《國(guo)(guo)(guo)務(wu)院辦公廳關(guan)于(yu)(yu)建(jian)(jian)立(li)(li)國(guo)(guo)(guo)有企業違(wei)規(gui)(gui)經(jing)(jing)營投(tou)資(zi)責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)制度(du)的(de)意見》(國(guo)(guo)(guo)辦發(fa)〔2016〕63號,以下(xia)簡稱63號文(wen)件)要求在2020年(nian)(nian)年(nian)(nian)底前,全(quan)面建(jian)(jian)立(li)(li)覆蓋各級履行出(chu)資(zi)人職(zhi)(zhi)責(ze)的(de)機(ji)(ji)構及國(guo)(guo)(guo)有企業的(de)責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)(zuo)體(ti)系(xi),形成(cheng)職(zhi)(zhi)責(ze)明確(que)、流(liu)程清晰、規(gui)(gui)范有序的(de)責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)(zuo)機(ji)(ji)制。各地國(guo)(guo)(guo)資(zi)委(wei)高(gao)度(du)重視,積極推進(jin)違(wei)規(gui)(gui)經(jing)(jing)營投(tou)資(zi)責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)制度(du)機(ji)(ji)制和組(zu)織(zhi)體(ti)系(xi)建(jian)(jian)設(she)(she),35個地方(含計(ji)劃單列市和新疆生產(chan)建(jian)(jian)設(she)(she)兵(bing)團)出(chu)臺了違(wei)規(gui)(gui)經(jing)(jing)營投(tou)資(zi)責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)制度(du),設(she)(she)立(li)(li)或(huo)明確(que)了專門(men)部門(men)承擔責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)職(zhi)(zhi)責(ze),實現了責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)(zuo)有序平(ping)穩起步,為(wei)推動企業高(gao)質量發(fa)展發(fa)揮了積極作(zuo)(zuo)用。但由于(yu)(yu)責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)(zuo)政策性強、涉及面廣,工(gong)作(zuo)(zuo)處于(yu)(yu)探索(suo)階(jie)段,仍存在對(dui)違(wei)規(gui)(gui)責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)重要性認識不(bu)到位,體(ti)系(xi)建(jian)(jian)設(she)(she)工(gong)作(zuo)(zuo)相對(dui)滯后,保障機(ji)(ji)制還比較薄弱(ruo)等(deng)問題。為(wei)進(jin)一步推動各級履行出(chu)資(zi)人職(zhi)(zhi)責(ze)的(de)機(ji)(ji)構及國(guo)(guo)(guo)有企業責(ze)任(ren)追(zhui)(zhui)究(jiu)(jiu)(jiu)(jiu)工(gong)作(zuo)(zuo)體(ti)系(xi)建(jian)(jian)設(she)(she),按(an)期完(wan)成(cheng)2020年(nian)(nian)年(nian)(nian)底工(gong)作(zuo)(zuo)目標,現將(jiang)有關(guan)事項通(tong)知如下(xia):
一、提高政治站位,深化對責任追究工作重要性的認識。黨中(zhong)(zhong)央(yang)、國(guo)(guo)(guo)務院高度重(zhong)視(shi)強化(hua)國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)監管、落實國(guo)(guo)(guo)有(you)企業(ye)(ye)經營投(tou)資(zi)(zi)(zi)責任(ren)(ren),黨的(de)(de)十(shi)八屆(jie)三中(zhong)(zhong)全會(hui)以(yi)及(ji)國(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)企改革系列文件對強化(hua)經營投(tou)資(zi)(zi)(zi)責任(ren)(ren)追(zhui)究,建立(li)健全國(guo)(guo)(guo)有(you)企業(ye)(ye)重(zhong)大決(jue)策失誤(wu)和(he)失職(zhi)、瀆職(zhi)責任(ren)(ren)追(zhui)究倒查(cha)機制等提(ti)出(chu)了明(ming)確要求。