國務院國資委印發《中央企業工資總額管理辦法》

國務院國資委(wei)近(jin)日(ri)印發(fa)《中(zhong)央(yang)企業工(gong)資總額(e)管(guan)理(li)辦法》(國資委(wei)令第39號,以下簡稱《辦法》)。

《辦(ban)法》以(yi)習近平新時(shi)代中(zhong)國(guo)(guo)(guo)特色社會主(zhu)義思想(xiang)為(wei)指引,以(yi)建立健全與勞(lao)動(dong)力(li)市場基本適應、與企業經(jing)濟效益(yi)和勞(lao)動(dong)生產率掛鉤(gou)的工(gong)資決定和正常增長機制,增強(qiang)企業活力(li)和動(dong)力(li),促進(jin)企業實現(xian)高質量(liang)發展(zhan),推動(dong)國(guo)(guo)(guo)有資本做(zuo)(zuo)(zuo)強(qiang)做(zuo)(zuo)(zuo)優做(zuo)(zuo)(zuo)大為(wei)目標,以(yi)出資人管資本為(wei)主(zhu)強(qiang)化激(ji)勵約(yue)束建設為(wei)遵循,按(an)照《國(guo)(guo)(guo)務院(yuan)關(guan)于改革國(guo)(guo)(guo)有企業工(gong)資決定機制的意見》(國(guo)(guo)(guo)發〔2018〕16號,以(yi)下簡稱《意見》)精神,在繼承(cheng)以(yi)往有效經(jing)驗和做(zuo)(zuo)(zuo)法的基礎(chu)上,對(dui)現(xian)行中(zhong)央(yang)企業工(gong)資總額管理相關(guan)制度辦(ban)法進(jin)行修改和完(wan)善(shan)。

《辦法》明確對中央企(qi)業(ye)工(gong)資(zi)(zi)總(zong)額(e)實行分類管(guan)理。對主(zhu)業(ye)處于充分競爭(zheng)行業(ye)和(he)領域(yu)的(de)(de)商業(ye)類中央企(qi)業(ye)工(gong)資(zi)(zi)總(zong)額(e)預(yu)(yu)(yu)算(suan)原則上全(quan)部實行備案制(zhi)管(guan)理,由企(qi)業(ye)董(dong)事(shi)會在依(yi)法依(yi)規的(de)(de)前(qian)提下,自主(zhu)決定年度(du)工(gong)資(zi)(zi)總(zong)額(e)預(yu)(yu)(yu)算(suan),國資(zi)(zi)委由事(shi)前(qian)核(he)準(zhun)轉變(bian)為事(shi)前(qian)引(yin)導(dao)、事(shi)中監測(ce)和(he)事(shi)后監督;對主(zhu)業(ye)處于關系國家安全(quan)、國民經濟命脈的(de)(de)重要(yao)行業(ye)和(he)關鍵(jian)領域(yu)、主(zhu)要(yao)承擔(dan)重大專項任務的(de)(de)商業(ye)類中央企(qi)業(ye)和(he)以(yi)提供公共產品或服務為主(zhu)的(de)(de)公益(yi)類中央企(qi)業(ye),工(gong)資(zi)(zi)總(zong)額(e)預(yu)(yu)(yu)算(suan)繼(ji)續實行核(he)準(zhun)制(zhi)管(guan)理;對開展國有(you)資(zi)(zi)本投(tou)資(zi)(zi)、運營公司或者混合所有(you)制(zhi)改革等(deng)試點的(de)(de)中央企(qi)業(ye),提出可(ke)以(yi)探(tan)索實行更加靈(ling)活高效的(de)(de)工(gong)資(zi)(zi)總(zong)額(e)管(guan)理方式。

