同志們:

  這次會議是(shi)在“十二五”開局之年(nian),國(guo)(guo)資(zi)監管和(he)(he)國(guo)(guo)企改革進(jin)入(ru)新(xin)階段召(zhao)開的(de)(de)一(yi)(yi)次重要(yao)(yao)會議。會議的(de)(de)主要(yao)(yao)任務是(shi):總結杭州會議以來指導(dao)監督(du)(du)地方國(guo)(guo)資(zi)工作(zuo)的(de)(de)進(jin)展和(he)(he)成效(xiao),交流各地好的(de)(de)做(zuo)(zuo)法和(he)(he)經驗,圍繞(rao)“國(guo)(guo)資(zi)監管上新(xin)水平、國(guo)(guo)企發展上新(xin)臺階”的(de)(de)“兩新(xin)目標”,研究“十二五”時期(qi)指導(dao)監督(du)(du)地方國(guo)(guo)資(zi)工作(zuo)的(de)(de)總體思路和(he)(he)工作(zuo)重點,提(ti)(ti)出做(zuo)(zuo)好下一(yi)(yi)步工作(zuo)的(de)(de)具體措施。國(guo)(guo)務院國(guo)(guo)資(zi)委(wei)對(dui)(dui)這次會議高度重視,國(guo)(guo)資(zi)委(wei)主任、黨委(wei)書記王勇同志(zhi)做(zuo)(zuo)出重要(yao)(yao)批示(shi),對(dui)(dui)進(jin)一(yi)(yi)步加強指導(dao)監督(du)(du)工作(zuo)提(ti)(ti)出明(ming)確要(yao)(yao)求。大家要(yao)(yao)認真學習領會,全(quan)面貫徹落實。下面,我講三點意見。

  一、指導(dao)監督地(di)方(fang)國資工作取得新進展新成(cheng)效(xiao)

  去年杭州會議以來,國(guo)資(zi)(zi)委(wei)系統(tong)緊緊圍繞(rao)國(guo)資(zi)(zi)監管和國(guo)企改(gai)革(ge)發(fa)展的(de)中心任務,大力(li)推(tui)進(jin)(jin)指導監督(du)工作(zuo),國(guo)資(zi)(zi)系統(tong)一盤棋理念進(jin)(jin)一步增強,上下級國(guo)資(zi)(zi)委(wei)溝通聯系進(jin)(jin)一步密切,工作(zuo)合力(li)進(jin)(jin)一步形成,指導監督(du)工作(zuo)取得新的(de)進(jin)(jin)展和成效。

  (一)加強組織領(ling)導,指導監督工(gong)作機(ji)制基本(ben)形成。

  分(fen)(fen)管領(ling)導(dao)和(he)工(gong)(gong)作(zuo)(zuo)機(ji)構全(quan)面落(luo)實(shi)。各省級國(guo)(guo)資(zi)委(wei)(wei)將(jiang)(jiang)指(zhi)導(dao)監(jian)督工(gong)(gong)作(zuo)(zuo)擺上重(zhong)要(yao)議事日程,普遍成立了(le)指(zhi)導(dao)監(jian)督工(gong)(gong)作(zuo)(zuo)領(ling)導(dao)小組,不少地方(fang)國(guo)(guo)資(zi)委(wei)(wei)由一把手親自擔(dan)任(ren)領(ling)導(dao)小組組長(chang),同時明(ming)確(que)了(le)委(wei)(wei)內牽頭處(chu)(chu)室(shi)(shi),建立了(le)各處(chu)(chu)室(shi)(shi)之間的(de)(de)分(fen)(fen)工(gong)(gong)協調機(ji)制。北京市國(guo)(guo)資(zi)委(wei)(wei)將(jiang)(jiang)36項工(gong)(gong)作(zuo)(zuo)任(ren)務分(fen)(fen)解到(dao)16個處(chu)(chu)室(shi)(shi)。山東省國(guo)(guo)資(zi)委(wei)(wei)將(jiang)(jiang)各處(chu)(chu)室(shi)(shi)指(zhi)導(dao)監(jian)督工(gong)(gong)作(zuo)(zuo)開展情況列入年度考核內容。上海市國(guo)(guo)資(zi)委(wei)(wei)對區(qu)縣(xian)國(guo)(guo)資(zi)監(jian)管工(gong)(gong)作(zuo)(zuo)中遇到(dao)的(de)(de)難題,由各業務處(chu)(chu)室(shi)(shi)實(shi)行(xing)對口(kou)“一條龍”服務。通過落(luo)實(shi)分(fen)(fen)管領(ling)導(dao)和(he)工(gong)(gong)作(zuo)(zuo)機(ji)構,初步形成了(le)職責(ze)明(ming)確(que)、統籌(chou)協調、分(fen)(fen)工(gong)(gong)負責(ze)的(de)(de)指(zhi)導(dao)監(jian)督工(gong)(gong)作(zuo)(zuo)組織體系。

  指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督工(gong)作(zuo)(zuo)(zuo)(zuo)制度建(jian)設不斷(duan)加強(qiang)(qiang)。國(guo)(guo)務院國(guo)(guo)資(zi)委(wei)修訂發(fa)布了(le)《地方國(guo)(guo)有資(zi)產監(jian)(jian)(jian)(jian)管(guan)工(gong)作(zuo)(zuo)(zuo)(zuo)指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督辦(ban)(ban)法》(以下簡稱《指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督辦(ban)(ban)法》),按照“指(zhi)(zhi)(zhi)(zhi)導(dao)、溝通、交流(liu)、服務”的原(yuan)則(ze),明確指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督工(gong)作(zuo)(zuo)(zuo)(zuo)機(ji)制和(he)主(zhu)要工(gong)作(zuo)(zuo)(zuo)(zuo)事項,進一(yi)步規(gui)范了(le)指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督的主(zhu)要方式(shi)和(he)途(tu)徑。上海市國(guo)(guo)資(zi)委(wei)制定了(le)《指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督辦(ban)(ban)法》的實施細則(ze),將區縣(xian)貫(guan)徹執(zhi)行(xing)國(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)管(guan)政(zheng)策法規(gui)情況作(zuo)(zuo)(zuo)(zuo)為指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督工(gong)作(zuo)(zuo)(zuo)(zuo)重點(dian)。湖(hu)南、湖(hu)北、四川、重慶、甘肅、內蒙、新疆生產建(jian)設兵團等省區市國(guo)(guo)資(zi)委(wei)出臺了(le)加強(qiang)(qiang)市、縣(xian)級國(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)管(guan)工(gong)作(zuo)(zuo)(zuo)(zuo)的指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)(jian)督辦(ban)(ban)法,探索建(jian)立政(zheng)策指(zhi)(zhi)(zhi)(zhi)導(dao)與具體(ti)指(zhi)(zhi)(zhi)(zhi)導(dao)、日(ri)常指(zhi)(zhi)(zhi)(zhi)導(dao)與專項指(zhi)(zhi)(zhi)(zhi)導(dao)相結合(he)的工(gong)作(zuo)(zuo)(zuo)(zuo)體(ti)系。

  上下級國(guo)資(zi)(zi)(zi)委之間(jian)的(de)溝通(tong)交流平臺(tai)(tai)逐步形(xing)成(cheng)。國(guo)務院國(guo)資(zi)(zi)(zi)委定期編發簡報,及(ji)時(shi)傳達指導(dao)監督工(gong)作要(yao)求,交流推廣各地國(guo)資(zi)(zi)(zi)監管的(de)特色(se)做法和先進(jin)(jin)經驗,同時(shi)加快建立地方國(guo)資(zi)(zi)(zi)監管信(xin)息資(zi)(zi)(zi)源系統,嘗試指導(dao)監督基礎數據的(de)整(zheng)合與利用(yong)(yong)。福建、安徽等省國(guo)資(zi)(zi)(zi)委健全監管工(gong)作體系,形(xing)成(cheng)了覆蓋全省的(de)基礎數據網(wang)絡。遼(liao)寧省國(guo)資(zi)(zi)(zi)委通(tong)過與地市國(guo)資(zi)(zi)(zi)委辦(ban)公信(xin)息系統聯網(wang),確保(bao)了重要(yao)信(xin)息及(ji)時(shi)上報。國(guo)資(zi)(zi)(zi)委系統運用(yong)(yong)溝通(tong)交流平臺(tai)(tai),有力地促進(jin)(jin)了相互(hu)之間(jian)的(de)學習借(jie)鑒和信(xin)息共享。

  (二)創新方式方法,指導監督工作全面(mian)展開。

  精心規劃部署指導(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)。國(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)印發(fa)年(nian)度(du)工(gong)(gong)作(zuo)(zuo)計(ji)(ji)劃,明確了(le)2011年(nian)指導(dao)(dao)(dao)監(jian)(jian)督(du)的(de)40項(xiang)工(gong)(gong)作(zuo)(zuo)任務(wu)和(he)(he)責任廳局。湖南、新疆、西(xi)藏、廈門等許多省(sheng)市(shi)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)也制定了(le)指導(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)年(nian)度(du)計(ji)(ji)劃。福建、江(jiang)西(xi)、陜西(xi)等省(sheng)市(shi)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)專門組織召(zhao)(zhao)開(kai)了(le)全省(sheng)指導(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)會(hui)議。北京(jing)市(shi)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)邀請(qing)區縣政(zheng)府(fu)主管領導(dao)(dao)(dao)參加國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管工(gong)(gong)作(zuo)(zuo)會(hui)議,全面(mian)部署了(le)區縣國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管重點工(gong)(gong)作(zuo)(zuo)。四川省(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)召(zhao)(zhao)開(kai)研(yan)討會(hui),研(yan)究部署“十二五”時期指導(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)的(de)總體思路(lu)、重點任務(wu)和(he)(he)工(gong)(gong)作(zuo)(zuo)措施(shi)。通過(guo)工(gong)(gong)作(zuo)(zuo)計(ji)(ji)劃和(he)(he)會(hui)議部署,各地指導(dao)(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作(zuo)(zuo)開(kai)始(shi)全面(mian)啟動,并初步打開(kai)了(le)工(gong)(gong)作(zuo)(zuo)局面(mian)。

