6月19日下午(wu),湖北(bei)國資委(wei)召(zhao)開(kai)了(le)所屬(shu)出資企業總(zong)法律顧問履(lv)職評議(yi)(yi)現(xian)場述職會議(yi)(yi)。湖北(bei)能源、三環(huan)集團、大(da)治(zhi)有色(se)等15家省出資企業的(de)總(zong)法律顧問公開(kai)進(jin)行了(le)述職,全面報告(gao)了(le)履(lv)職情況(kuang)。
進(jin)行(xing)現(xian)場評(ping)議(yi)是(shi)(shi)湖(hu)北(bei)國(guo)資(zi)委對省(sheng)出資(zi)企(qi)業(ye)總(zong)(zong)法(fa)(fa)律(lv)顧(gu)(gu)(gu)問(wen)(wen)開展(zhan)履(lv)職(zhi)評(ping)議(yi)工(gong)作(zuo)最重要(yao)的(de)一個環節。根據湖(hu)北(bei)國(guo)資(zi)委2011年(nian)底出臺(tai)的(de)《湖(hu)北(bei)國(guo)資(zi)委出資(zi)企(qi)業(ye)總(zong)(zong)法(fa)(fa)律(lv)顧(gu)(gu)(gu)問(wen)(wen)履(lv)職(zhi)評(ping)議(yi)辦法(fa)(fa)(試行(xing))》(鄂國(guo)資(zi)規〔2011〕7號)要(yao)求,企(qi)業(ye)總(zong)(zong)法(fa)(fa)律(lv)顧(gu)(gu)(gu)問(wen)(wen)年(nian)度履(lv)職(zhi)評(ping)議(yi)工(gong)作(zuo),采取總(zong)(zong)法(fa)(fa)律(lv)顧(gu)(gu)(gu)問(wen)(wen)述職(zhi)、所在(zai)企(qi)業(ye)法(fa)(fa)人代表評(ping)議(yi)、湖(hu)北(bei)國(guo)資(zi)委綜合評(ping)定的(de)方式進(jin)行(xing)。湖(hu)北(bei)國(guo)資(zi)委開展(zhan)企(qi)業(ye)總(zong)(zong)法(fa)(fa)律(lv)顧(gu)(gu)(gu)問(wen)(wen)年(nian)度履(lv)職(zhi)評(ping)議(yi)工(gong)作(zuo)是(shi)(shi)深入推進(jin)企(qi)業(ye)總(zong)(zong)法(fa)(fa)律(lv)顧(gu)(gu)(gu)問(wen)(wen)制(zhi)度建設的(de)又一個重大的(de)制(zhi)度創(chuang)新(xin),對于加強總(zong)(zong)法(fa)(fa)律(lv)顧(gu)(gu)(gu)問(wen)(wen)制(zhi)度建設具有重要(yao)的(de)意義。
湖(hu)北國(guo)資(zi)委(wei)對(dui)出(chu)資(zi)企(qi)(qi)業(ye)(ye)(ye)總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)進行(xing)履(lv)(lv)職(zhi)評(ping)(ping)(ping)(ping)議(yi)有四個方(fang)面(mian)的特(te)色:一是(shi)(shi)(shi)專(zhuan)家(jia)評(ping)(ping)(ping)(ping)審(shen)。在現(xian)(xian)場(chang)履(lv)(lv)職(zhi)評(ping)(ping)(ping)(ping)議(yi)評(ping)(ping)(ping)(ping)委(wei)的選(xuan)聘(pin)上突出(chu)以法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)專(zhuan)家(jia)為(wei)主(zhu)(zhu)導(dao)、職(zhi)能(neng)處(chu)室為(wei)輔助的原則。除了(le)(le)由湖(hu)北國(guo)資(zi)委(wei)分(fen)管(guan)法(fa)(fa)(fa)(fa)(fa)制(zhi)工(gong)(gong)作(zuo)(zuo)(zuo)副主(zhu)(zhu)任(ren)(ren)、政(zheng)策法(fa)(fa)(fa)(fa)(fa)規處(chu)、企(qi)(qi)業(ye)(ye)(ye)領(ling)導(dao)管(guan)理處(chu)、監事會(hui)(hui)工(gong)(gong)作(zuo)(zuo)(zuo)處(chu)的負責人擔任(ren)(ren)外(wai),還(huan)特(te)邀了(le)(le)武漢(han)鋼(gang)鐵(集團)公(gong)(gong)(gong)司、江漢(han)石油(you)管(guan)理局(ju)、中(zhong)建三局(ju)、中(zhong)鐵大橋(qiao)局(ju)等(deng)在鄂中(zhong)央(yang)企(qi)(qi)業(ye)(ye)(ye)的總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)(領(ling)導(dao))以及(ji)湖(hu)北省法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)界知名人士擔任(ren)(ren)專(zhuan)家(jia)評(ping)(ping)(ping)(ping)委(wei)。二是(shi)(shi)(shi)現(xian)(xian)場(chang)打分(fen)。現(xian)(xian)場(chang)述職(zhi)重在突出(chu)業(ye)(ye)(ye)績(ji)導(dao)向。突出(chu)工(gong)(gong)作(zuo)(zuo)(zuo)業(ye)(ye)(ye)績(ji),突出(chu)工(gong)(gong)作(zuo)(zuo)(zuo)特(te)色,突出(chu)工(gong)(gong)作(zuo)(zuo)(zuo)責任(ren)(ren),突出(chu)工(gong)(gong)作(zuo)(zuo)(zuo)措施。總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)述職(zhi)后,評(ping)(ping)(ping)(ping)委(wei)從職(zhi)業(ye)(ye)(ye)操守、勤勉敬(jing)業(ye)(ye)(ye)、履(lv)(lv)職(zhi)能(neng)力、廉潔從業(ye)(ye)(ye)、工(gong)(gong)作(zuo)(zuo)(zuo)業(ye)(ye)(ye)績(ji)五個方(fang)面(mian)進行(xing)量化現(xian)(xian)場(chang)打分(fen)。