《辦法》明確對中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)(ye)工(gong)資總額(e)實行分(fen)級管(guan)理(li)。按照《中(zhong)(zhong)共中(zhong)(zhong)央(yang)(yang) 國(guo)(guo)(guo)務院(yuan)關(guan)(guan)于(yu)深化(hua)國(guo)(guo)(guo)有企業(ye)(ye)(ye)(ye)改革的(de)(de)指導意見》(中(zhong)(zhong)發〔2015〕22號(hao),以(yi)下簡稱中(zhong)(zhong)發22號(hao)文件)、《國(guo)(guo)(guo)務院(yuan)辦公廳關(guan)(guan)于(yu)轉發國(guo)(guo)(guo)務院(yuan)國(guo)(guo)(guo)資委(wei)以(yi)管(guan)資本為主(zhu)(zhu)推進(jin)職(zhi)能轉變方(fang)案(an)的(de)(de)通知(zhi)》(國(guo)(guo)(guo)辦發〔2017〕38號(hao))要(yao)求,結(jie)合當前(qian)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)(ye)工(gong)資總額(e)管(guan)理(li)實際,強(qiang)調中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)(ye)工(gong)資總額(e)實行分(fen)級管(guan)理(li)體制,國(guo)(guo)(guo)資委(wei)與(yu)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)(ye)權責清晰、各司其職(zhi),國(guo)(guo)(guo)資委(wei)負責管(guan)制度、管(guan)總量、管(guan)監(jian)督,中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)(ye)負責管(guan)內(nei)部自主(zhu)(zhu)分(fen)配、管(guan)預(yu)算分(fen)解(jie)落實、管(guan)具體操作(zuo)執行。

《辦(ban)法》緊緊圍繞中(zhong)(zhong)發(fa)(fa)22號文件和(he)(he)《意見》關于“建(jian)立健全與(yu)(yu)勞(lao)動力市場(chang)基本(ben)適應、與(yu)(yu)企業(ye)(ye)(ye)(ye)(ye)經濟效(xiao)益和(he)(he)勞(lao)動生(sheng)產率(lv)掛(gua)鉤(gou)的(de)(de)(de)工(gong)(gong)(gong)資(zi)(zi)決(jue)定(ding)和(he)(he)正常增長(chang)機制”的(de)(de)(de)要求,明確(que)(que)(que)規定(ding)中(zhong)(zhong)央(yang)企業(ye)(ye)(ye)(ye)(ye)工(gong)(gong)(gong)資(zi)(zi)總額(e)預算(suan)主要按照效(xiao)益決(jue)定(ding)、效(xiao)率(lv)調(diao)整、水平(ping)調(diao)控三(san)個環節決(jue)定(ding)。一(yi)是(shi)(shi)中(zhong)(zhong)央(yang)企業(ye)(ye)(ye)(ye)(ye)工(gong)(gong)(gong)資(zi)(zi)總額(e)預算(suan)與(yu)(yu)利潤總額(e)等經濟效(xiao)益指標(biao)(biao)的(de)(de)(de)業(ye)(ye)(ye)(ye)(ye)績考(kao)核(he)目(mu)標(biao)(biao)值掛(gua)鉤(gou),并且根(gen)據目(mu)標(biao)(biao)值的(de)(de)(de)先(xian)進程度(du)確(que)(que)(que)定(ding)不同(tong)(tong)的(de)(de)(de)預算(suan)水平(ping),引導中(zhong)(zhong)央(yang)企業(ye)(ye)(ye)(ye)(ye)通(tong)過(guo)完成高質(zhi)量發(fa)(fa)展目(mu)標(biao)(biao),帶動職(zhi)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)總額(e)合理有序(xu)(xu)增長(chang)。二(er)是(shi)(shi)工(gong)(gong)(gong)資(zi)(zi)增長(chang)還應當通(tong)過(guo)人工(gong)(gong)(gong)成本(ben)投入(ru)產出效(xiao)率(lv)、勞(lao)動生(sheng)產率(lv)等指標(biao)(biao)對(dui)(dui)(dui)標(biao)(biao)進行調(diao)整,進一(yi)步協調(diao)不同(tong)(tong)效(xiao)率(lv)的(de)(de)(de)企業(ye)(ye)(ye)(ye)(ye)之間工(gong)(gong)(gong)資(zi)(zi)分(fen)配(pei)關系,提(ti)高企業(ye)(ye)(ye)(ye)(ye)工(gong)(gong)(gong)資(zi)(zi)總額(e)決(jue)定(ding)機制的(de)(de)(de)科學性(xing)與(yu)(yu)有效(xiao)性(xing)。三(san)是(shi)(shi)注重(zhong)收(shou)入(ru)分(fen)配(pei)公(gong)平(ping),國資(zi)(zi)委將按照國家有關部門發(fa)(fa)布(bu)的(de)(de)(de)工(gong)(gong)(gong)資(zi)(zi)指導線和(he)(he)對(dui)(dui)(dui)非(fei)競爭類(lei)國有企業(ye)(ye)(ye)(ye)(ye)的(de)(de)(de)工(gong)(gong)(gong)資(zi)(zi)調(diao)控要求,對(dui)(dui)(dui)部分(fen)工(gong)(gong)(gong)資(zi)(zi)水平(ping)偏高、過(guo)高的(de)(de)(de)行業(ye)(ye)(ye)(ye)(ye)與(yu)(yu)企業(ye)(ye)(ye)(ye)(ye),尤其是(shi)(shi)主業(ye)(ye)(ye)(ye)(ye)不屬于充分(fen)競爭行業(ye)(ye)(ye)(ye)(ye)和(he)(he)領域的(de)(de)(de)企業(ye)(ye)(ye)(ye)(ye)工(gong)(gong)(gong)資(zi)(zi)增長(chang)過(guo)快的(de)(de)(de)情況(kuang)進行適當約束,確(que)(que)(que)保(bao)企業(ye)(ye)(ye)(ye)(ye)職(zhi)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)(de)水平(ping)與(yu)(yu)增長(chang)幅(fu)度(du)更加公(gong)平(ping)合理、規范有序(xu)(xu)。同(tong)(tong)時,對(dui)(dui)(dui)中(zhong)(zhong)央(yang)企業(ye)(ye)(ye)(ye)(ye)承擔重(zhong)大專項(xiang)任務、重(zhong)大科技(ji)創新項(xiang)目(mu)等特殊事項(xiang)的(de)(de)(de),《辦(ban)法》也明確(que)(que)(que)將予以(yi)適度(du)支持。