  深入調(diao)研摸清指導(dao)監(jian)督(du)(du)面(mian)上情況(kuang)。今年上半(ban)年,國(guo)(guo)資(zi)(zi)委(wei)法規局赴13個(ge)省市深入了解(jie)地方國(guo)(guo)資(zi)(zi)監(jian)管(guan)機構(gou)建(jian)設、全覆(fu)蓋監(jian)管(guan)、融資(zi)(zi)平臺公司經營等(deng)(deng)方面(mian)的情況(kuang)和(he)問題(ti)(ti),并提交了有(you)關調(diao)研報告和(he)上報的專題(ti)(ti)信息(xi)。福建(jian)省國(guo)(guo)資(zi)(zi)委(wei)對市、縣國(guo)(guo)資(zi)(zi)監(jian)管(guan)工(gong)作和(he)指導(dao)監(jian)督(du)(du)工(gong)作情況(kuang)進(jin)行全面(mian)調(diao)研。山東省國(guo)(guo)資(zi)(zi)委(wei)針(zhen)(zhen)對部(bu)分(fen)地市出(chu)現(xian)的國(guo)(guo)資(zi)(zi)委(wei)監(jian)管(guan)企業劃回原主管(guan)部(bu)門的體制回潮現(xian)象,由(you)委(wei)領(ling)導(dao)分(fen)頭(tou)帶隊進(jin)行集中調(diao)研督(du)(du)導(dao)。安徽省國(guo)(guo)資(zi)(zi)委(wei)建(jian)立了委(wei)領(ling)導(dao)班(ban)子聯系點制度,每(mei)人分(fen)別聯系2-3個(ge)地市國(guo)(guo)資(zi)(zi)委(wei),定期開展(zhan)調(diao)研指導(dao)。四(si)川(chuan)、黑龍江等(deng)(deng)省國(guo)(guo)資(zi)(zi)委(wei)分(fen)片區開展(zhan)專題(ti)(ti)調(diao)研,實(shi)地協調(diao)解(jie)決市縣國(guo)(guo)資(zi)(zi)監(jian)管(guan)機構(gou)的困(kun)難和(he)問題(ti)(ti)。通過開展(zhan)廣泛深入的調(diao)查研究,進(jin)一步增強(qiang)了指導(dao)監(jian)督(du)(du)工(gong)作的針(zhen)(zhen)對性(xing)(xing)和(he)有(you)效(xiao)性(xing)(xing)。

  注(zhu)重(zhong)發揮先(xian)進(jin)典(dian)型示(shi)(shi)范引(yin)(yin)路作用。河(he)南(nan)、云(yun)南(nan)、青島等(deng)省(sheng)市(shi)對下(xia)級國(guo)資(zi)監管工(gong)(gong)作進(jin)行(xing)評優表彰,樹立先(xian)進(jin)典(dian)型。山(shan)東省(sheng)國(guo)資(zi)委總(zong)(zong)結推廣(guang)濟(ji)寧(ning)(ning)、聊城、棗莊等(deng)地(di)市(shi)國(guo)資(zi)委在加強(qiang)職能建設、強(qiang)化考核(he)培訓等(deng)方面的(de)經驗和做法(fa)。寧(ning)(ning)夏自治(zhi)區國(guo)資(zi)委指(zhi)導(dao)推動全(quan)區國(guo)有企(qi)(qi)業(ye)(ye)開展與全(quan)國(guo)先(xian)進(jin)企(qi)(qi)業(ye)(ye)、全(quan)區先(xian)進(jin)企(qi)(qi)業(ye)(ye)、本行(xing)業(ye)(ye)先(xian)進(jin)企(qi)(qi)業(ye)(ye)的(de)“三對標”活(huo)動。各地(di)通過總(zong)(zong)結推廣(guang)特色做法(fa)和先(xian)進(jin)經驗,以(yi)點帶面,使指(zhi)導(dao)監督(du)工(gong)(gong)作的(de)引(yin)(yin)領(ling)示(shi)(shi)范效應得到較好體(ti)現。

  不斷(duan)強(qiang)(qiang)化和豐富指(zhi)導(dao)監(jian)督工(gong)作(zuo)內涵。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)先后組(zu)織召開國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)系(xi)統(tong)財務監(jian)督、產(chan)(chan)權(quan)管理、業(ye)績(ji)考核(he)、收益(yi)分(fen)配、改革改制、董事(shi)會(hui)與監(jian)事(shi)會(hui)工(gong)作(zuo)、紀(ji)檢監(jian)察等專(zhuan)題會(hui)議和培(pei)訓班,對各(ge)地國(guo)(guo)資(zi)(zi)(zi)監(jian)管工(gong)作(zuo)進(jin)行(xing)(xing)專(zhuan)項(xiang)指(zhi)導(dao)。深圳、上海、河北、大(da)連等部分(fen)省市(shi)(shi)國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)在本地區積極探(tan)索推(tui)進(jin)經(jing)濟增(zeng)加(jia)值考核(he),引導(dao)國(guo)(guo)有(you)企(qi)業(ye)增(zeng)強(qiang)(qiang)價值創(chuang)造能力,提高發展質(zhi)量和效益(yi)。云南、江蘇(su)等省國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)組(zu)織對地市(shi)(shi)國(guo)(guo)有(you)企(qi)業(ye)生(sheng)產(chan)(chan)經(jing)營狀況進(jin)行(xing)(xing)綜合分(fen)析,全面掌握地市(shi)(shi)國(guo)(guo)有(you)經(jing)濟的運行(xing)(xing)情況。廣(guang)東省國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)指(zhi)導(dao)地市(shi)(shi)國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)建(jian)立健全國(guo)(guo)有(you)企(qi)業(ye)財務快報制度。江蘇(su)、湖北等省國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)統(tong)一(yi)全省企(qi)業(ye)國(guo)(guo)有(you)產(chan)(chan)權(quan)交易(yi)信息發布,實行(xing)(xing)產(chan)(chan)權(quan)交易(yi)網(wang)上動態(tai)監(jian)測。加(jia)強(qiang)(qiang)對國(guo)(guo)資(zi)(zi)(zi)監(jian)管各(ge)項(xiang)專(zhuan)題工(gong)作(zuo)的指(zhi)導(dao)推(tui)動,已經(jing)成為國(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)系(xi)統(tong)加(jia)強(qiang)(qiang)聯(lian)系(xi)、共同提高的重要紐帶。

  (三(san))突出工作(zuo)重(zhong)點,指導監督效果初(chu)步顯現。

  指導(dao)國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)體制(zhi)和(he)制(zhi)度(du)建(jian)設邁出(chu)新步伐。各地國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)以(yi)保(bao)持(chi)機(ji)(ji)(ji)(ji)構(gou)(gou)(gou)的(de)(de)獨(du)立(li)性(xing)(xing)(xing)、專業性(xing)(xing)(xing)和(he)落實出(chu)資(zi)(zi)(zi)(zi)人三項主(zhu)要(yao)職責(ze)為重點,通(tong)過立(li)法和(he)政(zheng)策引導(dao)等多種(zhong)途徑,深入(ru)推進本(ben)地區國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)體制(zhi)和(he)制(zhi)度(du)的(de)(de)完(wan)善(shan)。湖(hu)北省(sheng)(sheng)(sheng)(sheng)國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)主(zhu)要(yao)領(ling)導(dao)親(qin)自掛帥,主(zhu)動地向省(sheng)(sheng)(sheng)(sheng)委(wei)、省(sheng)(sheng)(sheng)(sheng)政(zheng)府(fu)匯報(bao),積極加強與省(sheng)(sheng)(sheng)(sheng)政(zheng)府(fu)各部門和(he)省(sheng)(sheng)(sheng)(sheng)人大法律委(wei)的(de)(de)協(xie)調配合,組織起草(cao)并推動出(chu)臺(tai)了(le)(le)(le)《湖(hu)北省(sheng)(sheng)(sheng)(sheng)企業國(guo)(guo)有資(zi)(zi)(zi)(zi)產監(jian)督(du)管(guan)(guan)理條例(li)》,首(shou)次以(yi)地方(fang)性(xing)(xing)(xing)法規(gui)的(de)(de)形(xing)式(shi),明(ming)確了(le)(le)(le)全省(sheng)(sheng)(sheng)(sheng)國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)的(de)(de)直屬(shu)特設機(ji)(ji)(ji)(ji)構(gou)(gou)(gou)性(xing)(xing)(xing)質和(he)全覆蓋(gai)監(jian)管(guan)(guan)職責(ze),健全完(wan)善(shan)了(le)(le)(le)地方(fang)國(guo)(guo)有資(zi)(zi)(zi)(zi)本(ben)經(jing)營預算制(zhi)度(du)。山東、貴州(zhou)等省(sheng)(sheng)(sheng)(sheng)市也先后出(chu)臺(tai)了(le)(le)(le)指導(dao)本(ben)地區國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)體制(zhi)完(wan)善(shan)的(de)(de)專門文件,對(dui)國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)職責(ze)定(ding)位、監(jian)管(guan)(guan)范圍(wei)以(yi)及市縣國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)責(ze)任主(zhu)體等做出(chu)了(le)(le)(le)明(ming)確規(gui)定(ding)。福(fu)建(jian)省(sheng)(sheng)(sheng)(sheng)國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)針對(dui)部分地市擬撤并國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)的(de)(de)動向,及時(shi)與各地市黨委(wei)、政(zheng)府(fu)溝通(tong),并將情況上(shang)報(bao)省(sheng)(sheng)(sheng)(sheng)政(zheng)府(fu)取得支持(chi),保(bao)持(chi)了(le)(le)(le)地市級國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)機(ji)(ji)(ji)(ji)構(gou)(gou)(gou)的(de)(de)穩定(ding)。重慶、陜西等省(sheng)(sheng)(sheng)(sheng)市國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)主(zhu)要(yao)領(ling)導(dao)與地市政(zheng)府(fu)主(zhu)要(yao)負(fu)責(ze)同志深入(ru)協(xie)商溝通(tong),推動地市級國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)的(de)(de)單獨(du)設立(li)和(he)職責(ze)到位。最近,深圳(zhen)市委(wei)和(he)市政(zheng)府(fu)對(dui)市國(guo)(guo)資(zi)(zi)(zi)(zi)局的(de)(de)機(ji)(ji)(ji)(ji)構(gou)(gou)(gou)名(ming)稱和(he)機(ji)(ji)(ji)(ji)構(gou)(gou)(gou)性(xing)(xing)(xing)質專門作(zuo)了(le)(le)(le)研究,正式(shi)決定(ding)將市國(guo)(guo)資(zi)(zi)(zi)(zi)局更(geng)名(ming)為市國(guo)(guo)資(zi)(zi)(zi)(zi)委(wei),機(ji)(ji)(ji)(ji)構(gou)(gou)(gou)性(xing)(xing)(xing)質由市政(zheng)府(fu)工作(zuo)部門變更(geng)為市政(zheng)府(fu)直屬(shu)特設機(ji)(ji)(ji)(ji)構(gou)(gou)(gou)。

