近日,國務院國資委發(fa)布了《中央企業工資總額管理辦(ban)(ban)法》(國資委令第39號(hao),以(yi)下(xia)簡稱《辦(ban)(ban)法》)。《辦(ban)(ban)法》出臺后,國務院國資委有關負(fu)責同志接受了記者(zhe)采訪。
問:請介紹《辦法》的起草背景。
答:中(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)總(zong)額管理(li)是調節國(guo)家(jia)、企(qi)業(ye)(ye)、職工(gong)三者利益(yi)關系的(de)重(zhong)要(yao)方(fang)(fang)式(shi),也是國(guo)資(zi)委(wei)依(yi)法(fa)履行出資(zi)人職責的(de)重(zhong)要(yao)手段,一直以來(lai),在推(tui)動中(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye)改(gai)革發展、確保國(guo)有資(zi)產保值增值方(fang)(fang)面發揮了重(zhong)要(yao)作(zuo)用,同時,工(gong)資(zi)總(zong)額管理(li)又是關乎民生(sheng)福祉的(de)重(zhong)要(yao)內容,涉(she)及中(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)(ye)廣大干部(bu)職工(gong)的(de)切身利益(yi),歷來(lai)受到各方(fang)(fang)面的(de)高度關注。
國資(zi)(zi)(zi)委成(cheng)立(li)以來,對(dui)完(wan)善工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)管(guan)(guan)(guan)理(li)(li)(li)制(zhi)度(du)做了(le)(le)(le)大量(liang)積極有(you)效(xiao)探索(suo),總(zong)(zong)(zong)(zong)體上分(fen)為三(san)個階(jie)段(duan)(duan)。第一階(jie)段(duan)(duan)為承接起(qi)步期(qi),從2003年(nian)(nian)至(zhi)2007年(nian)(nian),國資(zi)(zi)(zi)委在(zai)依法承接原勞動保障部門對(dui)中央(yang)企(qi)(qi)業(ye)(ye)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)監管(guan)(guan)(guan)職(zhi)能的(de)(de)基(ji)礎上,從出資(zi)(zi)(zi)人的(de)(de)角(jiao)度(du),持續對(dui)工(gong)(gong)(gong)(gong)(gong)效(xiao)掛鉤管(guan)(guan)(guan)理(li)(li)(li)辦法進行改革(ge)和(he)完(wan)善,初步構建(jian)了(le)(le)(le)出資(zi)(zi)(zi)人對(dui)企(qi)(qi)業(ye)(ye)的(de)(de)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)調控體系(xi)(xi),在(zai)促進企(qi)(qi)業(ye)(ye)經(jing)濟(ji)效(xiao)益高(gao)速(su)增長的(de)(de)同時,保障了(le)(le)(le)職(zhi)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)較快提高(gao)。第二(er)階(jie)段(duan)(duan)是改革(ge)突破期(qi),重點(dian)是探索(suo)和(he)建(jian)立(li)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)管(guan)(guan)(guan)理(li)(li)(li)的(de)(de)體制(zhi)機制(zhi)。2008年(nian)(nian)國資(zi)(zi)(zi)委在(zai)部分(fen)重點(dian)行業(ye)(ye)啟(qi)動了(le)(le)(le)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)試點(dian),著手建(jian)立(li)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)管(guan)(guan)(guan)理(li)(li)(li)制(zhi)度(du)體系(xi)(xi),2010年(nian)(nian)、2012年(nian)(nian)先后印發(fa)了(le)(le)(le)《中央(yang)企(qi)(qi)業(ye)(ye)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)管(guan)(guan)(guan)理(li)(li)(li)暫行辦法》和(he)《中央(yang)企(qi)(qi)業(ye)(ye)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)管(guan)(guan)(guan)理(li)(li)(li)暫行辦法實(shi)施(shi)細則》,2014年(nian)(nian)實(shi)現了(le)(le)(le)中央(yang)企(qi)(qi)業(ye)(ye)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)管(guan)(guan)(guan)理(li)(li)(li)全(quan)覆(fu)蓋。