王勇:完善各類國有資產管理體制

  黨的十(shi)八大明確提出要(yao)“完善各(ge)類國(guo)有(you)資(zi)(zi)(zi)產管(guan)理(li)體(ti)制”,這既是對黨的十(shi)六大以來國(guo)有(you)資(zi)(zi)(zi)產管(guan)理(li)體(ti)制改革(ge)取得成效(xiao)的充分肯定,也是對進一步加強各(ge)類國(guo)有(you)資(zi)(zi)(zi)產監管(guan)作出的重要(yao)部署。我們要(yao)深刻領(ling)會和認真貫(guan)徹黨的十(shi)八大精(jing)神,牢(lao)牢(lao)把握正確的改革(ge)方向,以改革(ge)創新的精(jing)神不斷完善各(ge)類國(guo)有(you)資(zi)(zi)(zi)產管(guan)理(li)體(ti)制。


  一、深刻認識完善各類國有資產管理體制的重要意義


  我國國有(you)資產(chan)包括經(jing)(jing)(jing)營性(xing)(xing)國有(you)資產(chan)(含(han)國有(you)金(jin)融資產(chan))、行政(zheng)(zheng)事業性(xing)(xing)國有(you)資產(chan)、資源(yuan)性(xing)(xing)國有(you)資產(chan)。隨著(zhu)社(she)會主(zhu)義(yi)現代(dai)化建設(she)的(de)(de)(de)不斷(duan)推進,我國國有(you)資產(chan)規(gui)模不斷(duan)擴大、質(zhi)量不斷(duan)提高,在經(jing)(jing)(jing)濟(ji)社(she)會發展中發揮(hui)著(zhu)不可(ke)替代(dai)的(de)(de)(de)作用。完善(shan)各類(lei)國有(you)資產(chan)管理體制(zhi),就是(shi)要立(li)足我國國情(qing),針(zhen)對各類(lei)國有(you)資產(chan)的(de)(de)(de)屬性(xing)(xing)和(he)特點,建立(li)健全(quan)適應社(she)會主(zhu)義(yi)市場經(jing)(jing)(jing)濟(ji)要求的(de)(de)(de)管理體制(zhi)和(he)制(zhi)度體系,保護好(hao)(hao)、利用好(hao)(hao)、經(jing)(jing)(jing)營好(hao)(hao)各類(lei)國有(you)資產(chan),最大限度地發揮(hui)好(hao)(hao)各類(lei)國有(you)資產(chan)的(de)(de)(de)作用,創(chuang)造更好(hao)(hao)的(de)(de)(de)經(jing)(jing)(jing)濟(ji)效益(yi)和(he)社(she)會效益(yi),為建設(she)中國特色社(she)會主(zhu)義(yi)提供堅實的(de)(de)(de)經(jing)(jing)(jing)濟(ji)和(he)政(zheng)(zheng)治基礎。