  推進經營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產集(ji)中統(tong)一(yi)(yi)監(jian)管(guan)(guan)取得新進展。各地按照“政企分開、政資(zi)(zi)(zi)分開”原則,積極拓展國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)系統(tong)的監(jian)管(guan)(guan)范圍。目前,全(quan)國(guo)(guo)(guo)有(you)(you)14個(ge)(ge)省(sheng)級國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)監(jian)管(guan)(guan)覆蓋(gai)(gai)(gai)(gai)面達到80%以(yi)上,北京、天(tian)津、上海、重(zhong)慶四個(ge)(ge)直轄市實(shi)現了(le)經營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產的全(quan)覆蓋(gai)(gai)(gai)(gai)監(jian)管(guan)(guan)。湖北省(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)對糧油、水(shui)電、文化等(deng)領域的脫鉤改制(zhi)企業實(shi)現了(le)“統(tong)一(yi)(yi)納入、委(wei)(wei)(wei)托監(jian)管(guan)(guan)”。云南選擇昆(kun)明、曲靖、文山、大理等(deng)四個(ge)(ge)州(zhou)市進行了(le)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)管(guan)(guan)全(quan)覆蓋(gai)(gai)(gai)(gai)試(shi)點(dian)。此外,全(quan)國(guo)(guo)(guo)有(you)(you)28個(ge)(ge)省(sheng)級國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)和70個(ge)(ge)地市級國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)監(jian)管(guan)(guan)范圍還涵蓋(gai)(gai)(gai)(gai)了(le)金融類國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產。

  推(tui)動(dong)落實(shi)縣(xian)級國(guo)(guo)有資(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管責任取(qu)得新(xin)成效。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)委召開義烏現場會(hui)后,浙(zhe)江、廣東等省(sheng)(sheng)(sheng)國(guo)(guo)資(zi)(zi)委相(xiang)繼在全(quan)省(sheng)(sheng)(sheng)范(fan)圍內(nei)大(da)力總(zong)結推(tui)廣義烏、順德(de)經驗,進一步(bu)加(jia)強縣(xian)級國(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管機(ji)構建設,健全(quan)縣(xian)級國(guo)(guo)有資(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管體制。湖北省(sheng)(sheng)(sheng)國(guo)(guo)資(zi)(zi)委總(zong)結推(tui)廣“大(da)國(guo)(guo)資(zi)(zi)、大(da)監(jian)(jian)(jian)(jian)管、大(da)資(zi)(zi)源、大(da)配置(zhi)”的(de)“宜都模式”,大(da)冶(ye)市對經營(ying)性國(guo)(guo)有資(zi)(zi)產(chan)和(he)行政(zheng)事業(ye)性資(zi)(zi)產(chan)實(shi)行產(chan)權、預算(suan)、資(zi)(zi)產(chan)處(chu)置(zhi)、資(zi)(zi)源配置(zhi)“四統一”的(de)監(jian)(jian)(jian)(jian)管模式。寧波市國(guo)(guo)資(zi)(zi)委推(tui)動(dong)明確了區縣(xian)國(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管責任主體。據對吉林(lin)、安徽、廣西(xi)等8省(sheng)(sheng)(sheng)市所轄(xia)883個縣(xian)區的(de)統計,單獨設立(li)國(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管機(ji)構的(de)有167個,占總(zong)數的(de)19%。廣東、江西(xi)、四川(chuan)的(de)縣(xian)(區)單獨設立(li)國(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管機(ji)構的(de)比例分(fen)別達到(dao)36%、30%和(he)28%。

  指導地方(fang)國(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)(ji)發(fa)揮(hui)引(yin)領(ling)帶動作(zuo)用(yong)呈現新格(ge)局。各級國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委積(ji)極(ji)指導推(tui)進跨區域(yu)(yu)、跨層級國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)(ye)(ye)(ye)之間的調整重組,引(yin)導地方(fang)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)本(ben)更多(duo)地投向(xiang)(xiang)支柱(zhu)(zhu)行業(ye)(ye)(ye)(ye)和(he)特色產(chan)(chan)業(ye)(ye)(ye)(ye)。國(guo)(guo)(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委推(tui)動中央(yang)企(qi)業(ye)(ye)(ye)(ye)與(yu)許多(duo)省(sheng)市(shi)開展(zhan)了央(yang)地合(he)(he)作(zuo)。福建(jian)省(sheng)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委牽頭搭(da)建(jian)本(ben)地區對接央(yang)企(qi)的合(he)(he)作(zuo)平(ping)臺。不(bu)少地方(fang)把(ba)國(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)(ji)作(zuo)為(wei)推(tui)進城(cheng)市(shi)化建(jian)設的重要平(ping)臺。四個直轄市(shi)的企(qi)業(ye)(ye)(ye)(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)逐步向(xiang)(xiang)支柱(zhu)(zhu)產(chan)(chan)業(ye)(ye)(ye)(ye)和(he)關(guan)系民生的公共(gong)基(ji)礎設施領(ling)域(yu)(yu)集中。山(shan)西省(sheng)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委以(yi)煤(mei)炭資(zi)(zi)源整合(he)(he)為(wei)推(tui)手,加快推(tui)進省(sheng)、市(shi)國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)(ye)(ye)(ye)的結構調整和(he)產(chan)(chan)業(ye)(ye)(ye)(ye)升(sheng)級。海南(nan)省(sheng)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委大力推(tui)動省(sheng)屬國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)(ye)(ye)(ye)與(yu)市(shi)縣合(he)(he)作(zuo),共(gong)同組建(jian)參與(yu)新城(cheng)區和(he)港區開發(fa)的投資(zi)(zi)主體。青海省(sheng)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)委以(yi)循環(huan)經濟(ji)(ji)試驗(yan)區和(he)高新技(ji)術(shu)產(chan)(chan)業(ye)(ye)(ye)(ye)為(wei)依托,積(ji)極(ji)搭(da)建(jian)省(sheng)內國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)(ye)(ye)(ye)合(he)(he)作(zuo)發(fa)展(zhan)平(ping)臺。各地通過(guo)指導推(tui)動優勢(shi)資(zi)(zi)源集中,使國(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)(ji)在地方(fang)經濟(ji)(ji)社會(hui)發(fa)展(zhan)中的引(yin)領(ling)帶動作(zuo)用(yong)得到進一步發(fa)揮(hui)。

  總體上看,近一(yi)年來,各地(di)國(guo)資(zi)(zi)委認(ren)真貫徹落實杭州(zhou)會議(yi)精神(shen),通過建(jian)立健全指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)工(gong)作機(ji)制和(he)制度,不(bu)斷創(chuang)新(xin)指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)方式和(he)方法,抓(zhua)住重點(dian),突破難(nan)點(dian),國(guo)資(zi)(zi)委系(xi)統(tong)指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)工(gong)作開(kai)始(shi)從起步(bu)開(kai)局向縱深推進(jin)(jin)轉(zhuan)變(bian),從分頭摸索向集(ji)中借鑒轉(zhuan)變(bian),從提出一(yi)般要求向深化(hua)體系(xi)建(jian)設轉(zhuan)變(bian),為推進(jin)(jin)完(wan)善地(di)方國(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管體制、促進(jin)(jin)地(di)方國(guo)有企(qi)業科學發展發揮了積(ji)極(ji)作用。在肯定成績的(de)(de)(de)同時,我們也要清醒(xing)地(di)看到,目前(qian)指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)工(gong)作尚處于剛(gang)(gang)剛(gang)(gang)起步(bu)、逐步(bu)發展的(de)(de)(de)階段(duan),仍然存(cun)(cun)在不(bu)少問題,主要是:對指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)工(gong)作的(de)(de)(de)認(ren)識參差(cha)不(bu)齊(qi),各地(di)工(gong)作進(jin)(jin)展不(bu)平(ping)衡;指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)工(gong)作體系(xi)還不(bu)夠完(wan)善,特別是對縣級國(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管工(gong)作的(de)(de)(de)指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)仍較薄弱;指(zhi)(zhi)導(dao)(dao)(dao)監(jian)(jian)(jian)(jian)督(du)(du)的(de)(de)(de)一(yi)些重點(dian)難(nan)點(dian)還需要積(ji)極(ji)探索、尋求突破。對存(cun)(cun)在的(de)(de)(de)這些問題,我們要在下一(yi)步(bu)工(gong)作中采取切實措施(shi),努力加以解決。

  二(er)、“十二(er)五”時(shi)期指導(dao)監督地方國資工(gong)作的總體思路和(he)主(zhu)要(yao)任務

  “十二五”時期,是深(shen)(shen)入推進(jin)國(guo)有(you)(you)資(zi)產監管體(ti)制(zhi)完善(shan)(shan)的關鍵時期,也是深(shen)(shen)化國(guo)有(you)(you)企業改(gai)革(ge)發(fa)展(zhan)(zhan)的重要(yao)時期。按照以(yi)科學發(fa)展(zhan)(zhan)為主題、以(yi)加(jia)快轉變經(jing)濟(ji)發(fa)展(zhan)(zhan)方式為主線的要(yao)求,“十二五”時期將(jiang)更(geng)加(jia)重視改(gai)革(ge)的頂層設(she)計(ji)和(he)(he)(he)總(zong)體(ti)規劃,在繼續完善(shan)(shan)經(jing)營性國(guo)有(you)(you)資(zi)產監管體(ti)制(zhi)的同時,還將(jiang)完善(shan)(shan)國(guo)有(you)(you)金融資(zi)產、行政事業單位資(zi)產和(he)(he)(he)自然資(zi)源資(zi)產監管體(ti)制(zhi),推動(dong)重點領域和(he)(he)(he)關鍵環節(jie)的改(gai)革(ge)取(qu)得(de)突破性進(jin)展(zhan)(zhan)。從國(guo)際看,隨著經(jing)濟(ji)全球化進(jin)程不斷深(shen)(shen)入,國(guo)有(you)(you)企業“走(zou)出(chu)去(qu)”步(bu)伐(fa)進(jin)一步(bu)加(jia)快,美國(guo)、歐盟等發(fa)達國(guo)家(jia)和(he)(he)(he)地(di)區對(dui)我國(guo)國(guo)有(you)(you)企業的管理體(ti)制(zhi)和(he)(he)(he)治理模式將(jiang)越來越關注。國(guo)內外形勢的發(fa)展(zhan)(zhan)變化,既(ji)為完善(shan)(shan)國(guo)有(you)(you)資(zi)產監管體(ti)制(zhi)、加(jia)快國(guo)有(you)(you)企業改(gai)革(ge)帶來新的機遇與挑戰,也對(dui)“十二五”時期深(shen)(shen)入開展(zhan)(zhan)指導監督(du)地(di)方國(guo)資(zi)工(gong)作提出(chu)了新任務和(he)(he)(he)新要(yao)求。