這個時期(qi)的(de)(de)改革(ge)突破,在(zai)中央(yang)企(qi)(qi)業(ye)(ye)構建(jian)起(qi)了(le)(le)(le)既符合現代企(qi)(qi)業(ye)(ye)制(zhi)度(du),又與(yu)中央(yang)企(qi)(qi)業(ye)(ye)實(shi)際相結合的(de)(de)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)管(guan)(guan)(guan)理(li)(li)(li)制(zhi)度(du)體系(xi)(xi),也為全(quan)國國有(you)企(qi)(qi)業(ye)(ye)全(quan)面(mian)實(shi)行工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)管(guan)(guan)(guan)理(li)(li)(li)提供了(le)(le)(le)可(ke)復(fu)制(zhi)、可(ke)推廣的(de)(de)經(jing)驗和(he)改革(ge)藍本。2014年(nian)(nian)以后,在(zai)深(shen)化(hua)國企(qi)(qi)改革(ge)的(de)(de)大背(bei)景(jing)下(xia),工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)管(guan)(guan)(guan)理(li)(li)(li)進入(ru)第三(san)階(jie)段(duan)(duan),即持續深(shen)化(hua)期(qi),重點(dian)以分(fen)類(lei)管(guan)(guan)(guan)理(li)(li)(li)為手段(duan)(duan),制(zhi)定了(le)(le)(le)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)預(yu)算(suan)(suan)(suan)備案(an)制(zhi)周期(qi)制(zhi)管(guan)(guan)(guan)理(li)(li)(li)、工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)(zong)(zong)(zong)額(e)(e)(e)特別獎勵等一系(xi)(xi)列政策措(cuo)施(shi),進一步增強(qiang)了(le)(le)(le)職(zhi)工(gong)(gong)(gong)(gong)(gong)收入(ru)分(fen)配調控的(de)(de)針對(dui)性和(he)有(you)效(xiao)性,在(zai)經(jing)濟(ji)發(fa)展新常態下(xia),發(fa)揮(hui)了(le)(le)(le)助力中央(yang)企(qi)(qi)業(ye)(ye)穩增長、激發(fa)和(he)調動企(qi)(qi)業(ye)(ye)干部職(zhi)工(gong)(gong)(gong)(gong)(gong)積極性的(de)(de)重要(yao)作用。
黨的(de)(de)(de)十九大(da)站在(zai)新(xin)的(de)(de)(de)歷史起(qi)點上(shang),明(ming)確我國(guo)(guo)經濟已經由高(gao)速增(zeng)長(chang)階段(duan)轉向高(gao)質量發(fa)(fa)(fa)展(zhan)階段(duan),作(zuo)出(chu)(chu)了貫徹新(xin)發(fa)(fa)(fa)展(zhan)理念(nian)、實現高(gao)質量發(fa)(fa)(fa)展(zhan)的(de)(de)(de)部署(shu),提出(chu)(chu)了培育具有全球競(jing)爭(zheng)力(li)的(de)(de)(de)世界一(yi)流企(qi)(qi)業(ye)(ye)(ye)目(mu)標。按照黨中(zhong)央、國(guo)(guo)務院的(de)(de)(de)決策部署(shu),以及《中(zhong)共(gong)中(zhong)央 國(guo)(guo)務院關(guan)于(yu)深化國(guo)(guo)有企(qi)(qi)業(ye)(ye)(ye)改(gai)革(ge)的(de)(de)(de)指導意(yi)見》(中(zhong)發(fa)(fa)(fa)〔2015〕22號(hao),以下(xia)(xia)簡稱中(zhong)發(fa)(fa)(fa)22號(hao)文件(jian))提出(chu)(chu)的(de)(de)(de)“建立健全與勞動(dong)(dong)力(li)市場基本適應(ying)、與企(qi)(qi)業(ye)(ye)(ye)經濟效益和勞動(dong)(dong)生(sheng)產率掛(gua)鉤的(de)(de)(de)工資(zi)(zi)(zi)決定(ding)(ding)(ding)和正(zheng)常(chang)增(zeng)長(chang)機制(zhi)”,即“一(yi)適應(ying)、兩(liang)掛(gua)鉤”的(de)(de)(de)總要求(qiu),人力(li)資(zi)(zi)(zi)源社會(hui)保障部、財政部、國(guo)(guo)資(zi)(zi)(zi)委(wei)共(gong)同(tong)研(yan)究(jiu)起(qi)草《關(guan)于(yu)改(gai)革(ge)國(guo)(guo)有企(qi)(qi)業(ye)(ye)(ye)工資(zi)(zi)(zi)決定(ding)(ding)(ding)機制(zhi)的(de)(de)(de)意(yi)見》(以下(xia)(xia)簡稱《意(yi)見》),2018年(nian)5月,《意(yi)見》經由中(zhong)央全面深化改(gai)革(ge)委(wei)員會(hui)第一(yi)次會(hui)議審議通過,國(guo)(guo)務院正(zheng)式印(yin)發(fa)(fa)(fa)。