一、主要負責人切實履行推進法治建設第一責任人職責
(一)深入學習貫徹習近平法治思想。國(guo)(guo)(guo)資(zi)委(wei)黨委(wei)書記(ji)、主(zhu)任郝鵬嚴格貫徹落實《中(zhong)(zhong)共中(zhong)(zhong)央(yang)辦公廳(ting) 國(guo)(guo)(guo)務院(yuan)辦公廳(ting)關(guan)于印發〈黨政主(zhu)要(yao)負責(ze)人履行(xing)推(tui)進(jin)法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)設第一責(ze)任人職責(ze)規定(ding)〉的(de)(de)通知》要(yao)求(qiu),始終(zhong)把習(xi)(xi)(xi)(xi)近(jin)平法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)思(si)想作為國(guo)(guo)(guo)資(zi)委(wei)系統法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)設的(de)(de)根本(ben)遵循,認真貫徹落實黨中(zhong)(zhong)央(yang)關(guan)于法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)設的(de)(de)重(zhong)大決策部署,切實履行(xing)國(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)企法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)設組織(zhi)者(zhe)、推(tui)動(dong)者(zhe)和實踐者(zhe)的(de)(de)職責(ze)。召開黨委(wei)會(hui)(hui)議(yi)(yi)傳(chuan)(chuan)達學習(xi)(xi)(xi)(xi)習(xi)(xi)(xi)(xi)近(jin)平總書記(ji)在中(zhong)(zhong)央(yang)全(quan)面依法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)國(guo)(guo)(guo)委(wei)員(yuan)(yuan)會(hui)(hui)第三次(ci)(ci)會(hui)(hui)議(yi)(yi)上(shang)的(de)(de)重(zhong)要(yao)講(jiang)話精神(shen),部署依法(fa)(fa)防控疫情工作。國(guo)(guo)(guo)資(zi)委(wei)黨委(wei)理論學習(xi)(xi)(xi)(xi)中(zhong)(zhong)心組集體(ti)深入學習(xi)(xi)(xi)(xi)習(xi)(xi)(xi)(xi)近(jin)平總書記(ji)在中(zhong)(zhong)央(yang)政治(zhi)(zhi)(zhi)(zhi)局第二十次(ci)(ci)集體(ti)學習(xi)(xi)(xi)(xi)時的(de)(de)重(zhong)要(yao)講(jiang)話精神(shen),邀請全(quan)國(guo)(guo)(guo)人大常(chang)委(wei)會(hui)(hui)法(fa)(fa)制工作委(wei)員(yuan)(yuan)會(hui)(hui)負責(ze)同志作《中(zhong)(zhong)華人民(min)共和國(guo)(guo)(guo)民(min)法(fa)(fa)典(dian)》(以下簡稱《民(min)法(fa)(fa)典(dian)》)專題講(jiang)座,結(jie)合國(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)企實際研究推(tui)動(dong)落實措施。黨委(wei)會(hui)(hui)議(yi)(yi)專題傳(chuan)(chuan)達學習(xi)(xi)(xi)(xi)中(zhong)(zhong)央(yang)全(quan)面依法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)國(guo)(guo)(guo)工作會(hui)(hui)議(yi)(yi)精神(shen),要(yao)求(qiu)全(quan)面準確學習(xi)(xi)(xi)(xi)領會(hui)(hui)習(xi)(xi)(xi)(xi)近(jin)平法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)思(si)想,深入開展(zhan)學習(xi)(xi)(xi)(xi)宣傳(chuan)(chuan)教育活動(dong),并就推(tui)進(jin)國(guo)(guo)(guo)資(zi)委(wei)系統法(fa)(fa)治(zhi)(zhi)(zhi)(zhi)建(jian)設作出(chu)部署安排。