  “十二五”時期(qi)指導監督地(di)(di)方(fang)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)工(gong)作的(de)總體思路是:以鄧小平理(li)論和“三個代表”重要思想(xiang)為(wei)指導,深入貫(guan)徹落實科學發展觀,緊緊圍繞 “兩新(xin)目標(biao)”,牢固(gu)樹立(li)(li)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)系統一(yi)(yi)盤(pan)棋理(li)念,立(li)(li)足“指導、溝通、交流、服務(wu)”,以加強地(di)(di)方(fang)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監管機(ji)構建設、推(tui)進(jin)經營性國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)集中(zhong)統一(yi)(yi)監管、促進(jin)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監管工(gong)作不斷深化(hua)、強化(hua)企業國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)基礎管理(li)為(wei)重點,進(jin)一(yi)(yi)步完(wan)善(shan)指導監督工(gong)作機(ji)制和制度,推(tui)動構建國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)工(gong)作大格局,努力提升地(di)(di)方(fang)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委依法(fa)履行出資(zi)(zi)(zi)(zi)人職責(ze)、加強國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監管的(de)能(neng)力和水平,為(wei)完(wan)善(shan)企業國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監管體制、促進(jin)國(guo)(guo)(guo)有(you)(you)企業改革發展作出新(xin)貢(gong)獻。

  根據上述總(zong)體(ti)思(si)路,“十二五”時期(qi)指導監督地方國資工作(zuo)要全面落(luo)實(shi)以下四(si)項主要任務:

  (一(yi))指(zhi)導(dao)加強地(di)方國有(you)資產監管機構(gou)建設。

  加強國(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)產監(jian)管(guan)(guan)機(ji)(ji)構(gou)(gou)建設,是(shi)完(wan)善國(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)產監(jian)管(guan)(guan)體制(zhi)的組織基(ji)礎。黨的十六大以來,中央和省、地市三級(ji)政府(fu)組建國(guo)(guo)資(zi)(zi)委(wei),作為(wei)政府(fu)直(zhi)屬特設機(ji)(ji)構(gou)(gou),在機(ji)(ji)構(gou)(gou)設置上(shang)實現(xian)了政府(fu)的社會(hui)公共管(guan)(guan)理(li)部門與(yu)(yu)政府(fu)的國(guo)(guo)有(you)(you)(you)(you)(you)資(zi)(zi)產監(jian)管(guan)(guan)機(ji)(ji)構(gou)(gou)完(wan)全分開(kai)。政府(fu)對國(guo)(guo)有(you)(you)(you)(you)(you)企(qi)業(ye)(ye)的管(guan)(guan)理(li),由(you)過(guo)去(qu)以行(xing)政方式管(guan)(guan)理(li)改(gai)為(wei)以出資(zi)(zi)方式管(guan)(guan)理(li),由(you)過(guo)去(qu)各部門多頭管(guan)(guan)理(li)改(gai)為(wei)由(you)國(guo)(guo)資(zi)(zi)委(wei)統(tong)一(yi)履行(xing)出資(zi)(zi)人職責。這一(yi)新(xin)體制(zhi)具有(you)(you)(you)(you)(you)鮮明(ming)的中國(guo)(guo)特色,既(ji)是(shi)我(wo)國(guo)(guo)不斷探索(suo)規范政府(fu)與(yu)(yu)國(guo)(guo)有(you)(you)(you)(you)(you)企(qi)業(ye)(ye)之間關系(xi)的重(zhong)要制(zhi)度創(chuang)新(xin),也是(shi)不斷深(shen)化國(guo)(guo)有(you)(you)(you)(you)(you)企(qi)業(ye)(ye)改(gai)革的經驗(yan)結晶。8年多來的實踐表(biao)明(ming),這一(yi)新(xin)體制(zhi)有(you)(you)(you)(you)(you)利于(yu)保障國(guo)(guo)有(you)(you)(you)(you)(you)企(qi)業(ye)(ye)真正成為(wei)獨立的市場主體和法人實體,有(you)(you)(you)(you)(you)利于(yu)國(guo)(guo)有(you)(you)(you)(you)(you)企(qi)業(ye)(ye)平等參與(yu)(yu)國(guo)(guo)內(nei)外兩個市場競(jing)爭,因而更(geng)好地適應(ying)了深(shen)化國(guo)(guo)有(you)(you)(you)(you)(you)企(qi)業(ye)(ye)改(gai)革的客(ke)觀需(xu)要,更(geng)好地適應(ying)了發(fa)展(zhan)社會(hui)主義市場經濟(ji)的客(ke)觀需(xu)要。

  目前(qian),省級國(guo)資(zi)(zi)(zi)委機(ji)構及其職(zhi)(zhi)責(ze)(ze)定(ding)位(wei)比較(jiao)穩固,但(dan)不(bu)少(shao)地(di)市(shi)國(guo)資(zi)(zi)(zi)委由(you)直屬特設(she)(she)機(ji)構改(gai)為了政府(fu)部門或者(zhe)與其他部門合署辦公,機(ji)構不(bu)獨立、行(xing)政化趨勢比較(jiao)明顯。據統計(ji),全國(guo)356個地(di)市(shi)中,盡管(guan)(guan)有(you)(you)331個設(she)(she)立國(guo)資(zi)(zi)(zi)委,占(zhan)93%,但(dan)作為獨立機(ji)構的只有(you)(you)227個,占(zhan)設(she)(she)立國(guo)資(zi)(zi)(zi)委的68.6%;保留直屬特設(she)(she)機(ji)構性質的只有(you)(you)107個,占(zhan)設(she)(she)立國(guo)資(zi)(zi)(zi)委的32.3%。從職(zhi)(zhi)責(ze)(ze)上看,一些地(di)方國(guo)資(zi)(zi)(zi)委出(chu)資(zi)(zi)(zi)人三項主要(yao)職(zhi)(zhi)責(ze)(ze)不(bu)統一、不(bu)到(dao)(dao)位(wei)現象仍然比較(jiao)突出(chu),面上監(jian)管(guan)(guan)職(zhi)(zhi)責(ze)(ze)尤為薄弱。個別(bie)地(di)市(shi)國(guo)資(zi)(zi)(zi)委的主要(yao)工(gong)作集中在企業改(gai)制、處理信訪和維(wei)護(hu)穩定(ding)上,企業國(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)管(guan)(guan)職(zhi)(zhi)責(ze)(ze)沒有(you)(you)得到(dao)(dao)落實(shi)。

  針對上述(shu)情(qing)況(kuang),“十二(er)(er)五(wu)”時期(qi)要(yao)把(ba)指導推(tui)進國有(you)資(zi)產監管機(ji)構(gou)建設擺在首要(yao)位(wei)置,核心是堅(jian)持(chi)國資(zi)委直屬特(te)設機(ji)構(gou)性質。具體(ti)來說,要(yao)把(ba)握好以下三點:一要(yao)準(zhun)確(que)把(ba)握特(te)設機(ji)構(gou)的實(shi)質要(yao)求。注意區別于政(zheng)府(fu)公共管理部門和(he)機(ji)構(gou),堅(jian)持(chi)國資(zi)委在政(zheng)府(fu)層面(mian)依法履(lv)行出(chu)資(zi)人職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)、專司國有(you)資(zi)產監管、不(bu)(bu)承擔公共管理職(zhi)(zhi)(zhi)能(neng)(neng)的特(te)殊定位(wei)。二(er)(er)要(yao)準(zhun)確(que)把(ba)握特(te)設機(ji)構(gou)的職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)邊界。對出(chu)資(zi)人職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)范圍內的工作(zuo)(zuo),盡職(zhi)(zhi)(zhi)盡責(ze)(ze)(ze)(ze)不(bu)(bu)缺(que)位(wei);對指導和(he)推(tui)動監管企業(ye)的工作(zuo)(zuo),有(you)據有(you)度(du)不(bu)(bu)越(yue)位(wei);對協助(zhu)政(zheng)府(fu)其他部門的工作(zuo)(zuo),做好配合不(bu)(bu)錯(cuo)位(wei)。三要(yao)準(zhun)確(que)把(ba)握特(te)設機(ji)構(gou)的職(zhi)(zhi)(zhi)能(neng)(neng)配置。堅(jian)持(chi)將出(chu)資(zi)人職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)和(he)面(mian)上監管職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)有(you)機(ji)結(jie)合起來,在依法履(lv)行出(chu)資(zi)人職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)的同時,認真履(lv)行好面(mian)上監管職(zhi)(zhi)(zhi)責(ze)(ze)(ze)(ze)。

  (二)指導推(tui)動經(jing)營性國(guo)有資(zi)產的集(ji)中統一監(jian)管(guan)。

  今年初(chu),張(zhang)德江副總理(li)在(zai)全國國有(you)(you)(you)資(zi)產(chan)監(jian)(jian)督管(guan)理(li)工作(zuo)(zuo)會議上提出,要“拓(tuo)寬監(jian)(jian)管(guan)范(fan)圍,逐(zhu)步做到全過程、全方(fang)位(wei)監(jian)(jian)管(guan),不留死角,不留遺漏(lou),不出現重大失責”。國務院(yuan)領(ling)導的(de)明確要求(qiu),為(wei)(wei)深(shen)入推動(dong)經(jing)營(ying)性(xing)國有(you)(you)(you)資(zi)產(chan)集(ji)中統(tong)(tong)一(yi)監(jian)(jian)管(guan)指明了方(fang)向。當(dang)前(qian),不少省(sheng)級國資(zi)委在(zai)省(sheng)委、省(sheng)政(zheng)府的(de)重視、支持(chi)下(xia),逐(zhu)步推進(jin)地方(fang)經(jing)營(ying)性(xing)國有(you)(you)(you)資(zi)產(chan)的(de)集(ji)中統(tong)(tong)一(yi)監(jian)(jian)管(guan),監(jian)(jian)管(guan)范(fan)圍不斷拓(tuo)展。但有(you)(you)(you)的(de)地方(fang)經(jing)營(ying)性(xing)國有(you)(you)(you)資(zi)產(chan)監(jian)(jian)管(guan)還(huan)較為(wei)(wei)分(fen)散,當(dang)地國資(zi)委監(jian)(jian)管(guan)的(de)比(bi)(bi)例比(bi)(bi)較低,目(mu)前(qian)仍有(you)(you)(you)4個省(sheng)級國資(zi)委監(jian)(jian)管(guan)覆蓋面低于50%。有(you)(you)(you)的(de)地方(fang)將(jiang)新(xin)設(she)立的(de)國有(you)(you)(you)企業交由公(gong)共管(guan)理(li)部門監(jian)(jian)管(guan),還(huan)有(you)(you)(you)的(de)地方(fang)甚至將(jiang)國資(zi)委監(jian)(jian)管(guan)企業重新(xin)劃回原行業主管(guan)部門。因此(ci),必須把(ba)推動(dong)地方(fang)經(jing)營(ying)性(xing)國有(you)(you)(you)資(zi)產(chan)的(de)集(ji)中統(tong)(tong)一(yi)監(jian)(jian)管(guan),作(zuo)(zuo)為(wei)(wei)指導監(jian)(jian)督工作(zuo)(zuo)的(de)重要任務。