國(guo)(guo)資(zi)(zi)(zi)委(wei)作(zuo)為(wei)共(gong)同(tong)牽(qian)頭單位,在(zai)積極(ji)參與《意(yi)見》制(zhi)定(ding)(ding)(ding)工作(zuo)的(de)(de)(de)同(tong)時(shi),根(gen)據(ju)《意(yi)見》精神,結合中(zhong)央企(qi)(qi)業(ye)(ye)(ye)改(gai)革(ge)發(fa)(fa)(fa)展(zhan)的(de)(de)(de)實際(ji)情(qing)況,對中(zhong)央企(qi)(qi)業(ye)(ye)(ye)工資(zi)(zi)(zi)總額管(guan)理制(zhi)度體系進行(xing)全面修訂完善,同(tong)步(bu)制(zhi)定(ding)(ding)(ding)了《辦法》。
作為(wei)《意見》在中(zhong)(zhong)央企業(ye)落地落實(shi)的(de)配套(tao)文件制度,在近兩年的(de)起草制定過程中(zhong)(zhong),國資(zi)委(wei)廣泛征求(qiu)了各(ge)有關(guan)部門、地方國資(zi)委(wei)以(yi)及全(quan)部中(zhong)(zhong)央企業(ye)意見,期間數易其稿,最終由(you)國務院(yuan)國資(zi)委(wei)黨委(wei)會和主(zhu)任辦(ban)公會審議(yi)通過,以(yi)國務院(yuan)國資(zi)委(wei)令的(de)形式正(zheng)式公布。
問:制定《辦法》的主要目的和意義是什么。
答:《辦(ban)法》是(shi)國資委首次以委令形式公開發布的(de)中央(yang)企業(ye)工資總額(e)管理制(zhi)度文件,充分體現了國資委對這項工作的(de)高度重視(shi)。制(zhi)定《辦(ban)法》的(de)根本目的(de),是(shi)貫徹(che)落實(shi)習近平新(xin)時代中國特色(se)社會主義(yi)思想,增強中央(yang)企業(ye)活力(li)和競爭力(li),促進中央(yang)企業(ye)實(shi)現高質(zhi)量發展。
中(zhong)央企(qi)(qi)(qi)業工資(zi)總額管理(li),既要(yao)與國有企(qi)(qi)(qi)業工資(zi)決(jue)定(ding)機制改革的(de)總體(ti)方(fang)向(xiang)保持(chi)一致,又要(yao)充分體(ti)現中(zhong)央企(qi)(qi)(qi)業自身的(de)經(jing)營發展特(te)點。此次出臺(tai)的(de)《辦法》,緊扣《意見》的(de)精神實(shi)質,切實(shi)做到(dao)了將出資(zi)人依(yi)法調(diao)控(kong)和企(qi)(qi)(qi)業自主分配有機結合(he)。
一(yi)(yi)是明確提出按(an)中(zhong)(zhong)央企(qi)業(ye)功(gong)能(neng)定位對(dui)工(gong)資總(zong)額(e)實(shi)行分(fen)類管(guan)(guan)理。此次改革的重要(yao)創新(xin)點之(zhi)一(yi)(yi)就是分(fen)類管(guan)(guan)理,將(jiang)工(gong)資總(zong)額(e)預算備案制(zhi)管(guan)(guan)理的實(shi)施范(fan)圍,擴大到全部主(zhu)業(ye)處于充(chong)分(fen)競(jing)爭行業(ye)和(he)領域的商業(ye)類中(zhong)(zhong)央企(qi)業(ye),由企(qi)業(ye)董事(shi)(shi)會依法依規(gui)自(zi)主(zhu)決(jue)定年度工(gong)資總(zong)額(e)預算,國資委由事(shi)(shi)前(qian)(qian)核準轉變為事(shi)(shi)前(qian)(qian)引導、事(shi)(shi)中(zhong)(zhong)監(jian)測和(he)事(shi)(shi)后監(jian)督。
二是(shi)明(ming)確提出了對中(zhong)央(yang)(yang)企業工資總額實行分級管(guan)理(li)。國(guo)資委(wei)負責管(guan)制(zhi)度、管(guan)總量、管(guan)監(jian)督,中(zhong)央(yang)(yang)企業負責管(guan)內部自(zi)主(zhu)分配、管(guan)預算分解落(luo)實、管(guan)具體操作執行,國(guo)資委(wei)與中(zhong)央(yang)(yang)企業權(quan)責清晰(xi)、各司其職。