  (一)完善(shan)各類國有資產管理體制是(shi)進一步完善(shan)社會(hui)主義市場經濟體制的必然(ran)選擇


  完(wan)(wan)(wan)(wan)善社(she)會(hui)(hui)(hui)主(zhu)(zhu)義市(shi)(shi)場經(jing)(jing)濟(ji)(ji)(ji)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi),使(shi)公有(you)(you)(you)(you)(you)(you)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)與市(shi)(shi)場經(jing)(jing)濟(ji)(ji)(ji)有(you)(you)(you)(you)(you)(you)機(ji)結合,一方面(mian)要(yao)求國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)經(jing)(jing)濟(ji)(ji)(ji)不(bu)斷增(zeng)強(qiang)(qiang)控制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)力和(he)(he)(he)(he)(he)影響力,在(zai)經(jing)(jing)濟(ji)(ji)(ji)發(fa)(fa)展中發(fa)(fa)揮主(zhu)(zhu)導(dao)作用(yong);另一方面(mian)要(yao)求國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)企業(ye)不(bu)斷增(zeng)強(qiang)(qiang)活力和(he)(he)(he)(he)(he)競爭力,真正成為(wei)市(shi)(shi)場經(jing)(jing)濟(ji)(ji)(ji)的(de)(de)(de)重要(yao)主(zhu)(zhu)體(ti)(ti)(ti)(ti)(ti),這需要(yao)以完(wan)(wan)(wan)(wan)善的(de)(de)(de)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)(guan)(guan)理(li)(li)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)為(wei)保障。黨的(de)(de)(de)十六大以來,國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)(guan)(guan)理(li)(li)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)改革取得了(le)(le)(le)積極的(de)(de)(de)進展和(he)(he)(he)(he)(he)成效(xiao),國(guo)(guo)(guo)(guo)務(wu)院(yuan)、省(sheng)(區、市(shi)(shi))、市(shi)(shi)(地(di))三級(ji)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)機(ji)構(gou)相繼建立(li),明(ming)確了(le)(le)(le)政(zheng)府(fu)(fu)層(ceng)面(mian)的(de)(de)(de)出資(zi)(zi)(zi)(zi)(zi)(zi)人代表,大部分經(jing)(jing)營性非金(jin)融(rong)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)納入監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)體(ti)(ti)(ti)(ti)(ti)系(xi);基本(ben)形成了(le)(le)(le)企業(ye)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)法(fa)律法(fa)規(gui)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)度體(ti)(ti)(ti)(ti)(ti)系(xi),國(guo)(guo)(guo)(guo)務(wu)院(yuan)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)委出臺的(de)(de)(de)規(gui)章(zhang)和(he)(he)(he)(he)(he)規(gui)范性文(wen)件(jian)299件(jian),地(di)方政(zheng)府(fu)(fu)和(he)(he)(he)(he)(he)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)委發(fa)(fa)布的(de)(de)(de)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)法(fa)規(gui)、制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)度2800多(duo)件(jian);強(qiang)(qiang)化了(le)(le)(le)對企業(ye)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)的(de)(de)(de)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan),業(ye)績考核(he)和(he)(he)(he)(he)(he)激勵(li)約束機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建立(li)并不(bu)斷完(wan)(wan)(wan)(wan)善,財務(wu)監(jian)(jian)(jian)督、審(shen)計監(jian)(jian)(jian)督、監(jian)(jian)(jian)事會(hui)(hui)(hui)監(jian)(jian)(jian)督機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)不(bu)斷完(wan)(wan)(wan)(wan)善,產(chan)(chan)(chan)權管(guan)(guan)(guan)(guan)理(li)(li)不(bu)斷加強(qiang)(qiang),國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)本(ben)預算管(guan)(guan)(guan)(guan)理(li)(li)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)度和(he)(he)(he)(he)(he)收益(yi)管(guan)(guan)(guan)(guan)理(li)(li)機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)逐步(bu)建立(li)。這一系(xi)列重要(yao)舉措,為(wei)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)企業(ye)改革發(fa)(fa)展創(chuang)造(zao)了(le)(le)(le)良好的(de)(de)(de)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)環境,促進了(le)(le)(le)社(she)會(hui)(hui)(hui)主(zhu)(zhu)義市(shi)(shi)場經(jing)(jing)濟(ji)(ji)(ji)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)的(de)(de)(de)完(wan)(wan)(wan)(wan)善。但目前,各(ge)類(lei)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)(guan)(guan)理(li)(li)的(de)(de)(de)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)還(huan)沒(mei)有(you)(you)(you)(you)(you)(you)完(wan)(wan)(wan)(wan)全(quan)理(li)(li)順,機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)和(he)(he)(he)(he)(he)法(fa)規(gui)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)度還(huan)不(bu)完(wan)(wan)(wan)(wan)善,存(cun)在(zai)責任主(zhu)(zhu)體(ti)(ti)(ti)(ti)(ti)不(bu)明(ming)確、監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)不(bu)到位、配置不(bu)合理(li)(li)等現象(xiang);一些特(te)定行業(ye)的(de)(de)(de)企業(ye)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)還(huan)沒(mei)有(you)(you)(you)(you)(you)(you)納入新的(de)(de)(de)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi),出資(zi)(zi)(zi)(zi)(zi)(zi)人職能還(huan)沒(mei)有(you)(you)(you)(you)(you)(you)完(wan)(wan)(wan)(wan)全(quan)落(luo)實,國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)科學(xue)性有(you)(you)(you)(you)(you)(you)效(xiao)性有(you)(you)(you)(you)(you)(you)待進一步(bu)增(zeng)強(qiang)(qiang)。適應完(wan)(wan)(wan)(wan)善社(she)會(hui)(hui)(hui)主(zhu)(zhu)義市(shi)(shi)場經(jing)(jing)濟(ji)(ji)(ji)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)的(de)(de)(de)要(yao)求,必須進一步(bu)完(wan)(wan)(wan)(wan)善各(ge)類(lei)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)(guan)(guan)理(li)(li)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)(zhi),使(shi)各(ge)類(lei)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)更好地(di)發(fa)(fa)揮其經(jing)(jing)濟(ji)(ji)(ji)社(she)會(hui)(hui)(hui)功(gong)能,使(shi)國(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)企業(ye)真正成為(wei)獨立(li)的(de)(de)(de)市(shi)(shi)場主(zhu)(zhu)體(ti)(ti)(ti)(ti)(ti)。


