國資委關于2017年度法治建設工作情況的報告

貫徹落實中(zhong)共中(zhong)央、國務院印發的《法治(zhi)政府建設(she)實施綱要(2015-2020年)》(以下(xia)簡稱《綱要》)要求,國資(zi)委2017年法治(zhi)建設(she)工作取得積極進展:

2017年(nian),國(guo)(guo)(guo)資(zi)(zi)委(wei)認(ren)真學習(xi)(xi)貫徹習(xi)(xi)近平新(xin)時代中國(guo)(guo)(guo)特(te)色社(she)會主(zhu)義思(si)想和黨(dang)的十九大精神(shen),深入貫徹全面(mian)依法(fa)治(zhi)國(guo)(guo)(guo)戰略部署(shu),認(ren)真落實(shi)《綱要》,扎實(shi)推(tui)進《國(guo)(guo)(guo)務院國(guo)(guo)(guo)資(zi)(zi)委(wei)推(tui)進國(guo)(guo)(guo)資(zi)(zi)監管(guan)法(fa)治(zhi)機(ji)構建設實(shi)施(shi)方案(an)》(國(guo)(guo)(guo)資(zi)(zi)發(fa)法(fa)規〔2016〕134號)各項任務措施(shi),在依法(fa)全面(mian)履職、完善法(fa)規體系、健全決策機(ji)制、強(qiang)化權(quan)力(li)監督、有效(xiao)化解矛(mao)盾、提升法(fa)治(zhi)能力(li)等(deng)方面(mian)取得明(ming)顯(xian)成效(xiao),國(guo)(guo)(guo)資(zi)(zi)國(guo)(guo)(guo)企法(fa)治(zhi)建設邁出新(xin)步(bu)伐。

一、切(qie)實(shi)加(jia)強對法治(zhi)建設(she)的領導和頂層(ceng)制度設(she)計

一(yi)(yi)是(shi)深入學(xue)習貫(guan)徹(che)習近平總(zong)書(shu)記(ji)關(guan)于全(quan)(quan)面依法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國(guo)(guo)新(xin)(xin)理(li)(li)念(nian)新(xin)(xin)思想(xiang)新(xin)(xin)戰(zhan)略。黨(dang)(dang)(dang)的(de)十(shi)九(jiu)大(da)把堅持全(quan)(quan)面依法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國(guo)(guo)確立為新(xin)(xin)時代堅持和發展中(zhong)國(guo)(guo)特色社會(hui)(hui)主(zhu)(zhu)義的(de)十(shi)四(si)條基本方(fang)(fang)略之一(yi)(yi),對深化依法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國(guo)(guo)實(shi)(shi)(shi)(shi)踐作(zuo)出全(quan)(quan)面部署,為全(quan)(quan)面推(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)各項工(gong)作(zuo)提(ti)(ti)供(gong)了根本遵循(xun)。國(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)牢固樹立“四(si)個意(yi)識”,通過(guo)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)會(hui)(hui)和中(zhong)心組學(xue)習、專題學(xue)習研(yan)討等方(fang)(fang)式,多次學(xue)習貫(guan)徹(che)習近平總(zong)書(shu)記(ji)關(guan)于全(quan)(quan)面依法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國(guo)(guo)新(xin)(xin)理(li)(li)念(nian)新(xin)(xin)思想(xiang)新(xin)(xin)戰(zhan)略,深刻領(ling)會(hui)(hui)總(zong)書(shu)記(ji)依法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)國(guo)(guo)、依規(gui)治(zhi)(zhi)(zhi)黨(dang)(dang)(dang)重(zhong)要(yao)論(lun)述和中(zhong)央(yang)政(zheng)法(fa)(fa)(fa)(fa)工(gong)作(zuo)會(hui)(hui)議精神,并(bing)提(ti)(ti)出貫(guan)徹(che)落實(shi)(shi)(shi)(shi)要(yao)求(qiu)。二是(shi)切實(shi)(shi)(shi)(shi)落實(shi)(shi)(shi)(shi)第(di)一(yi)(yi)責(ze)(ze)(ze)任人(ren)(ren)(ren)職(zhi)(zhi)責(ze)(ze)(ze)。貫(guan)徹(che)《黨(dang)(dang)(dang)政(zheng)主(zhu)(zhu)要(yao)負責(ze)(ze)(ze)人(ren)(ren)(ren)履行(xing)推(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)第(di)一(yi)(yi)責(ze)(ze)(ze)任人(ren)(ren)(ren)職(zhi)(zhi)責(ze)(ze)(ze)規(gui)定》(中(zhong)辦發〔2016〕71號)要(yao)求(qiu),黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)書(shu)記(ji)直接(jie)分(fen)管政(zheng)策法(fa)(fa)(fa)(fa)規(gui)工(gong)作(zuo),黨(dang)(dang)(dang)政(zheng)主(zhu)(zhu)要(yao)負責(ze)(ze)(ze)同(tong)志專門(men)研(yan)究、認真(zhen)謀(mou)劃國(guo)(guo)資(zi)國(guo)(guo)企(qi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)年度(du)工(gong)作(zuo)任務,并(bing)納入《國(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)2017年工(gong)作(zuo)要(yao)點》,確保(bao)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)與其(qi)他重(zhong)點工(gong)作(zuo)同(tong)部署、同(tong)推(tui)進(jin)、同(tong)督促。推(tui)動(dong)建(jian)(jian)立并(bing)帶頭落實(shi)(shi)(shi)(shi)規(gui)章、規(gui)范性(xing)文件和重(zhong)大(da)決策法(fa)(fa)(fa)(fa)律審核(he)制度(du),依法(fa)(fa)(fa)(fa)依規(gui)決策重(zhong)大(da)事項。在中(zhong)央(yang)企(qi)業(ye)、地(di)方(fang)(fang)國(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)負責(ze)(ze)(ze)人(ren)(ren)(ren)會(hui)(hui)議上(shang)對依法(fa)(fa)(fa)(fa)監管、依法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)企(qi)作(zuo)出部署,明確要(yao)求(qiu)中(zhong)央(yang)企(qi)業(ye)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)(黨(dang)(dang)(dang)組)書(shu)記(ji)、董事長(chang)、總(zong)經理(li)(li)切實(shi)(shi)(shi)(shi)履行(xing)推(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)第(di)一(yi)(yi)責(ze)(ze)(ze)任人(ren)(ren)(ren)職(zhi)(zhi)責(ze)(ze)(ze),層層壓實(shi)(shi)(shi)(shi)主(zhu)(zhu)體責(ze)(ze)(ze)任。三是(shi)強化制度(du)設(she)計(ji)。委(wei)(wei)(wei)(wei)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)會(hui)(hui)、委(wei)(wei)(wei)(wei)主(zhu)(zhu)任辦公會(hui)(hui)多次研(yan)究討論(lun)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工(gong)作(zuo),先后制定《中(zhong)央(yang)企(qi)業(ye)主(zhu)(zhu)要(yao)負責(ze)(ze)(ze)人(ren)(ren)(ren)履行(xing)推(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)第(di)一(yi)(yi)責(ze)(ze)(ze)任人(ren)(ren)(ren)職(zhi)(zhi)責(ze)(ze)(ze)規(gui)定》《中(zhong)央(yang)企(qi)業(ye)境外投資(zi)監督管理(li)(li)辦法(fa)(fa)(fa)(fa)》《國(guo)(guo)資(zi)委(wei)(wei)(wei)(wei)關(guan)于加強和改進(jin)行(xing)政(zheng)應訴(su)工(gong)作(zuo)的(de)實(shi)(shi)(shi)(shi)施意(yi)見》等文件,為國(guo)(guo)資(zi)國(guo)(guo)企(qi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)(jian)設(she)提(ti)(ti)供(gong)制度(du)支撐(cheng)和保(bao)障。