各(ge)地國(guo)(guo)(guo)資(zi)(zi)(zi)委要站(zhan)在守護好全體人民(min)共同(tong)財富的(de)(de)高度,深(shen)刻理解(jie)責任(ren)(ren)追(zhui)究工(gong)作(zuo)(zuo)在有(you)效(xiao)防止國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)流(liu)失、落實國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)保(bao)值增值責任(ren)(ren)方面的(de)(de)重(zhong)要作(zuo)(zuo)用,將推進責任(ren)(ren)追(zhui)究工(gong)作(zuo)(zuo)體系建設(she)作(zuo)(zuo)為提(ti)升(sheng)國(guo)(guo)(guo)有(you)企業(ye)(ye)合規經營水(shui)(shui)平(ping)和(he)防范化(hua)解(jie)重(zhong)大風險的(de)(de)重(zhong)要抓手,通過(guo)有(you)效(xiao)開展責任(ren)(ren)追(zhui)究工(gong)作(zuo)(zuo),促(cu)進各(ge)級經營管理人員規范履職(zhi)、勤勉盡責,推動企業(ye)(ye)提(ti)升(sheng)合規經營管理水(shui)(shui)平(ping)。
二、持續完善責任追究制度體系,實現制度全面覆蓋和有效約束。各地國資(zi)委要(yao)(yao)加快構(gou)建(jian)內容協調、流程清(qing)晰、配套完(wan)備(bei)、有(you)(you)效管用的責(ze)(ze)任追(zhui)究(jiu)制(zhi)度體系。要(yao)(yao)根(gen)據地區具體情況、企業(ye)規(gui)模體量差異、業(ye)務模式特點等,制(zhi)定(ding)履行出資(zi)人(ren)職責(ze)(ze)的機構(gou)及國有(you)(you)企業(ye)違(wei)規(gui)經(jing)營投資(zi)責(ze)(ze)任追(zhui)究(jiu)制(zhi)度,細(xi)化各類經(jing)營投資(zi)責(ze)(ze)任條款和清(qing)單,明確(que)責(ze)(ze)任追(zhui)究(jiu)范圍、劃(hua)分資(zi)產損失(shi)(shi)標(biao)準,規(gui)范責(ze)(ze)任追(zhui)究(jiu)工(gong)作(zuo)(zuo)(zuo)流程,研究(jiu)制(zhi)定(ding)損失(shi)(shi)認定(ding)、責(ze)(ze)任認定(ding)等實(shi)施細(xi)則,實(shi)現責(ze)(ze)任追(zhui)究(jiu)工(gong)作(zuo)(zuo)(zuo)標(biao)準一致(zhi)、有(you)(you)章(zhang)可循、規(gui)范有(you)(you)序。2019年(nian)(nian)年(nian)(nian)底前,要(yao)(yao)確(que)保實(shi)現省級違(wei)規(gui)經(jing)營投資(zi)責(ze)(ze)任追(zhui)究(jiu)制(zhi)度全(quan)覆蓋(gai)。2020年(nian)(nian)6月底前,要(yao)(yao)實(shi)現各級國有(you)(you)資(zi)產監督管理機構(gou)及國有(you)(you)企業(ye)責(ze)(ze)任追(zhui)究(jiu)制(zhi)度全(quan)覆蓋(gai),同(tong)時做好制(zhi)度備(bei)案工(gong)作(zuo)(zuo)(zuo)。
三、加快推進組織體系建設,完善追責工作運行機制。各(ge)地國資(zi)委要健(jian)全(quan)責(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究組(zu)織體(ti)系(xi),嚴格(ge)落實責(ze)(ze)(ze)(ze)任(ren)(ren),層層傳導壓(ya)力,持(chi)續深入推進(jin)(jin)責(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)。要根據地方(fang)機構改(gai)革總體(ti)安排,科學設立或明確具體(ti)部門承擔責(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)。同(tong)時結合(he)地方(fang)和企業(ye)(ye)實際、行業(ye)(ye)特點等,推進(jin)(jin)責(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)組(zu)織體(ti)系(xi)建(jian)設,壓(ya)實責(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究主體(ti)責(ze)(ze)(ze)(ze)任(ren)(ren),實現監(jian)督(du)追(zhui)(zhui)責(ze)(ze)(ze)(ze)組(zu)織體(ti)系(xi)全(quan)覆蓋。