國(guo)務院國(guo)資委近日印發(fa)《中央企業工資總額管理辦法》(國(guo)資委令第(di)39號,以下簡稱(cheng)《辦法》)。
《辦(ban)法》以習近平新時代中國(guo)特色社會主(zhu)義思想為(wei)指引,以建立(li)健(jian)全與勞動(dong)力(li)(li)市場(chang)基(ji)(ji)本(ben)適應(ying)、與企(qi)業經(jing)濟效益和(he)(he)勞動(dong)生產率掛(gua)鉤的工(gong)資(zi)決定和(he)(he)正常(chang)增(zeng)長機制(zhi),增(zeng)強企(qi)業活力(li)(li)和(he)(he)動(dong)力(li)(li),促進企(qi)業實現高質量(liang)發展(zhan),推(tui)動(dong)國(guo)有(you)(you)資(zi)本(ben)做(zuo)強做(zuo)優做(zuo)大為(wei)目(mu)標,以出(chu)資(zi)人管資(zi)本(ben)為(wei)主(zhu)強化激勵(li)約束建設(she)為(wei)遵循,按(an)照《國(guo)務院關于改革國(guo)有(you)(you)企(qi)業工(gong)資(zi)決定機制(zhi)的意(yi)(yi)見》(國(guo)發〔2018〕16號,以下(xia)簡稱《意(yi)(yi)見》)精神,在繼承以往有(you)(you)效經(jing)驗和(he)(he)做(zuo)法的基(ji)(ji)礎(chu)上,對現行中央企(qi)業工(gong)資(zi)總額(e)管理相關制(zhi)度辦(ban)法進行修改和(he)(he)完善(shan)。
《辦法(fa)》明(ming)確對(dui)中(zhong)央(yang)企(qi)(qi)(qi)業(ye)(ye)工(gong)資(zi)(zi)總(zong)(zong)額(e)實(shi)(shi)(shi)行(xing)(xing)(xing)(xing)(xing)分(fen)類(lei)管(guan)(guan)理(li)。對(dui)主(zhu)業(ye)(ye)處(chu)于充分(fen)競爭行(xing)(xing)(xing)(xing)(xing)業(ye)(ye)和(he)領域的(de)商業(ye)(ye)類(lei)中(zhong)央(yang)企(qi)(qi)(qi)業(ye)(ye)工(gong)資(zi)(zi)總(zong)(zong)額(e)預(yu)算原則上全部實(shi)(shi)(shi)行(xing)(xing)(xing)(xing)(xing)備案(an)制管(guan)(guan)理(li),由(you)(you)企(qi)(qi)(qi)業(ye)(ye)董事會在依法(fa)依規的(de)前提(ti)(ti)下,自主(zhu)決(jue)定年度(du)工(gong)資(zi)(zi)總(zong)(zong)額(e)預(yu)算,國(guo)資(zi)(zi)委(wei)由(you)(you)事前核(he)(he)準轉變為事前引(yin)導、事中(zhong)監(jian)測(ce)和(he)事后監(jian)督;對(dui)主(zhu)業(ye)(ye)處(chu)于關系國(guo)家安全、國(guo)民(min)經濟命(ming)脈(mo)的(de)重要行(xing)(xing)(xing)(xing)(xing)業(ye)(ye)和(he)關鍵領域、主(zhu)要承(cheng)擔(dan)重大(da)專(zhuan)項(xiang)任(ren)務的(de)商業(ye)(ye)類(lei)中(zhong)央(yang)企(qi)(qi)(qi)業(ye)(ye)和(he)以提(ti)(ti)供公(gong)共產(chan)品(pin)或服務為主(zhu)的(de)公(gong)益類(lei)中(zhong)央(yang)企(qi)(qi)(qi)業(ye)(ye),工(gong)資(zi)(zi)總(zong)(zong)額(e)預(yu)算繼續實(shi)(shi)(shi)行(xing)(xing)(xing)(xing)(xing)核(he)(he)準制管(guan)(guan)理(li);對(dui)開(kai)展國(guo)有(you)(you)資(zi)(zi)本投資(zi)(zi)、運營公(gong)司或者混合所有(you)(you)制改革等試點(dian)的(de)中(zhong)央(yang)企(qi)(qi)(qi)業(ye)(ye),提(ti)(ti)出可以探索實(shi)(shi)(shi)行(xing)(xing)(xing)(xing)(xing)更(geng)加(jia)靈(ling)活高(gao)效的(de)工(gong)資(zi)(zi)總(zong)(zong)額(e)管(guan)(guan)理(li)方式。