二、依法全(quan)面履行國有資(zi)產監(jian)管(guan)職責

一(yi)是研究制訂國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)以(yi)管(guan)資(zi)(zi)(zi)(zi)(zi)本(ben)(ben)為(wei)主(zhu)(zhu)推(tui)(tui)進職(zhi)能(neng)轉(zhuan)(zhuan)變(bian)方(fang)案(an)。認真貫(guan)徹國(guo)(guo)務(wu)院(yuan)(yuan)關(guan)(guan)于深化(hua)“放(fang)管(guan)服”改(gai)革工作部署,研究起草國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)職(zhi)能(neng)轉(zhuan)(zhuan)變(bian)方(fang)案(an),經中央(yang)全面深化(hua)改(gai)革領(ling)導小組(zu)第(di)三(san)十次會議審議通過(guo)。2017年4月(yue)27日,國(guo)(guo)務(wu)院(yuan)(yuan)辦公廳(ting)轉(zhuan)(zhuan)發(fa)了《國(guo)(guo)務(wu)院(yuan)(yuan)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)以(yi)管(guan)資(zi)(zi)(zi)(zi)(zi)本(ben)(ben)為(wei)主(zhu)(zhu)推(tui)(tui)進職(zhi)能(neng)轉(zhuan)(zhuan)變(bian)方(fang)案(an)》(以(yi)下簡稱《職(zhi)能(neng)轉(zhuan)(zhuan)變(bian)方(fang)案(an)》),提出(chu)(chu)強化(hua)3項(xiang)管(guan)資(zi)(zi)(zi)(zi)(zi)本(ben)(ben)職(zhi)能(neng),精簡43項(xiang)監(jian)(jian)管(guan)事項(xiang),整合三(san)方(fang)面相關(guan)(guan)職(zhi)能(neng)。國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)黨委(wei)(wei)第(di)一(yi)時間組(zu)織中心(xin)組(zu)專題(ti)學習,研究制定(ding)了《貫(guan)徹落(luo)實〈國(guo)(guo)務(wu)院(yuan)(yuan)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)以(yi)管(guan)資(zi)(zi)(zi)(zi)(zi)本(ben)(ben)為(wei)主(zhu)(zhu)推(tui)(tui)進職(zhi)能(neng)轉(zhuan)(zhuan)變(bian)方(fang)案(an)〉重點(dian)任(ren)務(wu)分工方(fang)案(an)》(國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)廳(ting)法規〔2017〕586號),確保(bao)各項(xiang)任(ren)務(wu)措施落(luo)實落(luo)細(xi)。二是制定(ding)出(chu)(chu)資(zi)(zi)(zi)(zi)(zi)人監(jian)(jian)管(guan)權(quan)(quan)力(li)和(he)責任(ren)清單(dan)。結合國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)《職(zhi)能(neng)轉(zhuan)(zhuan)變(bian)方(fang)案(an)》和(he)簡政放(fang)權(quan)(quan)要(yao)求,研究制定(ding)國(guo)(guo)務(wu)院(yuan)(yuan)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委(wei)(wei)出(chu)(chu)資(zi)(zi)(zi)(zi)(zi)人監(jian)(jian)管(guan)權(quan)(quan)力(li)和(he)責任(ren)清單(dan),依法厘清國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)職(zhi)責邊界,明(ming)確權(quan)(quan)責事項(xiang),規范履職(zhi)方(fang)式和(he)流(liu)程,細(xi)化(hua)追責情形。三(san)是依法加(jia)強國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產監(jian)(jian)督(du)。健全完善(shan)中央(yang)企(qi)業境外(wai)投資(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)制度(du),強化(hua)境外(wai)重大投資(zi)(zi)(zi)(zi)(zi)項(xiang)目審核把關(guan)(guan),指(zhi)導中央(yang)企(qi)業定(ding)期排(pai)查(cha)并(bing)妥善(shan)處置境外(wai)法律(lv)風險,健全長效(xiao)工作機制,確保(bao)境外(wai)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產安(an)全運營和(he)保(bao)值增值。進一(yi)步(bu)完善(shan)財務(wu)監(jian)(jian)管(guan),向部分中央(yang)企(qi)業委(wei)(wei)派(pai)總會計師,加(jia)強出(chu)(chu)資(zi)(zi)(zi)(zi)(zi)人對企(qi)業審計監(jian)(jian)督(du),指(zhi)導企(qi)業開展內(nei)審工作,督(du)促整改(gai)審計問題(ti)。強化(hua)監(jian)(jian)事會監(jian)(jian)督(du),進一(yi)步(bu)突(tu)出(chu)(chu)監(jian)(jian)督(du)重點(dian)、深入核查(cha)問題(ti)、強化(hua)督(du)促整改(gai),監(jian)(jian)督(du)的權(quan)(quan)威性、及時性和(he)有(you)效(xiao)性明(ming)顯增強。