  (二)完善各類國有資產管理(li)體(ti)(ti)制是深化(hua)行政(zheng)體(ti)(ti)制改(gai)革、轉變(bian)政(zheng)府(fu)職能的客觀需要


  黨的(de)(de)(de)(de)(de)十八大指出(chu)(chu)(chu),要深(shen)入(ru)推(tui)進(jin)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)企(qi)分開、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)資(zi)(zi)(zi)分開、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)事分開、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)社分開。這是深(shen)化(hua)行政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)改(gai)革(ge)(ge)、轉(zhuan)(zhuan)變(bian)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)職(zhi)能(neng)的(de)(de)(de)(de)(de)重(zhong)要內容(rong),對(dui)(dui)完(wan)善(shan)各類國(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)管(guan)(guan)(guan)理(li)(li)(li)體(ti)(ti)(ti)制(zhi)提(ti)出(chu)(chu)(chu)了(le)(le)新的(de)(de)(de)(de)(de)要求。改(gai)革(ge)(ge)開放初期,國(guo)(guo)有企(qi)業實(shi)際(ji)上(shang)是政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)的(de)(de)(de)(de)(de)附屬物與延伸,政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)很大精(jing)力(li)(li)放在(zai)管(guan)(guan)(guan)理(li)(li)(li)國(guo)(guo)有企(qi)業上(shang),企(qi)業的(de)(de)(de)(de)(de)生產(chan)(chan)、經營(ying)、人事都是由政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)直(zhi)接管(guan)(guan)(guan)理(li)(li)(li)。隨著國(guo)(guo)有企(qi)業改(gai)革(ge)(ge)的(de)(de)(de)(de)(de)推(tui)進(jin),企(qi)業被賦予了(le)(le)更多(duo)的(de)(de)(de)(de)(de)經營(ying)自主權,但仍(reng)然(ran)沒(mei)有從體(ti)(ti)(ti)制(zhi)上(shang)理(li)(li)(li)順政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)與企(qi)業的(de)(de)(de)(de)(de)關系。2000年國(guo)(guo)家(jia)撤銷政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)行業管(guan)(guan)(guan)理(li)(li)(li)部(bu)門(men),減少(shao)了(le)(le)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)對(dui)(dui)國(guo)(guo)有企(qi)業的(de)(de)(de)(de)(de)直(zhi)接管(guan)(guan)(guan)理(li)(li)(li),2003年國(guo)(guo)資(zi)(zi)(zi)委(wei)的(de)(de)(de)(de)(de)成立(li)從機構設置和制(zhi)度安排上(shang)解(jie)決(jue)了(le)(le)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)企(qi)分開、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)資(zi)(zi)(zi)分開的(de)(de)(de)(de)(de)問題(ti),在(zai)深(shen)化(hua)行政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)改(gai)革(ge)(ge)、轉(zhuan)(zhuan)變(bian)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)職(zhi)能(neng)方面取得(de)了(le)(le)重(zhong)大突破。新的(de)(de)(de)(de)(de)國(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)管(guan)(guan)(guan)理(li)(li)(li)體(ti)(ti)(ti)制(zhi)從機構設置上(shang)把(ba)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)的(de)(de)(de)(de)(de)公(gong)共(gong)(gong)管(guan)(guan)(guan)理(li)(li)(li)職(zhi)能(neng)與出(chu)(chu)(chu)資(zi)(zi)(zi)人職(zhi)能(neng)予以分離,明確政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)公(gong)共(gong)(gong)管(guan)(guan)(guan)理(li)(li)(li)部(bu)門(men)不(bu)再履(lv)(lv)(lv)行出(chu)(chu)(chu)資(zi)(zi)(zi)人職(zhi)責(ze),國(guo)(guo)資(zi)(zi)(zi)監管(guan)(guan)(guan)機構不(bu)履(lv)(lv)(lv)行政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)公(gong)共(gong)(gong)管(guan)(guan)(guan)理(li)(li)(li)職(zhi)責(ze),有力(li)(li)促進(jin)了(le)(le)行政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)改(gai)革(ge)(ge)和政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)職(zhi)能(neng)的(de)(de)(de)(de)(de)轉(zhuan)(zhuan)變(bian)。但目前很多(duo)改(gai)革(ge)(ge)措施還不(bu)到位,一(yi)(yi)些(xie)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)公(gong)共(gong)(gong)管(guan)(guan)(guan)理(li)(li)(li)部(bu)門(men)仍(reng)然(ran)對(dui)(dui)國(guo)(guo)有企(qi)業履(lv)(lv)(lv)行出(chu)(chu)(chu)資(zi)(zi)(zi)人職(zhi)責(ze),國(guo)(guo)資(zi)(zi)(zi)監管(guan)(guan)(guan)機構也還承擔(dan)著一(yi)(yi)些(xie)帶有公(gong)共(gong)(gong)管(guan)(guan)(guan)理(li)(li)(li)性質的(de)(de)(de)(de)(de)職(zhi)能(neng),政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)企(qi)不(bu)分、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)資(zi)(zi)(zi)不(bu)分的(de)(de)(de)(de)(de)現(xian)象(xiang)依然(ran)存(cun)在(zai)。從根本上(shang)解(jie)決(jue)這些(xie)問題(ti),需(xu)要進(jin)一(yi)(yi)步(bu)完(wan)善(shan)各類國(guo)(guo)有資(zi)(zi)(zi)產(chan)(chan)管(guan)(guan)(guan)理(li)(li)(li)體(ti)(ti)(ti)制(zhi),進(jin)一(yi)(yi)步(bu)促進(jin)行政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)改(gai)革(ge)(ge)和政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)職(zhi)能(neng)轉(zhuan)(zhuan)變(bian),推(tui)動各級政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)(fu)公(gong)共(gong)(gong)管(guan)(guan)(guan)理(li)(li)(li)部(bu)門(men)與所屬企(qi)業脫鉤,把(ba)精(jing)力(li)(li)集中到社會(hui)公(gong)共(gong)(gong)管(guan)(guan)(guan)理(li)(li)(li)上(shang)來。