《辦(ban)法》在(zai)從宏(hong)觀層面完善國家、企(qi)(qi)(qi)業(ye)和(he)(he)職工(gong)三(san)者工(gong)資(zi)分配關(guan)系,加大出資(zi)人向中央企(qi)(qi)(qi)業(ye)董事會(hui)授權的同時,也同步對(dui)責(ze)(ze)任落實(shi)和(he)(he)制(zhi)度(du)配套進行了規定(ding)。一(yi)是強(qiang)調企(qi)(qi)(qi)業(ye)作(zuo)為內(nei)部分配的責(ze)(ze)任主(zhu)體,應當(dang)持(chi)續深化內(nei)部三(san)項制(zhi)度(du)改革,構(gou)建(jian)企(qi)(qi)(qi)業(ye)內(nei)部管(guan)理人員能上能下、員工(gong)能進能出、收(shou)入(ru)能增能減的市場化勞動用工(gong)和(he)(he)收(shou)入(ru)分配管(guan)理機制(zhi),切實(shi)承擔起(qi)搞好、搞活企(qi)(qi)(qi)業(ye)內(nei)部分配的職責(ze)(ze)。二是加強(qiang)監督檢查,明(ming)確界定(ding)企(qi)(qi)(qi)業(ye)違(wei)規責(ze)(ze)任,并(bing)將(jiang)企(qi)(qi)(qi)業(ye)工(gong)資(zi)總額管(guan)理情況納入(ru)各項監督檢查范圍,與審計、巡視等工(gong)作(zuo)形(xing)成合力,確保實(shi)現權責(ze)(ze)對(dui)等,監管(guan)到位。