三、完善國資監(jian)管法規制度體系

一是(shi)(shi)做好(hao)(hao)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)立(li)(li)法(fa)(fa)(fa)(fa)工(gong)作(zuo)。編制國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)2017年(nian)立(li)(li)法(fa)(fa)(fa)(fa)工(gong)作(zuo)計劃(hua)(hua),列入立(li)(li)法(fa)(fa)(fa)(fa)項(xiang)(xiang)目23項(xiang)(xiang),優(you)先(xian)保障國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)企(qi)改革(ge)發展(zhan)(zhan)急(ji)需項(xiang)(xiang)目,切實(shi)提高計劃(hua)(hua)的(de)(de)科(ke)學性(xing)針(zhen)對(dui)(dui)性(xing)。共出臺規(gui)(gui)(gui)章(zhang)(zhang)2件(jian)(jian)、規(gui)(gui)(gui)范性(xing)文件(jian)(jian)23件(jian)(jian),包括《中(zhong)(zhong)央(yang)企(qi)業(ye)功能界(jie)定(ding)(ding)分(fen)類方案》《關(guan)于中(zhong)(zhong)央(yang)企(qi)業(ye)降杠桿(gan)減負債的(de)(de)指導(dao)意見(jian)》等。加(jia)強立(li)(li)法(fa)(fa)(fa)(fa)調(diao)研,在文件(jian)(jian)起草過程中(zhong)(zhong)充分(fen)聽(ting)取中(zhong)(zhong)央(yang)企(qi)業(ye)、地方國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)意見(jian),切實(shi)提高文件(jian)(jian)質量(liang)。截至2017年(nian)底,國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)現行(xing)有效(xiao)規(gui)(gui)(gui)章(zhang)(zhang)27件(jian)(jian)、規(gui)(gui)(gui)范性(xing)文件(jian)(jian)227件(jian)(jian),系統完備、科(ke)學有效(xiao)的(de)(de)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)法(fa)(fa)(fa)(fa)規(gui)(gui)(gui)制度(du)體(ti)系進一步形成。二是(shi)(shi)持(chi)續開展(zhan)(zhan)規(gui)(gui)(gui)章(zhang)(zhang)規(gui)(gui)(gui)范性(xing)文件(jian)(jian)清(qing)理工(gong)作(zuo)。堅持(chi)立(li)(li)改廢釋(shi)并舉(ju),結合國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)(wei)職(zhi)能轉變方案、國(guo)(guo)(guo)(guo)務院“放(fang)管(guan)(guan)(guan)服”改革(ge)和(he)(he)公(gong)平競爭審查(cha)工(gong)作(zuo)要求,對(dui)(dui)我委(wei)(wei)(wei)(wei)現行(xing)有效(xiao)的(de)(de)規(gui)(gui)(gui)章(zhang)(zhang)、規(gui)(gui)(gui)范性(xing)文件(jian)(jian)進行(xing)全面(mian)清(qing)理,重點清(qing)理與(yu)上位法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)(gui)不(bu)一致(zhi)、與(yu)以管(guan)(guan)(guan)資(zi)(zi)(zi)本為(wei)主加(jia)強國(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)產監(jian)(jian)管(guan)(guan)(guan)要求不(bu)相符、與(yu)法(fa)(fa)(fa)(fa)治化監(jian)(jian)管(guan)(guan)(guan)不(bu)相適(shi)應的(de)(de)文件(jian)(jian),共廢止失效(xiao)32件(jian)(jian)、計劃(hua)(hua)修改36件(jian)(jian)。三是(shi)(shi)積(ji)極參(can)與(yu)重點國(guo)(guo)(guo)(guo)家立(li)(li)法(fa)(fa)(fa)(fa)。配合中(zhong)(zhong)央(yang)紀委(wei)(wei)(wei)(wei)開展(zhan)(zhan)國(guo)(guo)(guo)(guo)家監(jian)(jian)察(cha)法(fa)(fa)(fa)(fa)實(shi)施(shi)問題研究,參(can)與(yu)預算法(fa)(fa)(fa)(fa)實(shi)施(shi)條(tiao)例、中(zhong)(zhong)央(yang)儲(chu)備糧管(guan)(guan)(guan)理條(tiao)例、上市公(gong)司監(jian)(jian)督管(guan)(guan)(guan)理條(tiao)例等重要法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)(gui)制訂修訂工(gong)作(zuo),積(ji)極反映國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)實(shi)際(ji)和(he)(he)中(zhong)(zhong)央(yang)企(qi)業(ye)合理訴求,為(wei)企(qi)業(ye)改革(ge)發展(zhan)(zhan)營造良(liang)好(hao)(hao)政策法(fa)(fa)(fa)(fa)律(lv)環境(jing)。四是(shi)(shi)參(can)與(yu)有關(guan)國(guo)(guo)(guo)(guo)際(ji)條(tiao)約(yue)和(he)(he)多雙邊協定(ding)(ding)的(de)(de)談(tan)判(pan)(pan)和(he)(he)制定(ding)(ding)。積(ji)極參(can)加(jia)中(zhong)(zhong)美(mei)投資(zi)(zi)(zi)協定(ding)(ding)談(tan)判(pan)(pan)、中(zhong)(zhong)歐投資(zi)(zi)(zi)協定(ding)(ding)談(tan)判(pan)(pan)、中(zhong)(zhong)加(jia)自貿區談(tan)判(pan)(pan)等政府(fu)間涉外談(tan)判(pan)(pan)對(dui)(dui)話(hua),努力為(wei)企(qi)業(ye)開展(zhan)(zhan)國(guo)(guo)(guo)(guo)際(ji)化經營創造良(liang)好(hao)(hao)外部環境(jing)。