(二)加強國資國企法治建設的組織領導。深入研究(jiu)謀劃國資國企法(fa)(fa)(fa)治(zhi)建(jian)(jian)設年度(du)(du)工(gong)作,確(que)保(bao)法(fa)(fa)(fa)治(zhi)建(jian)(jian)設與其他重(zhong)(zhong)點工(gong)作同步(bu)部(bu)署、同步(bu)推進、同步(bu)督(du)促。黨(dang)委會(hui)議專題(ti)傳達學習中央政法(fa)(fa)(fa)工(gong)作會(hui)議精神,研究(jiu)制定(ding)貫徹落實措(cuo)施。嚴格(ge)依法(fa)(fa)(fa)依規決(jue)策,健(jian)全重(zhong)(zhong)大決(jue)策法(fa)(fa)(fa)律審核(he)機制,加強對規章規范(fan)(fan)性(xing)文件(jian)和黨(dang)委規范(fan)(fan)性(xing)文件(jian)的審核(he)把關。及時研究(jiu)解決(jue)法(fa)(fa)(fa)治(zhi)建(jian)(jian)設重(zhong)(zhong)大問題(ti),國資委黨(dang)委會(hui)議、委務(wu)會(hui)議專題(ti)審議立法(fa)(fa)(fa)工(gong)作計劃、黨(dang)委規范(fan)(fan)性(xing)文件(jian)制定(ding)計劃、重(zhong)(zhong)要制度(du)(du)文件(jian)以及法(fa)(fa)(fa)治(zhi)建(jian)(jian)設年度(du)(du)情況報(bao)告等。統籌部(bu)署黨(dang)內法(fa)(fa)(fa)規制度(du)(du)建(jian)(jian)設,組織(zhi)研究(jiu)制定(ding)黨(dang)委規范(fan)(fan)性(xing)文件(jian),確(que)保(bao)黨(dang)內法(fa)(fa)(fa)規各項要求在國資委系統落實落地。
(三)強化對法治建設具體措施的指導督促。受(shou)國(guo)務院委(wei)托,向全(quan)國(guo)人大常委(wei)會報告國(guo)資(zi)委(wei)系統(tong)監管企業(ye)國(guo)有(you)資(zi)產管理情況,認真接受(shou)人大監督。部(bu)署推動重要法(fa)(fa)律法(fa)(fa)規(gui)研究制定(ding)工作,多次對配合做好《中(zhong)華人民共(gong)和國(guo)公司(si)法(fa)(fa)》(以(yi)下(xia)簡稱(cheng)《公司(si)法(fa)(fa)》)修訂等(deng)作出批示,組織研究起草《中(zhong)華人民共(gong)和國(guo)公職人員(yuan)政務處分法(fa)(fa)》(以(yi)下(xia)簡稱(cheng)《政務處分法(fa)(fa)》)有(you)關配套規(gui)定(ding)。專門就中(zhong)央企業(ye)法(fa)(fa)治工作會議作出批示,對“十(shi)四五”時期法(fa)(fa)治央企建設工作提出明確要求。堅(jian)持重視法(fa)(fa)治素養和法(fa)(fa)治能(neng)力的用人導向,推動將“依法(fa)(fa)依規(gui)辦(ban)事、制度執行能(neng)力”等(deng)納(na)入干部(bu)年度考核指標。
二、2020年法治建設主要舉措和成效
(一)依法全面行權履職。一是(shi)持續推(tui)(tui)進(jin)(jin)(jin)職能轉(zhuan)(zhuan)變(bian)重(zhong)點(dian)任(ren)(ren)務。加(jia)強組(zu)織推(tui)(tui)動(dong),建(jian)(jian)立(li)健全(quan)職能轉(zhuan)(zhuan)變(bian)工(gong)(gong)(gong)作(zuo)季報機(ji)制(zhi),定(ding)期梳(shu)理(li)(li)匯總工(gong)(gong)(gong)作(zuo)進(jin)(jin)(jin)展(zhan)。全(quan)面(mian)開展(zhan)權(quan)責清(qing)單運(yun)行(xing)評估,梳(shu)理(li)(li)調(diao)整權(quan)責事項(xiang),推(tui)(tui)進(jin)(jin)(jin)新版清(qing)單編制(zhi)工(gong)(gong)(gong)作(zuo)。加(jia)大(da)(da)國(guo)(guo)(guo)(guo)有(you)資(zi)本(ben)投資(zi)、運(yun)營(ying)公司授權(quan)放權(quan)工(gong)(gong)(gong)作(zuo)力度(du),推(tui)(tui)動(dong)優化運(yun)營(ying)模式(shi)和(he)經(jing)營(ying)機(ji)制(zhi),更好服務實(shi)(shi)體(ti)經(jing)濟(ji)和(he)科(ke)技創新。二是(shi)進(jin)(jin)(jin)一步加(jia)大(da)(da)監(jian)督工(gong)(gong)(gong)作(zuo)力度(du)。完善業務監(jian)督、綜合(he)監(jian)督、責任(ren)(ren)追究三(san)位一體(ti)的監(jian)督工(gong)(gong)(gong)作(zuo)格局(ju),指(zhi)導推(tui)(tui)動(dong)中央企業不(bu)斷完善內控體(ti)系(xi)(xi)(xi)、內部審計等制(zhi)度(du)。