  (三)完善各類國(guo)有資產管(guan)理體制(zhi)是進一步深化國(guo)有企業改革的迫切要求

  二、完善各類國有資產管理體制的方向和原則

  完善各類國(guo)(guo)有(you)資產管(guan)(guan)(guan)(guan)理(li)(li)體(ti)制,要(yao)堅持政(zheng)企(qi)(qi)分(fen)(fen)(fen)(fen)開、政(zheng)資分(fen)(fen)(fen)(fen)開、所有(you)權(quan)(quan)(quan)和(he)經(jing)營權(quan)(quan)(quan)相(xiang)分(fen)(fen)(fen)(fen)離的(de)(de)(de)原則。政(zheng)企(qi)(qi)分(fen)(fen)(fen)(fen)開、政(zheng)資分(fen)(fen)(fen)(fen)開是(shi)理(li)(li)順(shun)政(zheng)府(fu)與國(guo)(guo)有(you)企(qi)(qi)業(ye)(ye)關系(xi)的(de)(de)(de)核心。根據社(she)會公(gong)(gong)共管(guan)(guan)(guan)(guan)理(li)(li)職(zhi)能(neng)(neng)和(he)所有(you)者(zhe)職(zhi)能(neng)(neng)分(fen)(fen)(fen)(fen)開的(de)(de)(de)原則,國(guo)(guo)資監管(guan)(guan)(guan)(guan)機構(gou)專門承擔(dan)國(guo)(guo)有(you)資產出資人職(zhi)責(ze)(ze),不(bu)承擔(dan)社(she)會公(gong)(gong)共管(guan)(guan)(guan)(guan)理(li)(li)職(zhi)能(neng)(neng),社(she)會公(gong)(gong)共管(guan)(guan)(guan)(guan)理(li)(li)部門從(cong)政(zheng)府(fu)經(jing)濟調節和(he)社(she)會管(guan)(guan)(guan)(guan)理(li)(li)角度對(dui)各類所有(you)制企(qi)(qi)業(ye)(ye)進(jin)行管(guan)(guan)(guan)(guan)理(li)(li),不(bu)承擔(dan)出資人職(zhi)責(ze)(ze)。按照(zhao)政(zheng)企(qi)(qi)分(fen)(fen)(fen)(fen)開以(yi)及所有(you)權(quan)(quan)(quan)和(he)經(jing)營權(quan)(quan)(quan)分(fen)(fen)(fen)(fen)離的(de)(de)(de)原則,國(guo)(guo)資監管(guan)(guan)(guan)(guan)機構(gou)依法對(dui)企(qi)(qi)業(ye)(ye)的(de)(de)(de)國(guo)(guo)有(you)資產進(jin)行監管(guan)(guan)(guan)(guan),不(bu)能(neng)(neng)干預企(qi)(qi)業(ye)(ye)的(de)(de)(de)生產經(jing)營活(huo)動(dong)。企(qi)(qi)業(ye)(ye)必須自覺接受(shou)國(guo)(guo)資監管(guan)(guan)(guan)(guan)機構(gou)的(de)(de)(de)監管(guan)(guan)(guan)(guan),不(bu)得(de)損害(hai)所有(you)者(zhe)權(quan)(quan)(quan)益。