四、推進決策(ce)科學化、民主化、法治化

一是完善依(yi)法(fa)(fa)決(jue)策程(cheng)序。研究修訂國(guo)(guo)資(zi)委(wei)工(gong)作(zuo)規(gui)則,進(jin)(jin)一步(bu)對決(jue)策主體、決(jue)策事項(xiang)、決(jue)策程(cheng)序等進(jin)(jin)行規(gui)范,明確重(zhong)大決(jue)策應當經(jing)委(wei)黨委(wei)會、委(wei)主任辦(ban)公(gong)(gong)(gong)會議討論(lun)決(jue)定。二(er)是加強(qiang)重(zhong)大決(jue)策合法(fa)(fa)性審(shen)查。建立(li)健全(quan)國(guo)(guo)資(zi)委(wei)重(zhong)大決(jue)策合法(fa)(fa)性審(shen)查機(ji)(ji)制,對中央(yang)企(qi)業章程(cheng)、改制重(zhong)組方(fang)案、國(guo)(guo)有資(zi)本運(yun)營(ying)等涉及國(guo)(guo)資(zi)國(guo)(guo)企(qi)改革發展的(de)重(zhong)大決(jue)策事項(xiang)進(jin)(jin)行法(fa)(fa)律(lv)(lv)論(lun)證把關。建立(li)國(guo)(guo)資(zi)委(wei)公(gong)(gong)(gong)平競爭審(shen)查機(ji)(ji)制,對涉及的(de)規(gui)章規(gui)范性文(wen)件(jian)和政策措施進(jin)(jin)行公(gong)(gong)(gong)平競爭審(shen)查,確保監(jian)管行為(wei)依(yi)法(fa)(fa)合規(gui)。三(san)是建立(li)國(guo)(guo)資(zi)委(wei)公(gong)(gong)(gong)職律(lv)(lv)師和法(fa)(fa)律(lv)(lv)顧問(wen)(wen)制度。經(jing)司法(fa)(fa)部批準,9名(ming)同志成為(wei)國(guo)(guo)資(zi)委(wei)第(di)一批公(gong)(gong)(gong)職律(lv)(lv)師,正(zheng)式聘(pin)(pin)任17名(ming)專家學(xue)者、知名(ming)律(lv)(lv)師為(wei)外聘(pin)(pin)法(fa)(fa)律(lv)(lv)顧問(wen)(wen),充分發揮(hui)其咨詢論(lun)證、審(shen)核把關作(zuo)用。在《中央(yang)企(qi)業違規(gui)經(jing)營(ying)投(tou)資(zi)責任追究實施辦(ban)法(fa)(fa)(試行)》等重(zhong)要規(gui)章規(gui)范性文(wen)件(jian)研究起(qi)草過程(cheng)中,主動(dong)征求外聘(pin)(pin)法(fa)(fa)律(lv)(lv)顧問(wen)(wen)意見。