各(ge)地國資(zi)委和所監(jian)管國有(you)(you)企業(ye)(ye)要配齊(qi)配強(qiang)配優工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)隊(dui)伍(wu),提升工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)人(ren)員專(zhuan)業(ye)(ye)能(neng)力,提供(gong)必(bi)要的保障條件(jian),確保工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)有(you)(you)效開展。要完善聯(lian)合(he)實施、協同(tong)聯(lian)動的工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)機制,加強(qiang)與紀檢監(jian)察(cha)、巡(xun)視、審計、人(ren)力資(zi)源(yuan)等部門的協同(tong)配合(he)。要努力提升工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)信息(xi)化水平,推進(jin)(jin)信息(xi)系(xi)統建(jian)設,力爭實現損失(shi)風險動態(tai)監(jian)測和責(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)全(quan)流程信息(xi)管理。2020年(nian)年(nian)底前形成職責(ze)(ze)(ze)(ze)明確、流程清晰(xi)、規范有(you)(you)序的責(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)機制。
四、堅持分級組織分類處理,扎實做好違規責任追究工作。各地國(guo)資(zi)委要(yao)(yao)按照國(guo)有資(zi)本出資(zi)關(guan)系和干(gan)部(bu)管理(li)權限,界定(ding)(ding)責(ze)(ze)任追(zhui)究(jiu)工作職責(ze)(ze),分級組織開展責(ze)(ze)任追(zhui)究(jiu)工作。要(yao)(yao)堅持違規必究(jiu),追(zhui)責(ze)(ze)必嚴,切實增強國(guo)資(zi)監管法(fa)規制度和企業內部(bu)管理(li)規定(ding)(ding)剛性約(yue)束。要(yao)(yao)強化對違規經(jing)營投資(zi)責(ze)(ze)任追(zhui)究(jiu)定(ding)(ding)性、定(ding)(ding)損、定(ding)(ding)責(ze)(ze)等關(guan)鍵環節的指導把關(guan)和監督檢查(cha),積極探(tan)索有效的工作方式(shi)方法(fa)。要(yao)(yao)加強案例通報,在適當(dang)范圍總(zong)結、通報及公開違規經(jing)營投資(zi)責(ze)(ze)任追(zhui)究(jiu)處理(li)情況,以案為鑒(jian),發揮“追(zhui)責(ze)(ze)一(yi)個、警示一(yi)片”的警示教(jiao)育(yu)作用。
五、堅持糾建并舉,健全以追責促發展的長效機制。責(ze)任追(zhui)(zhui)究(jiu)是(shi)手段(duan)不是(shi)目的(de),各地國(guo)資委(wei)與所(suo)監(jian)管國(guo)有(you)企(qi)(qi)業(ye)(ye)(ye)都要注重(zhong)做好監(jian)督(du)追(zhui)(zhui)責(ze)“后(hou)半篇文章”,把追(zhui)(zhui)責(ze)成果(guo)轉化為促(cu)(cu)進(jin)企(qi)(qi)業(ye)(ye)(ye)健(jian)康發展的(de)監(jian)管效能。要以(yi)追(zhui)(zhui)責(ze)促(cu)(cu)追(zhui)(zhui)損,及時化解(jie)資產損失(shi)風險,防(fang)止國(guo)有(you)資產流失(shi)。要舉一(yi)反三,以(yi)點帶面,深(shen)入開展共性問題(ti)核查,排查問題(ti)隱患,預(yu)警提示經(jing)營風險。要以(yi)責(ze)任追(zhui)(zhui)究(jiu)為重(zhong)要抓手,通過(guo)懲治教育(yu)和(he)制度建設(she)相(xiang)結合,強化國(guo)有(you)企(qi)(qi)業(ye)(ye)(ye)各級(ji)經(jing)營管理人員合規履(lv)職的(de)自覺性和(he)主動性,全面推進(jin)依法治企(qi)(qi),有(you)效促(cu)(cu)進(jin)企(qi)(qi)業(ye)(ye)(ye)穩(wen)健(jian)經(jing)營和(he)可持(chi)續發展。
各省級國資委要(yao)按照目標要(yao)求,細化任務(wu)舉措,扎實推進各項工作(zuo),請于(yu)2020年(nian)6月30日(ri)前書面報(bao)告階段性進展情況(kuang)(kuang),于(yu)2020年(nian)12月底前報(bao)送63號文件目標任務(wu)完成情況(kuang)(kuang)。