  “十二(er)五”時期,推動(dong)地(di)(di)方(fang)經營(ying)性國(guo)(guo)有(you)資(zi)(zi)產的(de)(de)(de)(de)集(ji)(ji)中(zhong)統一(yi)(yi)監(jian)(jian)管(guan)(guan)(guan)(guan),應當(dang)著力抓(zhua)好以下(xia)三(san)點(dian):一(yi)(yi)要積極拓展國(guo)(guo)資(zi)(zi)委(wei)(wei)監(jian)(jian)管(guan)(guan)(guan)(guan)范(fan)圍。各地(di)(di)國(guo)(guo)資(zi)(zi)委(wei)(wei)要主動(dong)匯(hui)報,爭(zheng)取(qu)地(di)(di)方(fang)黨委(wei)(wei)、政府(fu)支持。要以統一(yi)(yi)履(lv)行出資(zi)(zi)人職責為(wei)目(mu)標(biao),采(cai)(cai)取(qu)多種方(fang)式,循(xun)序漸(jian)進,盡可能將地(di)(di)方(fang)國(guo)(guo)有(you)企(qi)(qi)業納入新的(de)(de)(de)(de)國(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)體(ti)制。完全(quan)納入暫時還有(you)困難的(de)(de)(de)(de),可以采(cai)(cai)取(qu)由(you)國(guo)(guo)資(zi)(zi)委(wei)(wei)委(wei)(wei)托監(jian)(jian)管(guan)(guan)(guan)(guan)、行業部門(men)具(ju)體(ti)監(jian)(jian)管(guan)(guan)(guan)(guan)等方(fang)式。二(er)要注意(yi)發(fa)揮好統一(yi)(yi)監(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)(de)體(ti)制優(you)(you)勢。嚴格按照(zhao)出資(zi)(zi)關系,切實加(jia)強(qiang)出資(zi)(zi)人專(zhuan)業化(hua)、系統化(hua)、規范(fan)化(hua)監(jian)(jian)管(guan)(guan)(guan)(guan),提高(gao)國(guo)(guo)有(you)資(zi)(zi)產監(jian)(jian)管(guan)(guan)(guan)(guan)效(xiao)率,使出資(zi)(zi)人監(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)(de)體(ti)制優(you)(you)勢得到(dao)充分體(ti)現。三(san)要集(ji)(ji)中(zhong)資(zi)(zi)源(yuan)打造優(you)(you)勢企(qi)(qi)業。通(tong)過(guo)推動(dong)集(ji)(ji)中(zhong)統一(yi)(yi)監(jian)(jian)管(guan)(guan)(guan)(guan),加(jia)快在更大范(fan)圍、更高(gao)層次上的(de)(de)(de)(de)企(qi)(qi)業重(zhong)組和資(zi)(zi)源(yuan)整合,著力培育一(yi)(yi)批(pi)地(di)(di)方(fang)優(you)(you)勢企(qi)(qi)業,具(ju)備條件的(de)(de)(de)(de)還要力爭(zheng)培育成為(wei)國(guo)(guo)內領(ling)先(xian)企(qi)(qi)業或世界一(yi)(yi)流企(qi)(qi)業。總(zong)之,要通(tong)過(guo)指導(dao)推動(dong),爭(zheng)取(qu)在新的(de)(de)(de)(de)體(ti)制框(kuang)架下(xia)實現集(ji)(ji)中(zhong)統一(yi)(yi)監(jian)(jian)管(guan)(guan)(guan)(guan),在優(you)(you)化(hua)資(zi)(zi)源(yuan)配置的(de)(de)(de)(de)前提下(xia)實現集(ji)(ji)中(zhong)統一(yi)(yi)監(jian)(jian)管(guan)(guan)(guan)(guan),在打造優(you)(you)勢企(qi)(qi)業的(de)(de)(de)(de)過(guo)程中(zhong)實現集(ji)(ji)中(zhong)統一(yi)(yi)監(jian)(jian)管(guan)(guan)(guan)(guan)。

  (三(san))指導促進(jin)地方國有(you)資產監管(guan)工作不斷深化(hua)。

  目前,各地國(guo)有(you)資(zi)產(chan)監(jian)(jian)管(guan)工(gong)作基(ji)本進入規(gui)(gui)范化(hua)軌道。但隨(sui)著國(guo)有(you)企(qi)業(ye)改革發展(zhan)的(de)(de)不(bu)(bu)斷(duan)加快(kuai),國(guo)資(zi)監(jian)(jian)管(guan)工(gong)作還不(bu)(bu)能完全適應當前形勢發展(zhan)變化(hua)的(de)(de)需(xu)要,監(jian)(jian)管(guan)不(bu)(bu)到位、監(jian)(jian)管(guan)資(zi)源分(fen)散、監(jian)(jian)管(guan)效率不(bu)(bu)高的(de)(de)問題還不(bu)(bu)同程度地存在,國(guo)資(zi)委(wei)內部業(ye)務流程和組織結構也有(you)待優(you)化(hua)完善(shan)。特別是在股(gu)權多元化(hua)條件下,國(guo)有(you)資(zi)產(chan)出資(zi)人(ren)代表如何在企(qi)業(ye)層(ceng)層(ceng)落實到位,如何加強境外(wai)國(guo)有(you)資(zi)產(chan)和重要子企(qi)業(ye)監(jian)(jian)管(guan)等,都(dou)需(xu)要進一步探索(suo)和規(gui)(gui)范。

  “十二(er)(er)五(wu)”時(shi)期要(yao)通過加(jia)強指導監(jian)(jian)(jian)(jian)督(du),大力推進國(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作(zuo)(zuo)的(de)(de)不斷深化(hua)。一要(yao)著(zhu)力拓寬(kuan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)思路(lu),提高監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作(zuo)(zuo)的(de)(de)前(qian)瞻(zhan)性(xing)。注(zhu)意指導下(xia)級國(guo)資(zi)(zi)委妥(tuo)善應對(dui)日趨復雜的(de)(de)宏觀經濟環境,準(zhun)確把(ba)握國(guo)有(you)(you)(you)(you)資(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)和國(guo)有(you)(you)(you)(you)企(qi)業(ye)改革(ge)發展中的(de)(de)方(fang)向性(xing)、趨勢性(xing)問(wen)題(ti)。二(er)(er)要(yao)著(zhu)力突出監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)重點,提高監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作(zuo)(zuo)的(de)(de)針(zhen)對(dui)性(xing)。根(gen)據監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)企(qi)業(ye)不同的(de)(de)股權結(jie)構和組(zu)織形式(shi),積極探索(suo)分(fen)(fen)類監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)。切實加(jia)強混(hun)合(he)(he)所(suo)有(you)(you)(you)(you)制(zhi)(zhi)下(xia)國(guo)有(you)(you)(you)(you)產(chan)權的(de)(de)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)理,繼續完善有(you)(you)(you)(you)利(li)于推動企(qi)業(ye)自主創(chuang)新、提高發展質(zhi)量的(de)(de)考核(he)指標體系。適應國(guo)有(you)(you)(you)(you)企(qi)業(ye)“走出去(qu)”要(yao)求,進一步(bu)加(jia)強對(dui)境外國(guo)有(you)(you)(you)(you)資(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)。針(zhen)對(dui)國(guo)有(you)(you)(you)(you)企(qi)業(ye)大部(bu)分(fen)(fen)資(zi)(zi)產(chan)集中在二(er)(er)、三級企(qi)業(ye)的(de)(de)情(qing)況(kuang),完善對(dui)重要(yao)子企(qi)業(ye)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)的(de)(de)制(zhi)(zhi)度機(ji)制(zhi)(zhi)。三要(yao)著(zhu)力整(zheng)合(he)(he)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)資(zi)(zi)源,提高監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作(zuo)(zuo)的(de)(de)有(you)(you)(you)(you)效(xiao)性(xing)。適時(shi)調(diao)整(zheng)優(you)化(hua)國(guo)資(zi)(zi)委內(nei)部(bu)機(ji)構設置(zhi)和職能配(pei)置(zhi),加(jia)強投資(zi)(zi)規劃(hua)、產(chan)權管(guan)(guan)(guan)(guan)(guan)(guan)(guan)理、財務(wu)監(jian)(jian)(jian)(jian)督(du)、業(ye)績(ji)考核(he)、薪(xin)酬分(fen)(fen)配(pei)、干部(bu)任(ren)免、外派監(jian)(jian)(jian)(jian)事(shi)會、紀檢監(jian)(jian)(jian)(jian)察等各(ge)個環節(jie)的(de)(de)銜接協調(diao),形成國(guo)資(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)的(de)(de)閉環鏈條(tiao)。探索(suo)國(guo)有(you)(you)(you)(you)企(qi)業(ye)財務(wu)信(xin)息公開制(zhi)(zhi)度,注(zhu)重利(li)用(yong)現代信(xin)息技(ji)術實施監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan),不斷創(chuang)新監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)方(fang)式(shi),不斷提高監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)效(xiao)率。

  這(zhe)里,我還要特別強調國(guo)資(zi)(zi)(zi)(zi)委系(xi)統融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)平臺(tai)公(gong)司(si)風(feng)(feng)險防(fang)范問題(ti)。這(zhe)是當(dang)前和今(jin)后一(yi)個時期,指(zhi)(zhi)導(dao)監督工作應當(dang)給予高度關注的(de)(de)問題(ti)。融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)平臺(tai)公(gong)司(si)大(da)多(duo)以國(guo)有(you)土地(di)使(shi)用(yong)權、國(guo)有(you)企業股權等(deng)作為(wei)融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)擔保,貸款期限長,潛在風(feng)(feng)險大(da)。要注意指(zhi)(zhi)導(dao)地(di)方(fang)融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)平臺(tai)公(gong)司(si)按照企業規律運營(ying),既要服務于當(dang)地(di)經濟(ji)社會(hui)發(fa)展(zhan)大(da)局(ju),為(wei)地(di)方(fang)基礎設施建設提供資(zi)(zi)(zi)(zi)金支(zhi)持;又要量入為(wei)出,合理確定融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)規模(mo),不能以犧牲國(guo)有(you)資(zi)(zi)(zi)(zi)產安全(quan)解決暫時的(de)(de)資(zi)(zi)(zi)(zi)金需求,不能給國(guo)有(you)經濟(ji)發(fa)展(zhan)帶來(lai)長期隱(yin)患。各地(di)國(guo)資(zi)(zi)(zi)(zi)委要對所監管的(de)(de)融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)平臺(tai)公(gong)司(si)依法履行好出資(zi)(zi)(zi)(zi)人職責,嚴格按照法定程序參與(yu)重大(da)事(shi)項決策(ce),重視指(zhi)(zhi)導(dao)融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)平臺(tai)公(gong)司(si)完善(shan)治理結構,提高科學決策(ce)水平。要抓緊摸(mo)清(qing)所監管的(de)(de)融(rong)(rong)(rong)資(zi)(zi)(zi)(zi)平臺(tai)公(gong)司(si)資(zi)(zi)(zi)(zi)產負債(zhai)、擔保等(deng)基本情況,全(quan)面評估潛在風(feng)(feng)險,認真研究(jiu)制定切(qie)實(shi)可(ke)行的(de)(de)風(feng)(feng)險防(fang)范預案(an)。