五(wu)、強化對權(quan)力(li)的制約和監督

一(yi)是(shi)健全國(guo)(guo)資監(jian)管(guan)(guan)權力運行制約和監(jian)督(du)(du)(du)體(ti)系(xi)。根據監(jian)管(guan)(guan)權力和責(ze)任清單,修訂《國(guo)(guo)資委(wei)(wei)機關職(zhi)責(ze)分解一(yi)覽(lan)表》,完(wan)善機關工(gong)(gong)(gong)作(zuo)(zuo)(zuo)指導書和程(cheng)序文件,進一(yi)步細化工(gong)(gong)(gong)作(zuo)(zuo)(zuo)流(liu)程(cheng)和責(ze)任追究(jiu)。針對機關工(gong)(gong)(gong)作(zuo)(zuo)(zuo)人(ren)員(yuan)與中(zhong)(zhong)央(yang)(yang)企(qi)業往來行為、中(zhong)(zhong)介(jie)機構服務委(wei)(wei)托制度、內(nei)(nei)(nei)幕(mu)信(xin)息(xi)(xi)管(guan)(guan)理(li)等(deng)(deng)共(gong)性廉潔(jie)風(feng)險(xian)問(wen)(wen)題,開(kai)(kai)(kai)(kai)(kai)展專題調研,研究(jiu)起(qi)草相(xiang)關制度規(gui)范(fan)。制定貫徹落(luo)實中(zhong)(zhong)央(yang)(yang)八(ba)項(xiang)規(gui)定精(jing)神進一(yi)步加強作(zuo)(zuo)(zuo)風(feng)建設的(de)(de)(de)實施(shi)意見,持之以(yi)恒糾正“四(si)風(feng)”。二是(shi)加強風(feng)險(xian)排查和內(nei)(nei)(nei)部監(jian)督(du)(du)(du)。認真開(kai)(kai)(kai)(kai)(kai)展廉潔(jie)風(feng)險(xian)排查工(gong)(gong)(gong)作(zuo)(zuo)(zuo),制定防控措(cuo)施(shi),有效堵塞(sai)管(guan)(guan)理(li)漏洞(dong)。切實加強對委(wei)(wei)內(nei)(nei)(nei)廳局和單位在正風(feng)反腐、選人(ren)用人(ren)、源(yuan)頭(tou)治理(li)、巡視整(zheng)改等(deng)(deng)方面落(luo)實主(zhu)體(ti)責(ze)任情(qing)(qing)況(kuang)的(de)(de)(de)監(jian)督(du)(du)(du)檢查。三是(shi)自(zi)覺接受黨內(nei)(nei)(nei)監(jian)督(du)(du)(du)和審計(ji)(ji)監(jian)督(du)(du)(du)。針對2016年(nian)中(zhong)(zhong)央(yang)(yang)巡視組對國(guo)(guo)資委(wei)(wei)黨委(wei)(wei)反饋的(de)(de)(de)巡視意見,開(kai)(kai)(kai)(kai)(kai)展自(zi)查自(zi)糾深化整(zheng)改工(gong)(gong)(gong)作(zuo)(zuo)(zuo),對已制定的(de)(de)(de)整(zheng)改措(cuo)施(shi)落(luo)實情(qing)(qing)況(kuang)開(kai)(kai)(kai)(kai)(kai)展“回(hui)頭(tou)看”。配合(he)審計(ji)(ji)署對我委(wei)(wei)開(kai)(kai)(kai)(kai)(kai)展2016年(nian)預算(suan)執行等(deng)(deng)情(qing)(qing)況(kuang)審計(ji)(ji)、穩增長(chang)等(deng)(deng)措(cuo)施(shi)落(luo)實情(qing)(qing)況(kuang)跟蹤審計(ji)(ji)以(yi)及(ji)相(xiang)關專項(xiang)審計(ji)(ji),積極提供(gong)材料(liao)、主(zhu)動說(shuo)明(ming)情(qing)(qing)況(kuang)、全力整(zheng)改問(wen)(wen)題,并將整(zheng)改情(qing)(qing)況(kuang)及(ji)時報告(gao)國(guo)(guo)務院。四(si)是(shi)全面推(tui)進政務公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)和信(xin)息(xi)(xi)公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)。研究(jiu)制定《國(guo)(guo)資委(wei)(wei)2017年(nian)政務公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)要點》,加大(da)國(guo)(guo)資監(jian)管(guan)(guan)信(xin)息(xi)(xi)主(zhu)動公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)力度,及(ji)時向(xiang)社(she)會(hui)公(gong)(gong)布國(guo)(guo)有資產保值增值總(zong)體(ti)情(qing)(qing)況(kuang)、中(zhong)(zhong)央(yang)(yang)企(qi)業業績考核、中(zhong)(zhong)央(yang)(yang)企(qi)業負責(ze)人(ren)薪(xin)酬及(ji)重(zhong)大(da)人(ren)事任免事項(xiang)等(deng)(deng)。2017年(nian),國(guo)(guo)資委(wei)(wei)主(zhu)動公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)信(xin)息(xi)(xi)18000余(yu)條(tiao),收到的(de)(de)(de)信(xin)息(xi)(xi)公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)申請全部予(yu)以(yi)答復(fu)。積極推(tui)進中(zhong)(zhong)央(yang)(yang)企(qi)業信(xin)息(xi)(xi)公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)試點工(gong)(gong)(gong)作(zuo)(zuo)(zuo),舉辦中(zhong)(zhong)央(yang)(yang)企(qi)業信(xin)息(xi)(xi)公(gong)(gong)開(kai)(kai)(kai)(kai)(kai)培訓班,明(ming)確工(gong)(gong)(gong)作(zuo)(zuo)(zuo)要求,打造“陽光央(yang)(yang)企(qi)”。