深入(ru)開展(zhan)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)重(zhong)大(da)(da)損失調(diao)查及違(wei)規(gui)(gui)經(jing)營(ying)投資(zi)責任(ren)(ren)追究,嚴(yan)防國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)流失。三(san)是(shi)推(tui)(tui)動(dong)構(gou)建(jian)(jian)國(guo)(guo)(guo)(guo)資(zi)監(jian)管(guan)(guan)大(da)(da)格局(ju)。組(zu)織召開構(gou)建(jian)(jian)國(guo)(guo)(guo)(guo)資(zi)監(jian)管(guan)(guan)大(da)(da)格局(ju)工(gong)(gong)(gong)作(zuo)推(tui)(tui)進(jin)(jin)(jin)會,印(yin)發年度(du)指(zhi)導監(jian)督地方(fang)國(guo)(guo)(guo)(guo)資(zi)工(gong)(gong)(gong)作(zuo)計劃(hua),全(quan)面(mian)部署(shu)年度(du)重(zhong)點(dian)工(gong)(gong)(gong)作(zuo)。經(jing)營(ying)性國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)集(ji)中統一監(jian)管(guan)(guan)有(you)序推(tui)(tui)進(jin)(jin)(jin),省級國(guo)(guo)(guo)(guo)資(zi)委監(jian)管(guan)(guan)比(bi)(bi)例超(chao)過91%,全(quan)國(guo)(guo)(guo)(guo)24個地方(fang)監(jian)管(guan)(guan)比(bi)(bi)例超(chao)過95%。四(si)是(shi)加(jia)快建(jian)(jian)設國(guo)(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)(guo)企在(zai)線監(jian)管(guan)(guan)系(xi)(xi)(xi)統。國(guo)(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)(guo)企在(zai)線監(jian)管(guan)(guan)系(xi)(xi)(xi)統建(jian)(jian)設取得實(shi)(shi)質性進(jin)(jin)(jin)展(zhan),基(ji)本(ben)建(jian)(jian)成涉企事項(xiang)網(wang)上(shang)服務大(da)(da)廳,35項(xiang)常規(gui)(gui)業務實(shi)(shi)現網(wang)上(shang)辦理(li)(li),推(tui)(tui)動(dong)國(guo)(guo)(guo)(guo)資(zi)監(jian)管(guan)(guan)向數字監(jian)管(guan)(guan)、智慧監(jian)管(guan)(guan)轉(zhuan)(zhuan)變(bian)。統籌推(tui)(tui)進(jin)(jin)(jin)全(quan)國(guo)(guo)(guo)(guo)國(guo)(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)(guo)企在(zai)線監(jian)管(guan)(guan)系(xi)(xi)(xi)統建(jian)(jian)設,促進(jin)(jin)(jin)形(xing)成上(shang)下聯動(dong)的信息化監(jian)管(guan)(guan)格局(ju)。
(二)在法治軌道上扎實做好疫情防控和復工復產相關工作。一是加(jia)(jia)強組織(zhi)領(ling)導(dao)(dao)(dao)(dao),健全工(gong)(gong)作(zuo)機制。第一時間成(cheng)立(li)應(ying)對疫(yi)(yi)情(qing)(qing)(qing)(qing)工(gong)(gong)作(zuo)領(ling)導(dao)(dao)(dao)(dao)小組,作(zuo)出(chu)全面部署(shu),加(jia)(jia)強對國資(zi)委(wei)和(he)(he)中央企(qi)業(ye)(ye)疫(yi)(yi)情(qing)(qing)(qing)(qing)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)工(gong)(gong)作(zuo)的(de)(de)領(ling)導(dao)(dao)(dao)(dao)。