  完善(shan)各類國(guo)(guo)(guo)有(you)資(zi)產(chan)管(guan)(guan)(guan)理體(ti)制(zhi),要堅持權(quan)(quan)(quan)利、義務和(he)(he)責任相(xiang)統一(yi),管(guan)(guan)(guan)資(zi)產(chan)和(he)(he)管(guan)(guan)(guan)人(ren)(ren)(ren)、管(guan)(guan)(guan)事相(xiang)結合的原則。各級國(guo)(guo)(guo)資(zi)監(jian)管(guan)(guan)(guan)機構經(jing)授權(quan)(quan)(quan)代表本級人(ren)(ren)(ren)民(min)(min)政(zheng)府(fu)對國(guo)(guo)(guo)有(you)資(zi)產(chan)履行出資(zi)人(ren)(ren)(ren)職(zhi)責,享有(you)資(zi)產(chan)收益權(quan)(quan)(quan)、參與(yu)重大決(jue)策和(he)(he)選擇管(guan)(guan)(guan)理者等出資(zi)人(ren)(ren)(ren)權(quan)(quan)(quan)利,對出資(zi)企業(ye)國(guo)(guo)(guo)有(you)資(zi)產(chan)保值增值和(he)(he)發揮(hui)好國(guo)(guo)(guo)有(you)資(zi)產(chan)在經(jing)濟社會發展中的作用負(fu)責,接(jie)受本級人(ren)(ren)(ren)民(min)(min)政(zheng)府(fu)的監(jian)督(du)和(he)(he)考核。國(guo)(guo)(guo)資(zi)監(jian)管(guan)(guan)(guan)機構建立以績效考核、薪酬(chou)分配、領導人(ren)(ren)(ren)員管(guan)(guan)(guan)理和(he)(he)財(cai)務評價、產(chan)權(quan)(quan)(quan)管(guan)(guan)(guan)理、風險(xian)管(guan)(guan)(guan)控(kong)等為(wei)主線的工作閉環體(ti)系,實現管(guan)(guan)(guan)人(ren)(ren)(ren)、管(guan)(guan)(guan)事、管(guan)(guan)(guan)資(zi)產(chan)的有(you)效結合。

  進一步(bu)明(ming)確(que)(que)各(ge)類國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)責(ze)任(ren)(ren)主體,明(ming)晰(xi)產(chan)(chan)(chan)(chan)權關系(xi),建(jian)立體制機制,落實監(jian)(jian)(jian)(jian)管責(ze)任(ren)(ren)。進一步(bu)完善中央、省(區、市)、市(地(di))三(san)級經營性(xing)國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管機構(gou),經營性(xing)國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)規模較大的(de)縣(市)可探索設立獨(du)立的(de)監(jian)(jian)(jian)(jian)管機構(gou)。進一步(bu)規范各(ge)級國(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管機構(gou)作(zuo)為政府(fu)直屬特設機構(gou)的(de)性(xing)質定位(wei),依法(fa)保障(zhang)其專門(men)(men)性(xing)和獨(du)立性(xing)。明(ming)確(que)(que)政府(fu)公(gong)共(gong)管理部門(men)(men)不履(lv)行(xing)國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)出(chu)資(zi)(zi)(zi)人(ren)職(zhi)責(ze)。進一步(bu)落實“上(shang)級政府(fu)國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管機構(gou)對下級政府(fu)的(de)國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)督管理工作(zuo)進行(xing)指導(dao)和監(jian)(jian)(jian)(jian)督”的(de)規定,各(ge)級國(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管部門(men)(men)在依法(fa)履(lv)行(xing)出(chu)資(zi)(zi)(zi)人(ren)職(zhi)責(ze)的(de)基(ji)礎上(shang),深入開展國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管,防止將國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管職(zhi)責(ze)混(hun)同于行(xing)政管理職(zhi)能,形(xing)成(cheng)新(xin)的(de)國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)(chan)(chan)多頭監(jian)(jian)(jian)(jian)管。