六、依法有效化解(jie)矛(mao)盾糾(jiu)紛

一(yi)(yi)是(shi)(shi)妥善(shan)應(ying)對機關(guan)涉訴(su)(su)案(an)(an)件(jian)(jian)。印發(fa)《國(guo)(guo)資委關(guan)于(yu)加(jia)(jia)(jia)強和改進(jin)行(xing)(xing)政應(ying)訴(su)(su)工(gong)(gong)作(zuo)(zuo)的實施意(yi)見》(國(guo)(guo)資廳(ting)發(fa)法(fa)(fa)規(gui)〔2017〕34號),進(jin)一(yi)(yi)步(bu)規(gui)范(fan)機關(guan)行(xing)(xing)政應(ying)訴(su)(su)工(gong)(gong)作(zuo)(zuo),有(you)效防(fang)范(fan)機關(guan)法(fa)(fa)律(lv)(lv)(lv)(lv)風(feng)險(xian)。二是(shi)(shi)依(yi)(yi)法(fa)(fa)推進(jin)信(xin)訪(fang)(fang)工(gong)(gong)作(zuo)(zuo)。按照《關(guan)于(yu)進(jin)一(yi)(yi)步(bu)加(jia)(jia)(jia)強信(xin)訪(fang)(fang)法(fa)(fa)治化建(jian)設的意(yi)見》(中辦發(fa)〔2017〕51號)要求,依(yi)(yi)法(fa)(fa)暢通信(xin)訪(fang)(fang)渠道(dao),堅持以法(fa)(fa)律(lv)(lv)(lv)(lv)標尺化解矛(mao)(mao)盾(dun)。全面(mian)引導(dao)(dao)來訪(fang)(fang)人員依(yi)(yi)法(fa)(fa)逐級(ji)上訪(fang)(fang),推動訪(fang)(fang)訴(su)(su)分離,注重(zhong)(zhong)加(jia)(jia)(jia)強對來訪(fang)(fang)人員的政策解釋(shi)和宣傳疏導(dao)(dao)。三是(shi)(shi)加(jia)(jia)(jia)大對中央(yang)企(qi)(qi)業(ye)(ye)防(fang)范(fan)風(feng)險(xian)指(zhi)(zhi)導(dao)(dao)力度(du)。指(zhi)(zhi)導(dao)(dao)企(qi)(qi)業(ye)(ye)加(jia)(jia)(jia)強境外法(fa)(fa)律(lv)(lv)(lv)(lv)風(feng)險(xian)防(fang)范(fan),印發(fa)《關(guan)于(yu)進(jin)一(yi)(yi)步(bu)加(jia)(jia)(jia)強中央(yang)企(qi)(qi)業(ye)(ye)境外法(fa)(fa)律(lv)(lv)(lv)(lv)風(feng)險(xian)排查處(chu)置工(gong)(gong)作(zuo)(zuo)的通知(zhi)(zhi)》(國(guo)(guo)資廳(ting)發(fa)法(fa)(fa)規(gui)〔2017〕40號),召開(kai)中央(yang)企(qi)(qi)業(ye)(ye)參(can)與“一(yi)(yi)帶一(yi)(yi)路”建(jian)設法(fa)(fa)律(lv)(lv)(lv)(lv)保障研討(tao)會,組織編寫并出版9個國(guo)(guo)家(jia)的《一(yi)(yi)帶一(yi)(yi)路沿線國(guo)(guo)家(jia)法(fa)(fa)律(lv)(lv)(lv)(lv)風(feng)險(xian)防(fang)范(fan)指(zhi)(zhi)引》。建(jian)立法(fa)(fa)律(lv)(lv)(lv)(lv)風(feng)險(xian)提示(shi)報告制度(du),針(zhen)對國(guo)(guo)際網絡電信(xin)詐騙(pian)、融資性(xing)貿易案(an)(an)件(jian)(jian)處(chu)理、國(guo)(guo)有(you)股權代持等共性(xing)法(fa)(fa)律(lv)(lv)(lv)(lv)風(feng)險(xian)發(fa)出提示(shi)函(han)7份,督促企(qi)(qi)業(ye)(ye)及早防(fang)范(fan)、妥善(shan)應(ying)對。四是(shi)(shi)指(zhi)(zhi)導(dao)(dao)協(xie)調中央(yang)企(qi)(qi)業(ye)(ye)重(zhong)(zhong)大法(fa)(fa)律(lv)(lv)(lv)(lv)糾紛案(an)(an)件(jian)(jian)。制定(ding)印發(fa)《關(guan)于(yu)進(jin)一(yi)(yi)步(bu)加(jia)(jia)(jia)強中央(yang)企(qi)(qi)業(ye)(ye)法(fa)(fa)律(lv)(lv)(lv)(lv)糾紛案(an)(an)件(jian)(jian)管理工(gong)(gong)作(zuo)(zuo)的通知(zhi)(zhi)》(國(guo)(guo)資發(fa)法(fa)(fa)規(gui)〔2017〕210號),促進(jin)企(qi)(qi)業(ye)(ye)依(yi)(yi)法(fa)(fa)妥善(shan)解決矛(mao)(mao)盾(dun)糾紛,及時化解社(she)會不穩定(ding)因素(su)。