三是(shi)進一步完善中央(yang)企(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)(gong)(gong)資總(zong)額與經濟效(xiao)(xiao)益掛鉤決(jue)定機(ji)制。《辦法》圍繞建立健全“一適應、兩掛鉤”工(gong)(gong)(gong)(gong)(gong)資決(jue)定機(ji)制的(de)(de)目標要求,進行了一系列重大創新。如明確了中央(yang)企(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)(gong)(gong)資總(zong)額根據效(xiao)(xiao)益決(jue)定,并按照效(xiao)(xiao)率(lv)調(diao)整,進一步豐富了工(gong)(gong)(gong)(gong)(gong)資與效(xiao)(xiao)益掛鉤的(de)(de)內涵,全面樹立“工(gong)(gong)(gong)(gong)(gong)資是(shi)掙出(chu)(chu)來”的(de)(de)核心理(li)念(nian)。再比如《辦法》進一步簡(jian)化(hua)了出(chu)(chu)資人根據國家要求調(diao)控企(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)(gong)(gong)資水平的(de)(de)規(gui)定,突出(chu)(chu)了出(chu)(chu)資人以管資本為主(zhu)加強監管、簡(jian)政放權的(de)(de)管理(li)導(dao)向,釋放了積極的(de)(de)改革信號(hao)。同時(shi),《辦法》還明確了企(qi)業(ye)(ye)(ye)同口徑增(zeng)人不(bu)增(zeng)工(gong)(gong)(gong)(gong)(gong)資總(zong)額、減人不(bu)減工(gong)(gong)(gong)(gong)(gong)資總(zong)額的(de)(de)有關規(gui)定,鼓勵中央(yang)企(qi)業(ye)(ye)(ye)提高(gao)用人效(xiao)(xiao)率(lv)。
四是(shi)進(jin)(jin)一步強調深化企業內(nei)部(bu)分配制度改革(ge)。《辦法(fa)》在宏觀層面完善國(guo)家、企業和(he)職(zhi)工(gong)(gong)三者工(gong)(gong)資(zi)分配關系的同時,強調企業作(zuo)為(wei)內(nei)部(bu)分配的責(ze)任主體,應當持續深化內(nei)部(bu)三項制度改革(ge),構建形成企業內(nei)部(bu)管理人員(yuan)(yuan)能(neng)上能(neng)下、員(yuan)(yuan)工(gong)(gong)能(neng)進(jin)(jin)能(neng)出(chu)、收(shou)入能(neng)增能(neng)減的市場化勞(lao)動用工(gong)(gong)和(he)收(shou)入分配管理機(ji)制,切實(shi)承擔起搞好(hao)、搞活企業內(nei)部(bu)分配的職(zhi)責(ze)。
五(wu)是進一步強調(diao)工(gong)(gong)資總(zong)(zong)額管(guan)(guan)(guan)理的(de)監(jian)(jian)督檢查(cha),明(ming)確(que)界定企業的(de)違(wei)規責(ze)任。如明(ming)確(que)對(dui)于(yu)(yu)實施備案制管(guan)(guan)(guan)理的(de)企業,出(chu)現嚴重違(wei)反國(guo)家和(he)國(guo)資委關(guan)于(yu)(yu)收入分配有關(guan)規定的(de),將其工(gong)(gong)資總(zong)(zong)額預算管(guan)(guan)(guan)理方式由備案制調(diao)整為核(he)準(zhun)制,確(que)保做到(dao)權(quan)責(ze)對(dui)等。同(tong)時,《辦法》明(ming)確(que)將企業工(gong)(gong)資總(zong)(zong)額管(guan)(guan)(guan)理情況納入各項(xiang)監(jian)(jian)督檢查(cha)范圍,與審計、巡視等工(gong)(gong)作形成(cheng)合力(li),切實保證監(jian)(jian)管(guan)(guan)(guan)到(dao)位。
總的(de)來(lai)說(shuo),《辦法》較好地(di)體(ti)現了中(zhong)(zhong)發(fa)22號文件的(de)改(gai)革要(yao)求,體(ti)現了黨(dang)的(de)十九大(da)提(ti)出的(de)堅持(chi)質量第一(yi)、效益優先的(de)發(fa)展理(li)念,符(fu)合(he)此前國有企業(ye)改(gai)革座談會(hui)提(ti)出強化正向激勵的(de)有關精神(shen),符(fu)合(he)中(zhong)(zhong)央(yang)關于簡政放(fang)權、“放(fang)管服(fu)”的(de)改(gai)革要(yao)求,對促進中(zhong)(zhong)央(yang)企業(ye)實現高質量發(fa)展、推(tui)動國有資本做(zuo)強做(zuo)優做(zuo)大(da),加快培育具有全球競爭力(li)的(de)世(shi)界一(yi)流企業(ye)具有重要(yao)意義。
問:根據新的《辦法》,中央企業職工工資總額具體如何決定?