  (二)完善國資監管(guan)法(fa)規規章


  根(gen)據各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)的屬性和(he)監(jian)(jian)(jian)管(guan)(guan)(guan)特點,加快(kuai)制(zhi)(zhi)(zhi)定各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)的法規規章,形成(cheng)比較(jiao)完善(shan)的國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)法規體系,實現(xian)國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)的制(zhi)(zhi)(zhi)度化(hua)、規范(fan)化(hua)和(he)體系化(hua)。要加快(kuai)完善(shan)各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)立法,健(jian)全(quan)(quan)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)出(chu)資(zi)(zi)(zi)人制(zhi)(zhi)(zhi)度、領導人員管(guan)(guan)(guan)理(li)制(zhi)(zhi)(zhi)度、重大事項管(guan)(guan)(guan)理(li)制(zhi)(zhi)(zhi)度、財(cai)務和(he)資(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)制(zhi)(zhi)(zhi)度,規范(fan)政(zheng)(zheng)府、國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)機構(gou)和(he)國(guo)(guo)(guo)家(jia)出(chu)資(zi)(zi)(zi)企(qi)(qi)業(或單(dan)位)的關(guan)系。健(jian)全(quan)(quan)完善(shan)國(guo)(guo)(guo)家(jia)出(chu)資(zi)(zi)(zi)企(qi)(qi)業(或單(dan)位)投資(zi)(zi)(zi)管(guan)(guan)(guan)理(li)、財(cai)務管(guan)(guan)(guan)理(li)、風險管(guan)(guan)(guan)理(li)等專項管(guan)(guan)(guan)理(li)制(zhi)(zhi)(zhi)度,不斷(duan)提高現(xian)代化(hua)管(guan)(guan)(guan)理(li)水平。健(jian)全(quan)(quan)完善(shan)產(chan)權登(deng)記、資(zi)(zi)(zi)產(chan)統(tong)計、清產(chan)核資(zi)(zi)(zi)、資(zi)(zi)(zi)產(chan)評估、產(chan)權轉讓等各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)制(zhi)(zhi)(zhi)度,建(jian)立全(quan)(quan)國(guo)(guo)(guo)統(tong)一的企(qi)(qi)業國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)工作體系。健(jian)全(quan)(quan)完善(shan)上下級(ji)國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)(guan)機構(gou)指導監(jian)(jian)(jian)督制(zhi)(zhi)(zhi)度,確保中央和(he)地方國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)(guan)政(zheng)(zheng)策(ce)、目標(biao)和(he)主要任務的協調一致。


  (三)推進經營性(xing)國有(you)資(zi)產集中統一監管


  明確(que)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)政策制(zhi)(zhi)度(du)的(de)(de)統一性(xing)。經(jing)營(ying)性(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)要(yao)堅(jian)持(chi)已形(xing)成并在(zai)實踐中證明行(xing)之有(you)(you)效的(de)(de)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)法律法規制(zhi)(zhi)度(du)的(de)(de)基本原(yuan)則,要(yao)有(you)(you)明確(que)的(de)(de)出資(zi)(zi)(zi)主體(ti),要(yao)落實保值(zhi)增值(zhi)責任,要(yao)建立考核(he)與薪酬掛鉤的(de)(de)激勵約(yue)束機制(zhi)(zhi),提(ti)高國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)的(de)(de)監(jian)(jian)管(guan)(guan)效能。總結推廣(guang)部分地方(fang)開展(zhan)集中統一監(jian)(jian)管(guan)(guan)的(de)(de)經(jing)驗,充分發揮各級國(guo)(guo)(guo)資(zi)(zi)(zi)委的(de)(de)專業(ye)化監(jian)(jian)管(guan)(guan)優(you)勢,探索實現國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)的(de)(de)全覆(fu)蓋,防止經(jing)營(ying)性(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)條塊分割,為在(zai)更(geng)大范圍優(you)化配(pei)置資(zi)(zi)(zi)源、提(ti)高國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本運行(xing)效率、加快資(zi)(zi)(zi)源整合和企業(ye)重組、培育具有(you)(you)核(he)心競爭力的(de)(de)企業(ye)集團創造(zao)有(you)(you)利條件。行(xing)政事業(ye)性(xing)和資(zi)(zi)(zi)源性(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)轉為經(jing)營(ying)性(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)的(de)(de),都(dou)要(yao)納入經(jing)營(ying)性(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)體(ti)制(zhi)(zhi)。