  (四)指(zhi)導(dao)健全企業(ye)國有資產基礎管理(li)工作體(ti)系。

  健(jian)全(quan)企業(ye)國有資(zi)(zi)(zi)產(chan)(chan)基礎管(guan)(guan)理(li)工(gong)作(zuo)體(ti)系(xi),既是開(kai)展指導監督工(gong)作(zuo)的(de)(de)(de)重(zhong)要(yao)(yao)抓(zhua)手(shou),也是上下級國資(zi)(zi)(zi)委之(zhi)間加強聯(lian)系(xi)的(de)(de)(de)重(zhong)要(yao)(yao)紐(niu)帶。認真做好(hao)這項工(gong)作(zuo),有利于全(quan)面掌握國有資(zi)(zi)(zi)產(chan)(chan)整(zheng)體(ti)狀(zhuang)況,有利于全(quan)程監管(guan)(guan)國有資(zi)(zi)(zi)產(chan)(chan)流轉環節,有利于適(shi)時(shi)實現(xian)國有資(zi)(zi)(zi)產(chan)(chan)運營(ying)質量監測。目前,國資(zi)(zi)(zi)委系(xi)統基礎管(guan)(guan)理(li)工(gong)作(zuo)體(ti)系(xi)初步(bu)(bu)形成(cheng),管(guan)(guan)理(li)規(gui)則(ze)逐步(bu)(bu)健(jian)全(quan)。但有關制(zhi)度位(wei)階較低(di),系(xi)統內外規(gui)則(ze)不統一(yi),部門職能交(jiao)叉、多頭管(guan)(guan)理(li)、責(ze)任不清的(de)(de)(de)現(xian)象仍然存(cun)在(zai),縣級企業(ye)國有資(zi)(zi)(zi)產(chan)(chan)基礎管(guan)(guan)理(li)缺位(wei)還比(bi)較嚴重(zhong)。同時(shi),隨著這幾年國有資(zi)(zi)(zi)產(chan)(chan)管(guan)(guan)理(li)體(ti)制(zhi)改(gai)革和國有企業(ye)改(gai)革重(zhong)組(zu)的(de)(de)(de)不斷深入(ru),國有經(jing)濟(ji)在(zai)我國經(jing)濟(ji)社會發展中(zhong)的(de)(de)(de)主體(ti)地位(wei)和主導作(zuo)用進(jin)一(yi)步(bu)(bu)突出,有關基礎數據對(dui)國家宏觀經(jing)濟(ji)決策的(de)(de)(de)參考價值日益凸(tu)顯,因而對(dui)我們加強企業(ye)國有資(zi)(zi)(zi)產(chan)(chan)基礎管(guan)(guan)理(li)提(ti)出了更(geng)為重(zhong)要(yao)(yao)和緊(jin)迫的(de)(de)(de)要(yao)(yao)求。

  “十二(er)五”時(shi)(shi)期,指(zhi)導健全(quan)企(qi)業(ye)國(guo)有(you)(you)(you)資產(chan)(chan)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)工作(zuo)體(ti)系,應當著力(li)抓好(hao)以下三點:一要(yao)(yao)加快(kuai)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)制(zhi)度(du)建(jian)設(she)。2010年、2011年,國(guo)務院兩次(ci)將《企(qi)業(ye)國(guo)有(you)(you)(you)資產(chan)(chan)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)條例(li)》列為“條件成(cheng)熟時(shi)(shi)出(chu)臺”的(de)(de)立法(fa)項目。各地國(guo)資委(wei)(wei)一方(fang)面(mian)(mian)(mian)要(yao)(yao)積極配合起草好(hao)這個條例(li),另一方(fang)面(mian)(mian)(mian),要(yao)(yao)重視加強地方(fang)國(guo)有(you)(you)(you)資產(chan)(chan)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)制(zhi)度(du)建(jian)設(she),積極創造條件,爭取實現本地區基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)規則(ze)和制(zhi)度(du)的(de)(de)統一。二(er)要(yao)(yao)完善基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)工作(zuo)機(ji)制(zhi)。要(yao)(yao)加強與(yu)有(you)(you)(you)關部門的(de)(de)溝(gou)通協調(diao)(diao),明確部門分工,依法(fa)落(luo)實省(sheng)、地市(shi)兩級國(guo)資委(wei)(wei)企(qi)業(ye)國(guo)有(you)(you)(you)資產(chan)(chan)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)職責,盡(jin)快(kuai)明確縣級企(qi)業(ye)國(guo)有(you)(you)(you)資產(chan)(chan)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)主體(ti),建(jian)立全(quan)面(mian)(mian)(mian)覆蓋(gai)、層(ceng)級完整(zheng)的(de)(de)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)工作(zuo)機(ji)制(zhi)。三要(yao)(yao)利用好(hao)基(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)數據成(cheng)果。比如,通過(guo)全(quan)面(mian)(mian)(mian)掌握(wo)總(zong)量(liang)與(yu)分布(bu)情況,為國(guo)有(you)(you)(you)經濟布(bu)局結(jie)構調(diao)(diao)整(zheng)提供(gong)依據;通過(guo)及時(shi)(shi)跟蹤國(guo)有(you)(you)(you)產(chan)(chan)權變動情況,有(you)(you)(you)效維護國(guo)有(you)(you)(you)資產(chan)(chan)安(an)全(quan);通過(guo)分析國(guo)有(you)(you)(you)經濟運行動態,為政府實施(shi)宏觀經濟管(guan)(guan)(guan)理(li)和國(guo)資委(wei)(wei)實施(shi)有(you)(you)(you)效監管(guan)(guan)(guan)提供(gong)決策參(can)考。

  以上四(si)項(xiang)主要任(ren)務,是針對國資委系統指導(dao)監督工(gong)(gong)(gong)作需要重點(dian)突(tu)破(po)的(de)共性問(wen)題(ti)提(ti)出(chu)來的(de)。各(ge)地情況(kuang)不(bu)同,在開展(zhan)指導(dao)監督工(gong)(gong)(gong)作時,還可以明確其他一些重點(dian)工(gong)(gong)(gong)作任(ren)務。要分析本地區的(de)突(tu)出(chu)矛盾(dun)和問(wen)題(ti),分清輕重緩急,在指導(dao)監督工(gong)(gong)(gong)作中始終堅持抓重點(dian),破(po)難(nan)點(dian),出(chu)亮點(dian),做精品。

  三(san)、深入做(zuo)好指導(dao)監督地方(fang)國資工(gong)作的幾點要求

  今年(nian)是(shi)指導監(jian)督(du)地方國(guo)資(zi)工(gong)(gong)作深入推(tui)進(jin)的(de)一(yi)年(nian)。按照“十二(er)五(wu)”時期指導監(jian)督(du)工(gong)(gong)作總體思路和主要任(ren)務(wu),各地國(guo)資(zi)委要著力(li)在“提高認識、完(wan)善制(zhi)度、突(tu)出重(zhong)點、提升能力(li)”上下功夫,扎(zha)扎(zha)實(shi)實(shi)地做好各項工(gong)(gong)作。

  (一)要(yao)始終把指導監督工作擺上重要(yao)議(yi)事日程。

  上級(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)依法(fa)對下(xia)級(ji)政府(fu)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)工作(zuo)(zuo)(zuo)進行指(zhi)(zhi)導(dao)(dao)和(he)監(jian)(jian)(jian)(jian)(jian)督(du),是法(fa)律賦(fu)予(yu)各級(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)的(de)(de)(de)(de)一(yi)項重要(yao)(yao)職(zhi)責(ze)。各地國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)要(yao)(yao)從加(jia)快(kuai)完(wan)善地方(fang)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)體制和(he)制度(du)、提升(sheng)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)工作(zuo)(zuo)(zuo)能力(li)和(he)水平的(de)(de)(de)(de)高度(du),深(shen)刻認(ren)(ren)識和(he)把(ba)握加(jia)強(qiang)指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)的(de)(de)(de)(de)重要(yao)(yao)性(xing)和(he)緊迫(po)性(xing)。要(yao)(yao)牢固樹立國(guo)(guo)(guo)(guo)(guo)資(zi)系統(tong)一(yi)盤棋的(de)(de)(de)(de)理念(nian),加(jia)快(kuai)形(xing)成國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)的(de)(de)(de)(de)“大合力(li)”。要(yao)(yao)切(qie)實糾正指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)可有(you)可無的(de)(de)(de)(de)模糊認(ren)(ren)識,克服各種畏難情緒,切(qie)實把(ba)指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)有(you)效開展起來。各地國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)(wei)主要(yao)(yao)負責(ze)同(tong)志,要(yao)(yao)親自(zi)統(tong)籌謀劃,層(ceng)層(ceng)落實指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)責(ze)任;親自(zi)過問(wen)協(xie)調(diao),及(ji)時解決指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)涉及(ji)的(de)(de)(de)(de)重大問(wen)題;親自(zi)溝通(tong)協(xie)商,切(qie)實加(jia)強(qiang)對下(xia)級(ji)政府(fu)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)工作(zuo)(zuo)(zuo)的(de)(de)(de)(de)指(zhi)(zhi)導(dao)(dao)服務。分管(guan)(guan)指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)的(de)(de)(de)(de)負責(ze)同(tong)志,更要(yao)(yao)盡職(zhi)盡責(ze),深(shen)入(ru)(ru)分析把(ba)握本(ben)地區指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)的(de)(de)(de)(de)重點(dian)、難點(dian),認(ren)(ren)真組織(zhi)、協(xie)調(diao)和(he)落實指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)各項工作(zuo)(zuo)(zuo)要(yao)(yao)求,努力(li)將(jiang)指(zhi)(zhi)導(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)工作(zuo)(zuo)(zuo)引向深(shen)入(ru)(ru)。