所有企(qi)(qi)業(ye)(ye)(ye)總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)述職(zhi)結(jie)束(shu)后,由主(zhu)(zhu)持人現(xian)(xian)場(chang)公(gong)(gong)(gong)布評(ping)(ping)(ping)(ping)議(yi)分(fen)值(zhi),做到了(le)(le)公(gong)(gong)(gong)平(ping)、公(gong)(gong)(gong)正、公(gong)(gong)(gong)開。三是(shi)(shi)(shi)結(jie)果(guo)(guo)公(gong)(gong)(gong)開。在確(que)(que)定(ding)總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)評(ping)(ping)(ping)(ping)定(ding)結(jie)果(guo)(guo)時,根據現(xian)(xian)場(chang)述職(zhi)評(ping)(ping)(ping)(ping)議(yi)和專(zhuan)家(jia)評(ping)(ping)(ping)(ping)審(shen)意(yi)(yi)(yi)見(jian),結(jie)合企(qi)(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)人代表評(ping)(ping)(ping)(ping)議(yi)意(yi)(yi)(yi)見(jian)對(dui)企(qi)(qi)業(ye)(ye)(ye)總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)年度履(lv)(lv)職(zhi)情(qing)況進行(xing)綜(zong)合評(ping)(ping)(ping)(ping)定(ding),提出(chu)評(ping)(ping)(ping)(ping)議(yi)意(yi)(yi)(yi)見(jian)并確(que)(que)定(ding)其(qi)年度評(ping)(ping)(ping)(ping)議(yi)結(jie)果(guo)(guo)。其(qi)中(zhong)總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)現(xian)(xian)場(chang)述職(zhi)評(ping)(ping)(ping)(ping)議(yi)權重為(wei)70%,所在企(qi)(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)人代表評(ping)(ping)(ping)(ping)議(yi)權重為(wei)20%,湖(hu)北國(guo)資(zi)委(wei)綜(zong)合評(ping)(ping)(ping)(ping)定(ding)權重為(wei)10%。企(qi)(qi)業(ye)(ye)(ye)總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)履(lv)(lv)職(zhi)評(ping)(ping)(ping)(ping)議(yi)結(jie)果(guo)(guo)分(fen)為(wei)優秀(xiu)、稱(cheng)職(zhi)、基本稱(cheng)職(zhi)、不(bu)稱(cheng)職(zhi)四個等(deng)次。評(ping)(ping)(ping)(ping)議(yi)結(jie)果(guo)(guo)經湖(hu)北國(guo)資(zi)委(wei)主(zhu)(zhu)任(ren)(ren)辦公(gong)(gong)(gong)會(hui)(hui)審(shen)定(ding)后,上網公(gong)(gong)(gong)示,公(gong)(gong)(gong)示期(qi)間(jian)無異議(yi)后,再書(shu)面(mian)通知述職(zhi)對(dui)象及(ji)單(dan)位。四是(shi)(shi)(shi)獎(jiang)懲掛(gua)鉤(gou)。履(lv)(lv)職(zhi)評(ping)(ping)(ping)(ping)議(yi)結(jie)果(guo)(guo)作(zuo)(zuo)(zuo)為(wei)對(dui)企(qi)(qi)業(ye)(ye)(ye)總(zong)(zong)(zong)(zong)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)年度和任(ren)(ren)期(qi)業(ye)(ye)(ye)績(ji)考核、任(ren)(ren)期(qi)綜(zong)合考核、獎(jiang)懲、任(ren)(ren)免(續聘(pin)、解(jie)聘(pin))和企(qi)(qi)業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)職(zhi)業(ye)(ye)(ye)崗位等(deng)級資(zi)格評(ping)(ping)(ping)(ping)定(ding)的重要依據。
通過湖北省(sheng)出資企業總(zong)法律(lv)顧問履(lv)職評議工(gong)作,總(zong)結了(le)成績,找(zhao)出了(le)差距(ju),關鍵的是強(qiang)化了(le)企業總(zong)法律(lv)顧問恪盡職守、愛崗(gang)敬業的責任,提高了(le)總(zong)法律(lv)顧問履(lv)職能力(li)和(he)水平。
現場履職(zhi)評(ping)議結束后,湖(hu)北國資委就進(jin)(jin)一(yi)步推進(jin)(jin)省出資企(qi)業總(zong)(zong)法律(lv)顧(gu)問(wen)的(de)制度建設提出了四點(dian)要(yao)求:一(yi)是堅(jian)(jian)定(ding)(ding)不(bu)移(yi)選好配強(qiang)企(qi)業總(zong)(zong)法律(lv)顧(gu)問(wen);二是堅(jian)(jian)定(ding)(ding)不(bu)移(yi)落實企(qi)業總(zong)(zong)法律(lv)顧(gu)問(wen)的(de)職(zhi)責;三是堅(jian)(jian)定(ding)(ding)不(bu)移(yi)地發(fa)揮總(zong)(zong)法律(lv)顧(gu)問(wen)在(zai)防(fang)范企(qi)業法律(lv)風險當中的(de)關鍵作用;四是堅(jian)(jian)定(ding)(ding)不(bu)移(yi)地推進(jin)(jin)法律(lv)工作隊(dui)伍建設。