《辦法(fa)》明確對中(zhong)(zhong)央(yang)(yang)企(qi)(qi)業(ye)工(gong)資(zi)(zi)總(zong)(zong)額實(shi)(shi)行分級(ji)管(guan)(guan)(guan)理。按照(zhao)《中(zhong)(zhong)共中(zhong)(zhong)央(yang)(yang) 國(guo)務院(yuan)關(guan)于(yu)深化國(guo)有企(qi)(qi)業(ye)改革的指(zhi)導意見》(中(zhong)(zhong)發〔2015〕22號,以(yi)下簡稱中(zhong)(zhong)發22號文(wen)件)、《國(guo)務院(yuan)辦公廳關(guan)于(yu)轉發國(guo)務院(yuan)國(guo)資(zi)(zi)委以(yi)管(guan)(guan)(guan)資(zi)(zi)本為(wei)主推進(jin)職能轉變方案的通(tong)知》(國(guo)辦發〔2017〕38號)要求,結(jie)合當前中(zhong)(zhong)央(yang)(yang)企(qi)(qi)業(ye)工(gong)資(zi)(zi)總(zong)(zong)額管(guan)(guan)(guan)理實(shi)(shi)際,強調(diao)中(zhong)(zhong)央(yang)(yang)企(qi)(qi)業(ye)工(gong)資(zi)(zi)總(zong)(zong)額實(shi)(shi)行分級(ji)管(guan)(guan)(guan)理體制,國(guo)資(zi)(zi)委與中(zhong)(zhong)央(yang)(yang)企(qi)(qi)業(ye)權責(ze)清(qing)晰、各司其職,國(guo)資(zi)(zi)委負責(ze)管(guan)(guan)(guan)制度(du)、管(guan)(guan)(guan)總(zong)(zong)量(liang)、管(guan)(guan)(guan)監督(du),中(zhong)(zhong)央(yang)(yang)企(qi)(qi)業(ye)負責(ze)管(guan)(guan)(guan)內(nei)部自主分配(pei)、管(guan)(guan)(guan)預算分解落實(shi)(shi)、管(guan)(guan)(guan)具體操作執行。
《辦(ban)法(fa)》緊緊圍繞中(zhong)(zhong)發(fa)22號文(wen)件和(he)《意(yi)見(jian)》關(guan)于(yu)“建立健全與(yu)勞(lao)動力市場基本(ben)適(shi)應、與(yu)企(qi)業(ye)(ye)經濟效(xiao)(xiao)益(yi)和(he)勞(lao)動生(sheng)產率(lv)(lv)(lv)掛(gua)鉤的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)決(jue)(jue)(jue)定(ding)和(he)正常(chang)增長(chang)(chang)機制”的(de)(de)(de)要求(qiu),明確規(gui)定(ding)中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)總額(e)(e)預算(suan)(suan)主(zhu)要按照效(xiao)(xiao)益(yi)決(jue)(jue)(jue)定(ding)、效(xiao)(xiao)率(lv)(lv)(lv)調(diao)整、水平(ping)(ping)調(diao)控(kong)三個環節決(jue)(jue)(jue)定(ding)。一是中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)總額(e)(e)預算(suan)(suan)與(yu)利潤(run)總額(e)(e)等(deng)經濟效(xiao)(xiao)益(yi)指標(biao)(biao)的(de)(de)(de)業(ye)(ye)績(ji)考核目標(biao)(biao)值(zhi)掛(gua)鉤,并且根據目標(biao)(biao)值(zhi)的(de)(de)(de)先進(jin)程度確定(ding)不(bu)(bu)同(tong)的(de)(de)(de)預算(suan)(suan)水平(ping)(ping),引導中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)通(tong)過(guo)(guo)完成(cheng)高(gao)(gao)質量發(fa)展目標(biao)(biao),帶(dai)動職工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)總額(e)(e)合理有(you)序增長(chang)(chang)。