七、加強(qiang)法治宣傳(chuan)教育

一(yi)是(shi)積極(ji)開展法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)宣(xuan)(xuan)(xuan)傳(chuan)。落(luo)實(shi)“七五”普法(fa)(fa)(fa)(fa)(fa)(fa)規劃,通過(guo)國(guo)資(zi)監管法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設網、簡報(bao)、微(wei)信(xin)群和(he)公眾號等多種途(tu)徑,加(jia)強(qiang)國(guo)資(zi)監管法(fa)(fa)(fa)(fa)(fa)(fa)規制(zhi)度的(de)宣(xuan)(xuan)(xuan)傳(chuan),及時(shi)向社會公開國(guo)資(zi)委(wei)(wei)規章(zhang)規范性文件(jian)、強(qiang)化政(zheng)(zheng)策解(jie)讀。結合(he)黨的(de)十九(jiu)大精神的(de)學(xue)(xue)習(xi)宣(xuan)(xuan)(xuan)傳(chuan),組(zu)(zu)織(zhi)開展“12·4”國(guo)家憲(xian)法(fa)(fa)(fa)(fa)(fa)(fa)日系列(lie)宣(xuan)(xuan)(xuan)傳(chuan)活(huo)動(dong)。組(zu)(zu)織(zhi)各廳局代表(biao)(biao)到北京市(shi)一(yi)中院旁(pang)聽行(xing)(xing)(xing)政(zheng)(zheng)訴訟(song)案(an)件(jian)庭審,提(ti)升機關(guan)干(gan)(gan)部法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)素養(yang)。開展中央企(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設主(zhu)題(ti)宣(xuan)(xuan)(xuan)傳(chuan)活(huo)動(dong),專(zhuan)門邀(yao)請(qing)新華社、中央電視臺等媒體對11家企(qi)業(ye)(ye)(ye)進行(xing)(xing)(xing)采訪(fang)并發(fa)表(biao)(biao)33篇報(bao)道,集中展示(shi)中央企(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設成果(guo)。二是(shi)切實(shi)加(jia)強(qiang)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)培(pei)訓。舉(ju)(ju)辦國(guo)資(zi)委(wei)(wei)機關(guan)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設專(zhuan)題(ti)培(pei)訓班(ban),邀(yao)請(qing)學(xue)(xue)者(zhe)、法(fa)(fa)(fa)(fa)(fa)(fa)官為(wei)(wei)機關(guan)干(gan)(gan)部講(jiang)(jiang)授(shou)民(min)法(fa)(fa)(fa)(fa)(fa)(fa)總(zong)則、行(xing)(xing)(xing)政(zheng)(zheng)訴訟(song)法(fa)(fa)(fa)(fa)(fa)(fa)和(he)典型案(an)例。全年組(zu)(zu)織(zhi)6期(qi)“法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)講(jiang)(jiang)堂”,邀(yao)請(qing)知名專(zhuan)家學(xue)(xue)者(zhe)進行(xing)(xing)(xing)視頻(pin)授(shou)課(ke),國(guo)資(zi)委(wei)(wei)系統(tong)每期(qi)參(can)(can)(can)加(jia)人(ren)(ren)員1萬多人(ren)(ren)。做好政(zheng)(zheng)策宣(xuan)(xuan)(xuan)講(jiang)(jiang)解(jie)讀,派員參(can)(can)(can)加(jia)各中央企(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)工作會議、為(wei)(wei)企(qi)業(ye)(ye)(ye)黨委(wei)(wei)(黨組(zu)(zu))中心組(zu)(zu)專(zhuan)題(ti)學(xue)(xue)法(fa)(fa)(fa)(fa)(fa)(fa)授(shou)課(ke)80余次。舉(ju)(ju)辦為(wei)(wei)期(qi)一(yi)個月的(de)首屆中央企(qi)業(ye)(ye)(ye)高級法(fa)(fa)(fa)(fa)(fa)(fa)律管理(li)人(ren)(ren)員履(lv)職能力培(pei)訓班(ban),60多名學(xue)(xue)員集中參(can)(can)(can)加(jia)學(xue)(xue)習(xi),取得良好效果(guo)。三是(shi)有力促進共享交(jiao)流。相繼建(jian)(jian)(jian)(jian)立了中央企(qi)業(ye)(ye)(ye)涉外、金融法(fa)(fa)(fa)(fa)(fa)(fa)律人(ren)(ren)才庫,入庫專(zhuan)家193人(ren)(ren),更好發(fa)揮優秀(xiu)人(ren)(ren)才作用。健全完善中央企(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設優秀(xiu)案(an)例庫,下(xia)發(fa)第(di)三批優選案(an)例50個。建(jian)(jian)(jian)(jian)立法(fa)(fa)(fa)(fa)(fa)(fa)律服務(wu)機構信(xin)息庫,為(wei)(wei)企(qi)業(ye)(ye)(ye)選聘律師提(ti)供參(can)(can)(can)考。組(zu)(zu)織(zhi)企(qi)業(ye)(ye)(ye)共同開展合(he)規管理(li)、融資(zi)性貿易法(fa)(fa)(fa)(fa)(fa)(fa)律風(feng)險防范等重(zhong)點課(ke)題(ti)研(yan)究(jiu)。