多(duo)措并舉確保(bao)(bao)國資(zi)委(wei)機關(guan)(guan)和(he)(he)直屬單位零感(gan)染(ran),主動作(zuo)為,及早成(cheng)立(li)醫療(liao)物(wu)資(zi)保(bao)(bao)障專(zhuan)項(xiang)(xiang)工(gong)(gong)作(zuo)組和(he)(he)境外(wai)(wai)疫(yi)(yi)情(qing)(qing)(qing)(qing)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)指(zhi)導(dao)(dao)(dao)(dao)組,指(zhi)導(dao)(dao)(dao)(dao)企(qi)業(ye)(ye)依(yi)(yi)法(fa)(fa)(fa)做(zuo)好醫療(liao)物(wu)資(zi)保(bao)(bao)障和(he)(he)境外(wai)(wai)疫(yi)(yi)情(qing)(qing)(qing)(qing)風險(xian)(xian)排(pai)查防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)等(deng)(deng)工(gong)(gong)作(zuo)。舉國資(zi)央企(qi)之(zhi)力,盡(jin)銳出(chu)戰,奮力奪取疫(yi)(yi)情(qing)(qing)(qing)(qing)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)和(he)(he)經(jing)營發(fa)展雙勝利。二是強化(hua)疫(yi)(yi)情(qing)(qing)(qing)(qing)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)復工(gong)(gong)復產法(fa)(fa)(fa)治(zhi)保(bao)(bao)障。召開(kai)專(zhuan)題(ti)會議,對新(xin)冠病(bing)毒疫(yi)(yi)苗研(yan)發(fa)、使用(yong)(yong)、接種(zhong)有關(guan)(guan)法(fa)(fa)(fa)律問題(ti)進行(xing)研(yan)究分析,指(zhi)導(dao)(dao)(dao)(dao)監督相關(guan)(guan)企(qi)業(ye)(ye)依(yi)(yi)法(fa)(fa)(fa)合(he)(he)規(gui)(gui)開(kai)展新(xin)冠病(bing)毒疫(yi)(yi)苗研(yan)發(fa)生(sheng)產和(he)(he)使用(yong)(yong)等(deng)(deng)工(gong)(gong)作(zuo)。督促企(qi)業(ye)(ye)在(zai)做(zuo)好全面防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)和(he)(he)確保(bao)(bao)依(yi)(yi)法(fa)(fa)(fa)合(he)(he)規(gui)(gui)的(de)(de)前提下有序安排(pai)復工(gong)(gong)復產。配合(he)(he)有關(guan)(guan)部門做(zuo)好動物(wu)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)疫(yi)(yi)法(fa)(fa)(fa)、傳染(ran)病(bing)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)治(zhi)法(fa)(fa)(fa)修(xiu)訂工(gong)(gong)作(zuo),開(kai)展野(ye)生(sheng)動物(wu)保(bao)(bao)護領(ling)域法(fa)(fa)(fa)規(gui)(gui)、規(gui)(gui)章、規(gui)(gui)范(fan)性(xing)文件清(qing)理(li)。三是指(zhi)導(dao)(dao)(dao)(dao)中央企(qi)業(ye)(ye)依(yi)(yi)法(fa)(fa)(fa)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)范(fan)涉(she)疫(yi)(yi)風險(xian)(xian)。印發(fa)《關(guan)(guan)于依(yi)(yi)法(fa)(fa)(fa)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)疫(yi)(yi)情(qing)(qing)(qing)(qing)切實防(fang)(fang)(fang)(fang)(fang)(fang)(fang)范(fan)法(fa)(fa)(fa)律合(he)(he)規(gui)(gui)風險(xian)(xian)的(de)(de)通(tong)知(zhi)》等(deng)(deng)制度文件,指(zhi)導(dao)(dao)(dao)(dao)企(qi)業(ye)(ye)加(jia)(jia)強研(yan)判,切實防(fang)(fang)(fang)(fang)(fang)(fang)(fang)范(fan)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)疫(yi)(yi)物(wu)資(zi)出(chu)口、境外(wai)(wai)施工(gong)(gong)等(deng)(deng)法(fa)(fa)(fa)律合(he)(he)規(gui)(gui)風險(xian)(xian)。加(jia)(jia)強對境外(wai)(wai)項(xiang)(xiang)目較多(duo)的(de)(de)能源、建筑類企(qi)業(ye)(ye)依(yi)(yi)法(fa)(fa)(fa)防(fang)(fang)(fang)(fang)(fang)(fang)(fang)控(kong)境外(wai)(wai)疫(yi)(yi)情(qing)(qing)(qing)(qing)工(gong)(gong)作(zuo)的(de)(de)調研(yan)指(zhi)導(dao)(dao)(dao)(dao)。邀請有關(guan)(guan)專(zhuan)家就(jiu)疫(yi)(yi)情(qing)(qing)(qing)(qing)期(qi)間不可(ke)抗力原(yuan)則適用(yong)(yong)和(he)(he)實務(wu)應(ying)對等(deng)(deng)問題(ti)作(zuo)專(zhuan)題(ti)培訓。