  (二)要繼續(xu)健全指導監(jian)督工作機制和制度。

  健全完善指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)機制(zhi)和(he)(he)(he)制(zhi)度,是做(zuo)好(hao)指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)重(zhong)(zhong)要(yao)(yao)(yao)基(ji)礎(chu)。各地國(guo)資(zi)委(wei)要(yao)(yao)(yao)依(yi)據(ju)《指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)辦法(fa)(fa)(fa)》的(de)(de)(de)(de)(de)規(gui)定(ding),結(jie)合(he)本地實(shi)際,進一步加(jia)強指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)機制(zhi)和(he)(he)(he)制(zhi)度建設。要(yao)(yao)(yao)加(jia)快(kuai)形(xing)成委(wei)內(nei)各專業機構之間、上(shang)(shang)下(xia)級國(guo)資(zi)委(wei)之間指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)“兩個合(he)力(li)”。在(zai)明(ming)確委(wei)內(nei)分管領導(dao)(dao)(dao)(dao)(dao)(dao)和(he)(he)(he)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)機構的(de)(de)(de)(de)(de)基(ji)礎(chu)上(shang)(shang),既要(yao)(yao)(yao)發揮(hui)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)機構的(de)(de)(de)(de)(de)信息(xi)溝通(tong)、交(jiao)流服務和(he)(he)(he)綜合(he)協調(diao)作(zuo)(zuo)(zuo)(zuo)用,又要(yao)(yao)(yao)調(diao)動(dong)委(wei)內(nei)專業機構開展指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)積極性(xing)。要(yao)(yao)(yao)按(an)照指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)總體(ti)部(bu)署,通(tong)過會議、簡報(bao)、調(diao)研交(jiao)流和(he)(he)(he)指導(dao)(dao)(dao)(dao)(dao)(dao)檢查等(deng)多(duo)種形(xing)式,加(jia)快(kuai)健全國(guo)資(zi)委(wei)系統上(shang)(shang)下(xia)聯動(dong)、運轉有力(li)的(de)(de)(de)(de)(de)指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)機制(zhi)。要(yao)(yao)(yao)及時(shi)總結(jie)推廣指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)中的(de)(de)(de)(de)(de)特色做(zuo)法(fa)(fa)(fa)和(he)(he)(he)先進經驗,及時(shi)反饋工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)中遇到的(de)(de)(de)(de)(de)難點和(he)(he)(he)問題。要(yao)(yao)(yao)認真落實(shi)《指導(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)督(du)(du)(du)辦法(fa)(fa)(fa)》確立的(de)(de)(de)(de)(de)立法(fa)(fa)(fa)備案、法(fa)(fa)(fa)規(gui)政策實(shi)施(shi)督(du)(du)(du)查和(he)(he)(he)重(zhong)(zhong)大(da)(da)事項報(bao)告(gao)等(deng)“三項制(zhi)度”。堅持寓(yu)指導(dao)(dao)(dao)(dao)(dao)(dao)于服務之中,發揮(hui)好(hao)指導(dao)(dao)(dao)(dao)(dao)(dao)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)引導(dao)(dao)(dao)(dao)(dao)(dao)、規(gui)范、提高(gao)和(he)(he)(he)促(cu)進作(zuo)(zuo)(zuo)(zuo)用,同(tong)時(shi)防(fang)止越權干預下(xia)級國(guo)資(zi)委(wei)依(yi)法(fa)(fa)(fa)行權履責。堅持監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)“少而精”的(de)(de)(de)(de)(de)原(yuan)則,注意把監(jian)(jian)(jian)督(du)(du)(du)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)(zuo)的(de)(de)(de)(de)(de)著(zhu)力(li)點放在(zai)確保國(guo)資(zi)監(jian)(jian)(jian)管法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)和(he)(he)(he)國(guo)家(jia)政策的(de)(de)(de)(de)(de)貫(guan)徹(che)實(shi)施(shi)上(shang)(shang),放在(zai)國(guo)企改制(zhi)、產權轉讓等(deng)可能出現違(wei)法(fa)(fa)(fa)違(wei)規(gui)行為的(de)(de)(de)(de)(de)重(zhong)(zhong)點環節上(shang)(shang),放在(zai)防(fang)范國(guo)有資(zi)產重(zhong)(zhong)大(da)(da)損(sun)失和(he)(he)(he)重(zhong)(zhong)大(da)(da)不良社會影響的(de)(de)(de)(de)(de)潛在(zai)風(feng)險(xian)上(shang)(shang)。

  (三)要進一步(bu)突出指導監督(du)工(gong)作(zuo)重點(dian)。

  各(ge)地(di)國(guo)(guo)資(zi)(zi)(zi)委(wei)要(yao)(yao)(yao)根據“十二(er)五”時期指(zhi)導監(jian)(jian)(jian)督工(gong)作(zuo)(zuo)總(zong)體(ti)部(bu)署,注(zhu)意從本地(di)區實際情況和工(gong)作(zuo)(zuo)需要(yao)(yao)(yao)出發,明確工(gong)作(zuo)(zuo)重(zhong)(zhong)點,抓(zhua)好重(zhong)(zhong)點突破。要(yao)(yao)(yao)立足于(yu)進一(yi)步發揮國(guo)(guo)有(you)經(jing)(jing)濟(ji)在地(di)方經(jing)(jing)濟(ji)發展(zhan)中的(de)(de)引領帶動(dong)作(zuo)(zuo)用,積極(ji)參與當地(di)企(qi)業脫鉤改制和調整重(zhong)(zhong)組工(gong)作(zuo)(zuo),加快推進地(di)方經(jing)(jing)營性國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)的(de)(de)集(ji)中統一(yi)監(jian)(jian)(jian)管(guan)(guan)(guan)。要(yao)(yao)(yao)立足于(yu)國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)體(ti)制改革的(de)(de)正確方向(xiang),堅持政(zheng)企(qi)分(fen)開(kai)、政(zheng)資(zi)(zi)(zi)分(fen)開(kai)、所有(you)權(quan)與經(jing)(jing)營權(quan)相(xiang)分(fen)離,確保國(guo)(guo)資(zi)(zi)(zi)委(wei)直(zhi)屬(shu)特設機構(gou)定位(wei),切實扭轉部(bu)分(fen)地(di)市級(ji)國(guo)(guo)資(zi)(zi)(zi)委(wei)回歸行(xing)政(zheng)化的(de)(de)趨勢。要(yao)(yao)(yao)立足于(yu)新的(de)(de)國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)體(ti)制的(de)(de)特點和優勢,繼(ji)續探索加強縣級(ji)經(jing)(jing)營性國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)工(gong)作(zuo)(zuo),鼓勵國(guo)(guo)有(you)企(qi)業數(shu)量較多(duo)、企(qi)業國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)規模較大的(de)(de)縣單獨設立國(guo)(guo)資(zi)(zi)(zi)委(wei),指(zhi)導暫不具備條(tiao)件的(de)(de)縣抓(zhua)緊明確國(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)責任主體(ti)。

  (四)要(yao)不斷(duan)提升指導監督工作能力和水平(ping)。

  指(zhi)(zhi)導監(jian)督(du)工作(zuo)(zuo)涉(she)及(ji)國(guo)(guo)(guo)資(zi)(zi)監(jian)管(guan)和(he)國(guo)(guo)(guo)企改革發展的(de)(de)(de)(de)方方面(mian)面(mian),政(zheng)(zheng)(zheng)策(ce)(ce)要求高(gao)(gao),探(tan)(tan)索性(xing)很(hen)強,推進難度大,必須(xu)不斷提升指(zhi)(zhi)導監(jian)督(du)工作(zuo)(zuo)的(de)(de)(de)(de)能力(li)和(he)水平。要深(shen)入學(xue)(xue)(xue)習領會黨的(de)(de)(de)(de)十六大、十七大關于國(guo)(guo)(guo)有資(zi)(zi)產監(jian)管(guan)體制(zhi)改革和(he)完善(shan)的(de)(de)(de)(de)一系(xi)列方針政(zheng)(zheng)(zheng)策(ce)(ce),不斷探(tan)(tan)索解(jie)決指(zhi)(zhi)導監(jian)督(du)工作(zuo)(zuo)涉(she)及(ji)的(de)(de)(de)(de)方向性(xing)、全局(ju)性(xing)、戰略性(xing)問題(ti)。要適應指(zhi)(zhi)導監(jian)督(du)工作(zuo)(zuo)面(mian)臨(lin)的(de)(de)(de)(de)新形勢(shi)新任務,進一步加強指(zhi)(zhi)導監(jian)督(du)工作(zuo)(zuo)隊伍(wu)建(jian)設。堅持“學(xue)(xue)(xue)用(yong)結合(he)”,經常(chang)組織國(guo)(guo)(guo)資(zi)(zi)委(wei)系(xi)統深(shen)入交流(liu)學(xue)(xue)(xue)習,及(ji)時(shi)研討重(zhong)點(dian)問題(ti),加快提高(gao)(gao)指(zhi)(zhi)導監(jian)督(du)工作(zuo)(zuo)隊伍(wu)的(de)(de)(de)(de)政(zheng)(zheng)(zheng)治(zhi)業務素質和(he)綜合(he)工作(zuo)(zuo)能力(li),努力(li)培養(yang)一支懂(dong)政(zheng)(zheng)(zheng)策(ce)(ce)法(fa)規、精(jing)國(guo)(guo)(guo)資(zi)(zi)監(jian)管(guan)、善(shan)協(xie)調服務的(de)(de)(de)(de)指(zhi)(zhi)導監(jian)督(du)工作(zuo)(zuo)隊伍(wu)。

  根據(ju)委(wei)里會議計劃(hua),今(jin)年不(bu)再專門(men)召開國資委(wei)系統政(zheng)策法(fa)規(gui)工作會議,借此機(ji)會,我想重點強調(diao)兩個問題(ti)。

  (一)關于依法(fa)(fa)行權履(lv)責、進一步加強法(fa)(fa)治機(ji)構建設。

  近幾(ji)年(nian)來,國(guo)務院(yuan)高度重視法(fa)(fa)治政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)建設,專(zhuan)門印發(fa)了(le)《國(guo)務院(yuan)全(quan)面(mian)推(tui)(tui)進依(yi)法(fa)(fa)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)實施(shi)綱要(yao)》和《國(guo)務院(yuan)關(guan)于加強法(fa)(fa)治政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)建設的意見》,并且召開了(le)全(quan)國(guo)依(yi)法(fa)(fa)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)工作(zuo)會議,明確要(yao)求各級政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)部(bu)門從立法(fa)(fa)、決(jue)策(ce)、執(zhi)行(xing)(xing)(xing)、監督等方(fang)面(mian),采取切實措施(shi),全(quan)面(mian)推(tui)(tui)進依(yi)法(fa)(fa)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)工作(zuo)。國(guo)資委雖然不(bu)是政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)部(bu)門,但作(zuo)為直屬(shu)特(te)設機(ji)構在依(yi)法(fa)(fa)行(xing)(xing)(xing)權履(lv)責過程中,同樣必須貫徹落實好(hao)這些(xie)部(bu)署和要(yao)求。

