)機關管(guan)理的企(qi)業(ye)和(he)經營(ying)性(xing)資(zi)產(chan)要制定分(fen)離脫鉤方(fang)案和(he)時間表(biao),盡快納入國有資(zi)產(chan)監管(guan)機構實行統一(yi)監管(guan)。支持按照(zhao)出(chu)資(zi)關系(xi)對(dui)地方(fang)金融、文化等領(ling)域經營(ying)性(xing)國有資(zi)產(chan)實行專業(ye)或授權(quan)監管(guan)。
(四)執行(xing)重大(da)事項報(bao)(bao)告(gao)制度。市、縣國(guo)(guo)(guo)資(zi)(zi)監(jian)管機(ji)構要定(ding)期向本(ben)(ben)級黨(dang)委、政府(fu)匯(hui)報(bao)(bao)本(ben)(ben)地區(qu)國(guo)(guo)(guo)資(zi)(zi)國(guo)(guo)(guo)企改革發展(zhan)情(qing)況(kuang)以及(ji)(ji)國(guo)(guo)(guo)有資(zi)(zi)產總(zong)(zong)量、結構、變動、收益等匯(hui)總(zong)(zong)分析(xi)情(qing)況(kuang),圍繞當地經(jing)濟社(she)會發展(zhan)大(da)局和國(guo)(guo)(guo)有經(jing)濟改革發展(zhan)狀(zhuang)況(kuang),提出相關意見建議(yi)。下級國(guo)(guo)(guo)有資(zi)(zi)產監(jian)管機(ji)構要將本(ben)(ben)地區(qu)國(guo)(guo)(guo)有經(jing)濟運行(xing)情(qing)況(kuang)以及(ji)(ji)所出資(zi)(zi)企業匯(hui)總(zong)(zong)月度及(ji)(ji)年(nian)度財務(wu)情(qing)況(kuang)向上一級國(guo)(guo)(guo)有資(zi)(zi)產監(jian)管機(ji)構報(bao)(bao)告(gao)。下級國(guo)(guo)(guo)有資(zi)(zi)產監(jian)管機(ji)構出臺(tai)的規范性文件(jian)要向上一級國(guo)(guo)(guo)有資(zi)(zi)產監(jian)管機(ji)構報(bao)(bao)備。
(五)加強指(zhi)導(dao)(dao)監督(du)工作(zuo)。根據逐級(ji)指(zhi)導(dao)(dao)監督(du)的(de)原則,上級(ji)國(guo)有資(zi)產(chan)(chan)監管機(ji)構應當(dang)加強與下級(ji)政府的(de)溝通協調,加強對下級(ji)國(guo)有資(zi)產(chan)(chan)監管工作(zuo)的(de)調研指(zhi)導(dao)(dao),加強業(ye)務交流和培(pei)訓,及時總結推廣(guang)國(guo)有資(zi)產(chan)(chan)監管和國(guo)有企業(ye)改革發展的(de)典型經(jing)驗,通報開展監督(du)檢查情況。
(六)加強合作(zuo)交流。要(yao)進(jin)一步優(you)化資(zi)源配置(zhi),按照市場(chang)經(jing)濟規(gui)律,大力(li)推進(jin)各級(ji)(ji)(ji)國有資(zi)產(chan)開放性(xing)市場(chang)化有效整合、兼并(bing)重(zhong)組,實現(xian)優(you)勢互補、互利(li)共(gong)贏(ying)。要(yao)進(jin)一步拓寬各級(ji)(ji)(ji)國有資(zi)產(chan)監(jian)(jian)管(guan)(guan)機構信息交流渠(qu)道,建(jian)立健(jian)全國有資(zi)產(chan)基礎管(guan)(guan)理信息平臺,大力(li)推進(jin)信息交流工作(zuo)的(de)制(zhi)度(du)化、規(gui)范化,逐步實現(xian)信息互通,數據共(gong)享(xiang)。要(yao)積極搭建(jian)人才隊伍培養平臺,健(jian)全完善各級(ji)(ji)(ji)國有資(zi)產(chan)監(jian)(jian)管(guan)(guan)機構之間、國有資(zi)產(chan)監(jian)(jian)管(guan)(guan)機構與監(jian)(jian)管(guan)(guan)企業之間的(de)人員(yuan)雙向(xiang)交流掛職制(zhi)度(du),努(nu)力(li)實現(xian)人才資(zi)源共(gong)享(xiang)。
(七)嚴格實施(shi)監(jian)督檢查。各級國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監(jian)管機構(gou)要依法加強(qiang)對下(xia)級政(zheng)府國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監(jian)管工作(zuo)的監(jian)督檢查,上級國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監(jian)管機構(gou)發(fa)現下(xia)級政(zheng)府國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監(jian)管工作(zuo)中(zhong)存在與國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)監(jian)管法律、行政(zheng)法規和國(guo)(guo)家方(fang)針政(zheng)策不(bu)符情形的,應當依法提出糾正意見或(huo)處理(li)建議(yi)。
(八)著(zhu)力發(fa)展(zhan)(zhan)地方國(guo)(guo)有(you)優(you)(you)勢(shi)特(te)色(se)企(qi)業。繼續推(tui)動國(guo)(guo)有(you)企(qi)業加快轉型(xing)升級和調整(zheng)產業結構,推(tui)進自(zi)主創新、優(you)(you)化內(nei)部(bu)資(zi)源(yuan)配置,大力發(fa)展(zhan)(zhan)新型(xing)混合(he)所有(you)制企(qi)業,推(tui)動國(guo)(guo)有(you)資(zi)本(ben)(ben)、集體資(zi)本(ben)(ben)、非公有(you)資(zi)本(ben)(ben)相互融合(he)、優(you)(you)勢(shi)互補、共同發(fa)展(zhan)(zhan),探索改組或組建國(guo)(guo)有(you)資(zi)本(ben)(ben)投資(zi)運(yun)營公司,加快打造(zao)一批具有(you)競爭力和影響力的地方優(you)(you)勢(shi)特(te)色(se)企(qi)業。
(九)大力加(jia)強自身建設(she)。要大力推(tui)動國有(you)資(zi)產監管(guan)機(ji)構(gou)專業化、規范(fan)化、制度化建設(she),切實改進干部作風,強化大局意(yi)識、責任(ren)意(yi)識、服務意(yi)識、擔當意(yi)識,提(ti)升履(lv)職能力,提(ti)高監管(guan)水平。要依法規范(fan)出資(zi)人行權履(lv)責的各項活動,重視合法性、合規性審查,強化監督機(ji)制,防(fang)范(fan)法律風險,全面提(ti)高國有(you)資(zi)產監管(guan)工作規范(fan)化水平。