(三)強化對權力的制約和監督。一是嚴(yan)格落實依(yi)法(fa)(fa)決策(ce)機(ji)制(zhi)(zhi)。自覺落實《重大(da)行政(zheng)決策(ce)程(cheng)序(xu)暫行條例》,進一步規范(fan)議事程(cheng)序(xu),推進決策(ce)科(ke)學化、民(min)主(zhu)化、法(fa)(fa)治化。強化對(dui)規章(zhang)規范(fan)性文件、中(zhong)(zhong)央企業(ye)章(zhang)程(cheng)、改(gai)(gai)制(zhi)(zhi)重組(zu)方(fang)案(an)等的法(fa)(fa)律(lv)審(shen)(shen)核把(ba)關(guan),完善公(gong)(gong)(gong)平(ping)競爭審(shen)(shen)查機(ji)制(zhi)(zhi)。聘(pin)請11名法(fa)(fa)律(lv)專家擔任法(fa)(fa)律(lv)顧問(wen),發揮法(fa)(fa)律(lv)顧問(wen)制(zhi)(zhi)度積極作(zuo)用。二是自覺接(jie)受(shou)(shou)(shou)人(ren)大(da)監督。認(ren)真落實全國(guo)人(ren)大(da)常(chang)委(wei)(wei)會(hui)(hui)對(dui)企業(ye)國(guo)有(you)(you)(you)資產(chan)管(guan)理(li)情況專項報(bao)告的審(shen)(shen)議意(yi)見(jian),扎實推進整改(gai)(gai)落實。就加強國(guo)有(you)(you)(you)資本經營預算(suan)編報(bao)工(gong)作(zuo)、完善國(guo)有(you)(you)(you)資本經營預算(suan)績效管(guan)理(li)問(wen)題,接(jie)受(shou)(shou)(shou)全國(guo)人(ren)大(da)常(chang)委(wei)(wei)會(hui)(hui)問(wen)詢。配(pei)(pei)合做好(hao)全國(guo)人(ren)大(da)常(chang)委(wei)(wei)會(hui)(hui)領(ling)導同(tong)志到國(guo)資委(wei)(wei)調(diao)(diao)研(yan)工(gong)作(zuo),協(xie)(xie)助組(zu)織(zhi)召(zhao)開企業(ye)國(guo)有(you)(you)(you)資產(chan)管(guan)理(li)情況座談會(hui)(hui)并作(zuo)全面匯報(bao)。三(san)是自覺接(jie)受(shou)(shou)(shou)審(shen)(shen)計(ji)監督。成立由主(zhu)要負責同(tong)志任組(zu)長的審(shen)(shen)計(ji)工(gong)作(zuo)領(ling)導小組(zu),加強對(dui)委(wei)(wei)內審(shen)(shen)計(ji)的組(zu)織(zhi)領(ling)導和統籌協(xie)(xie)調(diao)(diao)。積極支持和配(pei)(pei)合審(shen)(shen)計(ji)署對(dui)國(guo)資委(wei)(wei)2019年預算(suan)執(zhi)行和2020年政(zheng)策(ce)跟(gen)蹤的審(shen)(shen)計(ji),全面提供資料、主(zhu)動(dong)說明情況,及(ji)時(shi)制(zhi)(zhi)定整改(gai)(gai)措施,認(ren)真加以整改(gai)(gai)。堅持上下聯動(dong),及(ji)時(shi)督促指導中(zhong)(zhong)央企業(ye)整改(gai)(gai)審(shen)(shen)計(ji)發現的問(wen)題。四是自覺接(jie)受(shou)(shou)(shou)社會(hui)(hui)監督。認(ren)真落實政(zheng)務(wu)公(gong)(gong)(gong)開有(you)(you)(you)關(guan)要求,規范(fan)做好(hao)信(xin)息公(gong)(gong)(gong)開工(gong)作(zuo)。依(yi)法(fa)(fa)依(yi)規公(gong)(gong)(gong)開中(zhong)(zhong)央企業(ye)經濟運(yun)行情況、經營業(ye)績考核情況等信(xin)息。加強政(zheng)策(ce)解讀力度,全年組(zu)織(zhi)召(zhao)開13場(次(ci))新聞發布活動(dong),主(zhu)動(dong)回應(ying)社會(hui)(hui)關(guan)切。優(you)化信(xin)息公(gong)(gong)(gong)開平(ping)臺(tai)建設(she),規范(fan)政(zheng)務(wu)咨(zi)詢欄目留言辦(ban)理(li)工(gong)作(zuo)程(cheng)序(xu)。落實國(guo)企改(gai)(gai)革三(san)年行動(dong)方(fang)案(an),部署推進中(zhong)(zhong)央企業(ye)信(xin)息公(gong)(gong)(gong)開全覆蓋。