  (四)增強國資監管的(de)針對性、有效性和及時(shi)性


  科學把(ba)握(wo)各(ge)(ge)類國(guo)有資(zi)(zi)(zi)產(chan)(chan)管(guan)(guan)理的(de)(de)特殊性(xing),針(zhen)對(dui)具有不同(tong)(tong)(tong)屬性(xing)和(he)特點的(de)(de)國(guo)有資(zi)(zi)(zi)產(chan)(chan),探(tan)索(suo)有針(zhen)對(dui)性(xing)的(de)(de)監管(guan)(guan)模式(shi)和(he)方(fang)式(shi)方(fang)法(fa)。根據國(guo)家經濟(ji)社會發展的(de)(de)不同(tong)(tong)(tong)階段和(he)面(mian)臨的(de)(de)新形(xing)(xing)勢(shi)新任(ren)務新要(yao)求(qiu),及時調整監管(guan)(guan)措施和(he)重點。完(wan)善績(ji)效考核(he)體系,加(jia)(jia)大分類考核(he)力度(du),探(tan)索(suo)不同(tong)(tong)(tong)性(xing)質(zhi)、不同(tong)(tong)(tong)類別、不同(tong)(tong)(tong)行業的(de)(de)績(ji)效考核(he)模式(shi),提(ti)(ti)高考核(he)指(zhi)標的(de)(de)導向性(xing)和(he)針(zhen)對(dui)性(xing),切實落(luo)實國(guo)有資(zi)(zi)(zi)產(chan)(chan)保值增(zeng)值、有效使用和(he)管(guan)(guan)理責(ze)任(ren)。加(jia)(jia)強對(dui)各(ge)(ge)類國(guo)有資(zi)(zi)(zi)產(chan)(chan)經營(ying)管(guan)(guan)理和(he)使用重點環(huan)節的(de)(de)監管(guan)(guan),形(xing)(xing)成依靠政(zheng)府、聯合(he)部(bu)門、協調各(ge)(ge)界(jie)的(de)(de)國(guo)資(zi)(zi)(zi)監管(guan)(guan)大格局,使各(ge)(ge)類國(guo)有資(zi)(zi)(zi)產(chan)(chan)監管(guan)(guan)的(de)(de)工作合(he)力進一(yi)步(bu)增(zeng)強,國(guo)有資(zi)(zi)(zi)產(chan)(chan)配置效率(lv)進一(yi)步(bu)提(ti)(ti)高。


  各類國(guo)(guo)有資(zi)產(chan)(chan)的(de)(de)存在(zai)形態、功能作用(yong)、監(jian)管方式(shi)等雖有所不同,但加強國(guo)(guo)有資(zi)產(chan)(chan)監(jian)管、保(bao)障國(guo)(guo)有資(zi)產(chan)(chan)安全的(de)(de)基本(ben)要求應是一致的(de)(de),必(bi)須做(zuo)到產(chan)(chan)權(quan)(quan)清(qing)晰、權(quan)(quan)責明確、配(pei)置(zhi)合(he)理(li)(li)、運轉順暢、監(jian)管到位(wei)、保(bao)護嚴格。要通過完善各類國(guo)(guo)有資(zi)產(chan)(chan)管理(li)(li)體制,進一步提高(gao)(gao)各類國(guo)(guo)有資(zi)產(chan)(chan)管理(li)(li)的(de)(de)科學性,使(shi)經營性國(guo)(guo)有資(zi)產(chan)(chan)實現保(bao)值增(zeng)值,不斷增(zeng)強國(guo)(guo)有經濟的(de)(de)活(huo)力、控(kong)制力、影響力;使(shi)行政事業(ye)性國(guo)(guo)有資(zi)產(chan)(chan)配(pei)置(zhi)使(shi)用(yong)更(geng)加合(he)理(li)(li)有效,發(fa)揮更(geng)大的(de)(de)社會效益;使(shi)資(zi)源性國(guo)(guo)有資(zi)產(chan)(chan)規劃更(geng)加科學、開發(fa)更(geng)加節約高(gao)(gao)效,促進經濟、社會、環境可持續發(fa)展(zhan)。