八、促進中央(yang)企業(ye)提(ti)高依法治(zhi)企水平

一(yi)是(shi)強(qiang)化(hua)(hua)組(zu)織推(tui)(tui)動(dong)。召開(kai)中(zhong)央(yang)企(qi)(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工作(zuo)會(hui),對2017年(nian)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)企(qi)(qi)(qi)(qi)建設(she)作(zuo)出(chu)部署安排。加強(qiang)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)央(yang)企(qi)(qi)(qi)(qi)建設(she)進(jin)(jin)展(zhan)情況的通報,對重(zhong)點(dian)指(zhi)標進(jin)(jin)行統計分析,每半(ban)年(nian)通報一(yi)次,促進(jin)(jin)企(qi)(qi)(qi)(qi)業(ye)查找差距、對標提升。指(zhi)導(dao)(dao)各中(zhong)央(yang)企(qi)(qi)(qi)(qi)業(ye)普遍建立了法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建設(she)領(ling)導(dao)(dao)機構(gou),并制(zhi)(zhi)定(ding)(ding)主要(yao)負責(ze)(ze)人履(lv)行推(tui)(tui)進(jin)(jin)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建設(she)第(di)一(yi)責(ze)(ze)任(ren)人職(zhi)責(ze)(ze)實(shi)施(shi)辦法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)。推(tui)(tui)動(dong)企(qi)(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)工作(zuo)重(zhong)點(dian)要(yao)求進(jin)(jin)章程(cheng),強(qiang)化(hua)(hua)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建設(she)的制(zhi)(zhi)度(du)保(bao)障。二是(shi)強(qiang)化(hua)(hua)重(zhong)點(dian)領(ling)域指(zhi)導(dao)(dao)。通過分行業(ye)、分區域組(zu)織座談會(hui)、研討會(hui)、專(zhuan)題調研等活動(dong),有針對性的督促指(zhi)導(dao)(dao)企(qi)(qi)(qi)(qi)業(ye)依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)理(li)、依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)開(kai)展(zhan)經營活動(dong)。探(tan)索(suo)推(tui)(tui)進(jin)(jin)合(he)(he)規管(guan)理(li),在5家中(zhong)央(yang)企(qi)(qi)(qi)(qi)業(ye)開(kai)展(zhan)試點(dian)基(ji)礎上,啟動(dong)《中(zhong)央(yang)企(qi)(qi)(qi)(qi)業(ye)合(he)(he)規管(guan)理(li)指(zhi)引》研究起(qi)草(cao)工作(zuo),為全面推(tui)(tui)進(jin)(jin)合(he)(he)規管(guan)理(li)奠定(ding)(ding)基(ji)礎。指(zhi)導(dao)(dao)企(qi)(qi)(qi)(qi)業(ye)在法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)軌道上有序推(tui)(tui)進(jin)(jin)混合(he)(he)所有制(zhi)(zhi)經濟、公(gong)(gong)司制(zhi)(zhi)改(gai)制(zhi)(zhi)、完善現代企(qi)(qi)(qi)(qi)業(ye)制(zhi)(zhi)度(du)、處(chu)僵治(zhi)(zhi)(zhi)困等重(zhong)點(dian)改(gai)革發展(zhan)任(ren)務,更好(hao)服務和保(bao)障企(qi)(qi)(qi)(qi)業(ye)持(chi)續(xu)健康發展(zhan)。三(san)是(shi)強(qiang)化(hua)(hua)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)隊伍建設(she)。推(tui)(tui)動(dong)中(zhong)央(yang)企(qi)(qi)(qi)(qi)業(ye)集團公(gong)(gong)司健全完善總法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)律顧問制(zhi)(zhi)度(du)。持(chi)續(xu)推(tui)(tui)進(jin)(jin)企(qi)(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)律事(shi)(shi)務機構(gou)建設(she),優化(hua)(hua)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)律事(shi)(shi)務機構(gou)職(zhi)能配(pei)置,推(tui)(tui)動(dong)中(zhong)央(yang)企(qi)(qi)(qi)(qi)業(ye)將法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)律事(shi)(shi)務機構(gou)由內設(she)處(chu)室升級(ji)為一(yi)級(ji)部門或(huo)由合(he)(he)署辦公(gong)(gong)調整為獨(du)立設(she)置。積極開(kai)展(zhan)企(qi)(qi)(qi)(qi)業(ye)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)律顧問職(zhi)業(ye)崗位(wei)等級(ji)資格(ge)評審,進(jin)(jin)一(yi)步夯實(shi)依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)企(qi)(qi)(qi)(qi)的隊伍基(ji)礎。

黨(dang)的(de)十(shi)(shi)(shi)九(jiu)(jiu)(jiu)大(da)(da)把堅(jian)持全(quan)面依法(fa)(fa)治(zhi)國(guo)(guo)確立為(wei)(wei)新時(shi)代堅(jian)持和(he)發展中(zhong)(zhong)國(guo)(guo)特色社會(hui)(hui)主(zhu)義的(de)十(shi)(shi)(shi)四(si)條基(ji)本(ben)方(fang)略之一,對深化依法(fa)(fa)治(zhi)國(guo)(guo)實(shi)踐作(zuo)出(chu)全(quan)面部署(shu)。黨(dang)的(de)十(shi)(shi)(shi)九(jiu)(jiu)(jiu)屆(jie)(jie)二中(zhong)(zhong)全(quan)會(hui)(hui)提出(chu)了修(xiu)改憲(xian)法(fa)(fa)部分內(nei)容的(de)建議,第十(shi)(shi)(shi)三屆(jie)(jie)全(quan)國(guo)(guo)人(ren)大(da)(da)一次會(hui)(hui)議審議通過了憲(xian)法(fa)(fa)修(xiu)正案(an),必將對法(fa)(fa)治(zhi)政(zheng)府建設(she)提出(chu)更高要(yao)(yao)求(qiu)。下(xia)一步(bu),我們將以習近平新時(shi)代中(zhong)(zhong)國(guo)(guo)特色社會(hui)(hui)主(zhu)義思想為(wei)(wei)指(zhi)導,深入貫徹黨(dang)的(de)十(shi)(shi)(shi)九(jiu)(jiu)(jiu)大(da)(da)和(he)十(shi)(shi)(shi)九(jiu)(jiu)(jiu)屆(jie)(jie)二中(zhong)(zhong)、三中(zhong)(zhong)全(quan)會(hui)(hui)關于依法(fa)(fa)治(zhi)國(guo)(guo)的(de)決策部署(shu),嚴格(ge)落實(shi)憲(xian)法(fa)(fa)法(fa)(fa)律規定,按照(zhao)《綱要(yao)(yao)》要(yao)(yao)求(qiu),緊緊圍繞國(guo)(guo)資(zi)國(guo)(guo)企(qi)改革發展中(zhong)(zhong)心任(ren)務(wu)(wu),進(jin)一步(bu)健全(quan)國(guo)(guo)資(zi)監(jian)管(guan)制度,強化任(ren)務(wu)(wu)措(cuo)施督(du)促檢查,完善經營性國(guo)(guo)有(you)資(zi)產集中(zhong)(zhong)統一監(jian)管(guan)機制,著力打造(zao)國(guo)(guo)資(zi)監(jian)管(guan)法(fa)(fa)治(zhi)機構和(he)法(fa)(fa)治(zhi)央企(qi),為(wei)(wei)實(shi)現(xian)國(guo)(guo)有(you)資(zi)產保值增值、國(guo)(guo)有(you)資(zi)本(ben)做強做優做大(da)(da)、打造(zao)具有(you)全(quan)球競(jing)爭力的(de)世界一流企(qi)業提供有(you)力法(fa)(fa)治(zhi)保障。