(四)完善國資監管法規制度體系。一是(shi)積(ji)極參與國(guo)家立(li)法(fa)(fa)工(gong)作(zuo)。深入開(kai)展(zhan)(zhan)《公(gong)司法(fa)(fa)》修改(gai)有關問題研究,組織(zhi)起(qi)草(cao)配套辦法(fa)(fa),推動《政務處分法(fa)(fa)》規(gui)定落(luo)(luo)實(shi)落(luo)(luo)地。二是(shi)深入開(kai)展(zhan)(zhan)立(li)改(gai)廢釋工(gong)作(zuo)。編制(zhi)2020年度(du)立(li)法(fa)(fa)工(gong)作(zuo)計劃,加大計劃執行督促落(luo)(luo)實(shi)力度(du),圍繞業績考(kao)核、章程管(guan)理(li)、風險防范(fan)、產權(quan)管(guan)理(li)等重點出(chu)臺規(gui)范(fan)性文(wen)件(jian)(jian)16件(jian)(jian)。深入開(kai)展(zhan)(zhan)規(gui)章規(gui)范(fan)性文(wen)件(jian)(jian)清理(li)。截至2020年底,國(guo)資(zi)委(wei)現行有效(xiao)規(gui)章27件(jian)(jian),規(gui)范(fan)性文(wen)件(jian)(jian)221件(jian)(jian)。三是(shi)加強重大立(li)法(fa)(fa)課(ke)題研究。完成完善國(guo)資(zi)監(jian)(jian)管(guan)法(fa)(fa)規(gui)制(zhi)度(du)體(ti)系(xi)課(ke)題研究項目(mu),明確“十四五”時期健全國(guo)資(zi)監(jian)(jian)管(guan)法(fa)(fa)規(gui)制(zhi)度(du)體(ti)系(xi)的目(mu)標任務。
(五)深入推進法治央企建設。一是(shi)開(kai)(kai)展(zhan)法(fa)治(zhi)央企(qi)(qi)建(jian)設總(zong)結(jie)驗收。全面總(zong)結(jie)5年來法(fa)治(zhi)央企(qi)(qi)建(jian)設成(cheng)效,深入查(cha)找短板(ban)和不足,及(ji)時推動(dong)整改(gai)提升。組織開(kai)(kai)展(zhan)中央企(qi)(qi)業(ye)(ye)優秀總(zong)法(fa)律顧(gu)(gu)問、優秀企(qi)(qi)業(ye)(ye)法(fa)律顧(gu)(gu)問和企(qi)(qi)業(ye)(ye)法(fa)律事(shi)務(wu)先進(jin)工作(zuo)者(zhe)評比表彰,進(jin)一步激發企(qi)(qi)業(ye)(ye)法(fa)務(wu)人員工作(zuo)榮譽感和積極性。二(er)是(shi)強化重點(dian)領(ling)域合(he)規(gui)(gui)管(guan)理(li)(li)。編印(yin)(yin)中央企(qi)(qi)業(ye)(ye)合(he)規(gui)(gui)管(guan)理(li)(li)指(zhi)(zhi)南(nan),指(zhi)(zhi)導企(qi)(qi)業(ye)(ye)切實防范合(he)規(gui)(gui)風險(xian)。三是(shi)夯實糾(jiu)紛案(an)(an)(an)件(jian)管(guan)理(li)(li)。全面分析2019年中央企(qi)(qi)業(ye)(ye)法(fa)律糾(jiu)紛案(an)(an)(an)件(jian)特點(dian)及(ji)原(yuan)因,針對性指(zhi)(zhi)導企(qi)(qi)業(ye)(ye)加(jia)大(da)案(an)(an)(an)件(jian)處(chu)置(zhi)力度。開(kai)(kai)展(zhan)建(jian)筑行業(ye)(ye)企(qi)(qi)業(ye)(ye)案(an)(an)(an)件(jian)管(guan)理(li)(li)“壓存(cun)控增(zeng)、提質(zhi)增(zeng)效”專項(xiang)行動(dong)。印(yin)(yin)發重大(da)案(an)(an)(an)件(jian)督辦函,指(zhi)(zhi)導督促企(qi)(qi)業(ye)(ye)切實維護合(he)法(fa)權益。