二是工(gong)(gong)資(zi)(zi)(zi)增長(chang)(chang)還應當通(tong)過(guo)(guo)人工(gong)(gong)成(cheng)本(ben)投入產出效(xiao)(xiao)率(lv)(lv)(lv)、勞(lao)動生(sheng)產率(lv)(lv)(lv)等(deng)指標(biao)(biao)對標(biao)(biao)進(jin)行調(diao)整,進(jin)一步協(xie)調(diao)不(bu)(bu)同(tong)效(xiao)(xiao)率(lv)(lv)(lv)的(de)(de)(de)企(qi)業(ye)(ye)之間工(gong)(gong)資(zi)(zi)(zi)分(fen)配(pei)(pei)關(guan)系,提高(gao)(gao)企(qi)業(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)總額(e)(e)決(jue)(jue)(jue)定(ding)機制的(de)(de)(de)科學性(xing)(xing)與(yu)有(you)效(xiao)(xiao)性(xing)(xing)。三是注(zhu)重收入分(fen)配(pei)(pei)公平(ping)(ping),國資(zi)(zi)(zi)委(wei)將(jiang)按照國家有(you)關(guan)部門發(fa)布(bu)的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)指導線和(he)對非競(jing)爭類國有(you)企(qi)業(ye)(ye)的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)調(diao)控(kong)要求(qiu),對部分(fen)工(gong)(gong)資(zi)(zi)(zi)水平(ping)(ping)偏高(gao)(gao)、過(guo)(guo)高(gao)(gao)的(de)(de)(de)行業(ye)(ye)與(yu)企(qi)業(ye)(ye),尤其是主(zhu)業(ye)(ye)不(bu)(bu)屬于(yu)充分(fen)競(jing)爭行業(ye)(ye)和(he)領域的(de)(de)(de)企(qi)業(ye)(ye)工(gong)(gong)資(zi)(zi)(zi)增長(chang)(chang)過(guo)(guo)快(kuai)的(de)(de)(de)情況進(jin)行適(shi)當約束(shu),確保企(qi)業(ye)(ye)職工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de)水平(ping)(ping)與(yu)增長(chang)(chang)幅度更加公平(ping)(ping)合理、規(gui)范(fan)有(you)序。同(tong)時,對中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)承擔重大專項任務(wu)、重大科技創新項目等(deng)特殊事(shi)項的(de)(de)(de),《辦(ban)法(fa)》也(ye)明確將(jiang)予以(yi)適(shi)度支持。
《辦法(fa)》在從宏觀(guan)層面完善國家、企(qi)業(ye)(ye)(ye)和職工三者工資分配(pei)關系,加大(da)出資人向中央企(qi)業(ye)(ye)(ye)董事會(hui)授權(quan)的同時,也同步對責(ze)任落(luo)實(shi)和制度(du)配(pei)套進行(xing)了規定。一(yi)是強(qiang)調(diao)企(qi)業(ye)(ye)(ye)作為(wei)內(nei)部(bu)分配(pei)的責(ze)任主體,應當(dang)持續(xu)深(shen)化內(nei)部(bu)三項制度(du)改革,構建企(qi)業(ye)(ye)(ye)內(nei)部(bu)管(guan)(guan)理人員能(neng)(neng)(neng)上能(neng)(neng)(neng)下、員工能(neng)(neng)(neng)進能(neng)(neng)(neng)出、收入能(neng)(neng)(neng)增能(neng)(neng)(neng)減(jian)的市(shi)場化勞動用工和收入分配(pei)管(guan)(guan)理機制,切實(shi)承擔起搞好、搞活企(qi)業(ye)(ye)(ye)內(nei)部(bu)分配(pei)的職責(ze)。二是加強(qiang)監(jian)督檢查,明確(que)界定企(qi)業(ye)(ye)(ye)違規責(ze)任,并將企(qi)業(ye)(ye)(ye)工資總額管(guan)(guan)理情況納(na)入各項監(jian)督檢查范圍,與審(shen)計、巡視等工作形成合力,確(que)保實(shi)現權(quan)責(ze)對等,監(jian)管(guan)(guan)到位。