  國(guo)(guo)(guo)(guo)(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)去(qu)年(nian)12月印(yin)發了《關(guan)于(yu)依法(fa)(fa)行(xing)(xing)權(quan)履責進(jin)一(yi)步加強法(fa)(fa)治機(ji)構建(jian)(jian)(jian)設的(de)(de)實(shi)施意見》,明確提(ti)出(chu)加強國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)法(fa)(fa)治機(ji)構建(jian)(jian)(jian)設的(de)(de)總體要(yao)求和(he)(he)具體任務(wu)。希望各(ge)(ge)(ge)地國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)高度重(zhong)視這項工(gong)(gong)作(zuo)。一(yi)要(yao)繼(ji)續做好國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)立法(fa)(fa)工(gong)(gong)作(zuo)。國(guo)(guo)(guo)(guo)(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)于(yu)近(jin)日制(zhi)定出(chu)臺了《中(zhong)央(yang)企業(ye)境(jing)外國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)督管(guan)(guan)理(li)暫行(xing)(xing)辦(ban)(ban)法(fa)(fa)》和(he)(he)《中(zhong)央(yang)企業(ye)境(jing)外國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)產(chan)權(quan)管(guan)(guan)理(li)暫行(xing)(xing)辦(ban)(ban)法(fa)(fa)》,目前正在抓緊起草《企業(ye)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)基礎管(guan)(guan)理(li)條例》,同時配合(he)(he)(he)財政部起草《國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)本經營(ying)預算條例》。各(ge)(ge)(ge)地國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)也要(yao)結(jie)(jie)合(he)(he)(he)本地區(qu)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)工(gong)(gong)作(zuo)實(shi)際和(he)(he)突出(chu)問題,切實(shi)加強相(xiang)關(guan)制(zhi)度建(jian)(jian)(jian)設,努力(li)(li)實(shi)現(xian)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)履行(xing)(xing)職(zhi)責的(de)(de)各(ge)(ge)(ge)項行(xing)(xing)為都有(you)(you)法(fa)(fa)可依。二要(yao)堅持國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)系統依法(fa)(fa)科學民(min)主決策。加強對重(zhong)大決策事(shi)項的(de)(de)合(he)(he)(he)法(fa)(fa)性審查(cha)(cha),未經合(he)(he)(he)法(fa)(fa)性審查(cha)(cha)或者(zhe)經審查(cha)(cha)不合(he)(he)(he)法(fa)(fa)的(de)(de),不能提(ti)交委(wei)(wei)(wei)主任辦(ban)(ban)公會議討論決定。三要(yao)牢固樹立程(cheng)(cheng)(cheng)序意識(shi)。在履行(xing)(xing)出(chu)資(zi)(zi)(zi)(zi)人職(zhi)責過程(cheng)(cheng)(cheng)中(zhong),自(zi)覺(jue)按程(cheng)(cheng)(cheng)序辦(ban)(ban)事(shi),嚴格(ge)遵(zun)守公司法(fa)(fa)、企業(ye)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)法(fa)(fa)和(he)(he)公司章程(cheng)(cheng)(cheng)有(you)(you)關(guan)公司治理(li)結(jie)(jie)構和(he)(he)議事(shi)規(gui)(gui)則的(de)(de)各(ge)(ge)(ge)項規(gui)(gui)定,認真(zhen)執行(xing)(xing)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)工(gong)(gong)作(zuo)規(gui)(gui)程(cheng)(cheng)(cheng)。四(si)要(yao)深入開展(zhan)(zhan)“六(liu)五(wu)(wu)”普(pu)法(fa)(fa)工(gong)(gong)作(zuo)。根據全國(guo)(guo)(guo)(guo)(guo)(guo)(guo)普(pu)法(fa)(fa)辦(ban)(ban)“六(liu)五(wu)(wu)”普(pu)法(fa)(fa)規(gui)(gui)劃和(he)(he)即將印(yin)發的(de)(de)《國(guo)(guo)(guo)(guo)(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)關(guan)于(yu)在國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)系統開展(zhan)(zhan)法(fa)(fa)制(zhi)宣傳教育(yu)的(de)(de)第六(liu)個五(wu)(wu)年(nian)規(gui)(gui)劃》,進(jin)一(yi)步提(ti)高國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)系統廣大干(gan)部職(zhi)工(gong)(gong)特別(bie)是領(ling)導干(gan)部的(de)(de)法(fa)(fa)律意識(shi),大力(li)(li)推(tui)進(jin)機(ji)關(guan)合(he)(he)(he)規(gui)(gui)文化(hua)建(jian)(jian)(jian)設,自(zi)覺(jue)防范(fan)好各(ge)(ge)(ge)級國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)行(xing)(xing)權(quan)履責中(zhong)的(de)(de)法(fa)(fa)律風險(xian)。

  (二)關于加快落實地(di)方國有重點企(qi)業法制工作三(san)年目標(biao)。

  按照地(di)方國(guo)(guo)有重點企(qi)業法(fa)制工作第二個(ge)三年目(mu)標(biao)要求,在(zai)今年年底前,省(sheng)屬(shu)國(guo)(guo)有重點企(qi)業要全(quan)部設立(li)(li)法(fa)律事(shi)務機構(gou),70%以上的(de)企(qi)業要建立(li)(li)總(zong)(zong)法(fa)律顧問制度。據初步統計,截止到(dao)今年5月底,928戶(hu)省(sheng)屬(shu)國(guo)(guo)有重點企(qi)業中,有782戶(hu)建立(li)(li)了法(fa)律事(shi)務機構(gou),占84%;419戶(hu)建立(li)(li)了總(zong)(zong)法(fa)律顧問制度,占45%。總(zong)(zong)體(ti)上看,這一(yi)進展與目(mu)標(biao)要求相比(bi)還(huan)有不小差距,特(te)別是有6個(ge)省(sheng)國(guo)(guo)資委(wei)所監(jian)管企(qi)業,至今未有一(yi)戶(hu)設立(li)(li)總(zong)(zong)法(fa)律顧問,應當引起我們的(de)高度重視。

  目(mu)(mu)前,距(ju)離三(san)(san)(san)年(nian)(nian)目(mu)(mu)標(biao)(biao)結束僅剩半年(nian)(nian)時(shi)(shi)間(jian),各地(di)國(guo)(guo)資(zi)(zi)(zi)委要(yao)進一步增(zeng)強緊迫感,采(cai)取有(you)力(li)措(cuo)施盡快完成任務(wu)。一要(yao)切實(shi)落實(shi)工(gong)作責任,加(jia)大(da)推(tui)(tui)進力(li)度。尤(you)其是進展較慢的(de)省市,國(guo)(guo)資(zi)(zi)(zi)委領導(dao)(dao)要(yao)親自(zi)抓(zhua),法(fa)規(gui)處(chu)室要(yao)切實(shi)履行(xing)(xing)職責,要(yao)會(hui)同干部管理處(chu)室在摸清具(ju)體情況(kuang)和(he)原因的(de)基礎上(shang)(shang),抓(zhua)緊進行(xing)(xing)專(zhuan)題研究,制定(ding)符合實(shi)際的(de)整改推(tui)(tui)進計劃(hua)。二要(yao)及時(shi)(shi)開(kai)展專(zhuan)項(xiang)督導(dao)(dao),有(you)效解決推(tui)(tui)進三(san)(san)(san)年(nian)(nian)目(mu)(mu)標(biao)(biao)的(de)短板。要(yao)針對(dui)所(suo)監(jian)管企(qi)(qi)業(ye)(ye)落實(shi)三(san)(san)(san)年(nian)(nian)目(mu)(mu)標(biao)(biao)的(de)薄弱環節(jie),擬定(ding)督導(dao)(dao)名單,由(you)國(guo)(guo)資(zi)(zi)(zi)委領導(dao)(dao)帶隊,通過(guo)與企(qi)(qi)業(ye)(ye)領導(dao)(dao)當面(mian)(mian)交換意見(jian)、幫助(zhu)總(zong)結分(fen)析(xi)典型(xing)案(an)例等形式,對(dui)重點企(qi)(qi)業(ye)(ye)逐(zhu)戶開(kai)展專(zhuan)項(xiang)督導(dao)(dao)。三(san)(san)(san)要(yao)注(zhu)意抓(zhua)好(hao)總(zong)法(fa)律顧問(wen)的(de)上(shang)(shang)崗到位(wei),突(tu)出(chu)推(tui)(tui)進三(san)(san)(san)年(nian)(nian)目(mu)(mu)標(biao)(biao)實(shi)現的(de)重點環節(jie)。對(dui)于暫(zan)時(shi)(shi)沒(mei)有(you)合適專(zhuan)職人(ren)選的(de)企(qi)(qi)業(ye)(ye),可(ke)以由(you)企(qi)(qi)業(ye)(ye)領導(dao)(dao)班(ban)子成員兼任,也可(ke)以面(mian)(mian)向(xiang)社會(hui)公開(kai)招聘。各地(di)還可(ke)以借(jie)鑒(jian)江西、河南(nan)、湖(hu)北(bei)等地(di)國(guo)(guo)資(zi)(zi)(zi)委的(de)做(zuo)法(fa),向(xiang)監(jian)管企(qi)(qi)業(ye)(ye)直(zhi)接委派總(zong)法(fa)律顧問(wen)。四要(yao)認真組織檢(jian)查(cha)(cha)驗(yan)收(shou),確保三(san)(san)(san)年(nian)(nian)目(mu)(mu)標(biao)(biao)的(de)實(shi)現不走過(guo)場。各地(di)要(yao)按照目(mu)(mu)標(biao)(biao)要(yao)求的(de)基本內容,借(jie)鑒(jian)國(guo)(guo)務(wu)院(yuan)國(guo)(guo)資(zi)(zi)(zi)委檢(jian)查(cha)(cha)驗(yan)收(shou)中央(yang)企(qi)(qi)業(ye)(ye)的(de)做(zuo)法(fa),具(ju)體細化檢(jian)查(cha)(cha)驗(yan)收(shou)標(biao)(biao)準(zhun),在今年(nian)(nian)年(nian)(nian)底前后(hou),通過(guo)自(zi)查(cha)(cha)、互查(cha)(cha)、抽查(cha)(cha)相結合的(de)方式,全(quan)面(mian)(mian)檢(jian)查(cha)(cha)本地(di)區國(guo)(guo)有(you)重點企(qi)(qi)業(ye)(ye)三(san)(san)(san)年(nian)(nian)目(mu)(mu)標(biao)(biao)的(de)完成情況(kuang),注(zhu)意總(zong)結先(xian)進典型(xing),著(zhu)力(li)解決突(tu)出(chu)困難和(he)問(wen)題,檢(jian)查(cha)(cha)結果要(yao)以適當形式進行(xing)(xing)通報。

  同(tong)志(zhi)們,“十二(er)五”時期指導監督(du)地方國(guo)資工作(zuo)任務艱巨,責任重大,舞臺廣闊(kuo)。我(wo)們要緊(jin)(jin)緊(jin)(jin)圍繞“兩新目標”,以更(geng)加奮發有(you)為(wei)的精神狀態(tai),更(geng)加扎實過(guo)硬的工作(zuo)作(zuo)風(feng),積(ji)極探索推(tui)動(dong),努力開創指導監督(du)工作(zuo)新局面,為(wei)加快完(wan)善國(guo)有(you)資產監管體制和制度、促(cu)進國(guo)有(you)企業又好又快發展作(zuo)出新貢(gong)獻!