(六)扎實開展法治宣傳教育。一(yi)是突出(chu)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)傳教育(yu)重點內容。將(jiang)學(xue)習(xi)領(ling)會習(xi)近平法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)思(si)想(xiang)作(zuo)為重大政(zheng)治(zhi)(zhi)(zhi)任務,切實(shi)發(fa)(fa)揮“關鍵(jian)少數”引領(ling)作(zuo)用,國資(zi)委(wei)(wei)黨委(wei)(wei)帶(dai)頭(tou)認真(zhen)學(xue)習(xi),吃(chi)透(tou)基本(ben)精神、把握核(he)心要義(yi)、扎實(shi)抓好落實(shi)。將(jiang)《民(min)法(fa)(fa)(fa)(fa)典》等(deng)重要法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)納入國資(zi)委(wei)(wei)黨委(wei)(wei)理論學(xue)習(xi)中心組(zu)學(xue)習(xi)重要內容,有力發(fa)(fa)揮領(ling)學(xue)促學(xue)作(zuo)用。將(jiang)國資(zi)監管法(fa)(fa)(fa)(fa)規(gui)(gui)制(zhi)度文(wen)件作(zuo)為法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)傳教育(yu)重要內容,及時通過網站(zhan)、新媒(mei)體(ti)平臺(tai)對外(wai)公開,采取多種形(xing)式加強宣(xuan)傳解讀。二是開展法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)設專(zhuan)題培(pei)(pei)訓。面(mian)向(xiang)國資(zi)委(wei)(wei)系統機關干(gan)(gan)部(bu)(bu),舉辦(ban)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)建(jian)設專(zhuan)題培(pei)(pei)訓班,提升干(gan)(gan)部(bu)(bu)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)意識(shi)。面(mian)向(xiang)中央企業、地方國資(zi)委(wei)(wei)和(he)(he)國有企業,每(mei)兩月舉辦(ban)一(yi)期(qi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)講堂,邀請(qing)專(zhuan)家講授《民(min)法(fa)(fa)(fa)(fa)典》等(deng)法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui),每(mei)期(qi)受眾超過2萬人。三是創新普法(fa)(fa)(fa)(fa)方式方法(fa)(fa)(fa)(fa)。持續提升“互聯網+法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)傳”工作(zuo)效(xiao)能,充分利用門戶官網和(he)(he)微信公眾號等(deng)新媒(mei)體(ti)開展法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)傳教育(yu)。豐富(fu)普法(fa)(fa)(fa)(fa)活動,通過組(zu)織(zhi)國家憲法(fa)(fa)(fa)(fa)日知(zhi)識(shi)競賽、優(you)秀微視頻作(zuo)品征集(ji)、班組(zu)學(xue)習(xi)等(deng)形(xing)式,引導廣大干(gan)(gan)部(bu)(bu)職工不斷(duan)增強法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)意識(shi)和(he)(he)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)能力。
(七)持續加強黨內法規制度建設。一(yi)是(shi)編制(zhi)2020年黨(dang)(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)制(zhi)定(ding)計劃,嚴格規(gui)范(fan)新增(zeng)計劃外項(xiang)目的(de)報批程序(xu),不斷增(zeng)強黨(dang)(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)制(zhi)定(ding)的(de)科(ke)學性(xing)(xing)(xing)、計劃性(xing)(xing)(xing)和(he)嚴肅性(xing)(xing)(xing)。全(quan)年制(zhi)定(ding)黨(dang)(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)6件(jian)(jian)。二(er)是(shi)健(jian)(jian)全(quan)黨(dang)(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)制(zhi)定(ding)機(ji)制(zhi)。落(luo)實中央(yang)黨(dang)(dang)(dang)內法(fa)規(gui)要求,研究起草《國資委(wei)(wei)(wei)黨(dang)(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)制(zhi)定(ding)管理辦法(fa)》,進一(yi)步(bu)明確征求意(yi)見(jian)、前(qian)置(zhi)審核、審議簽批等程序(xu)規(gui)定(ding),不斷健(jian)(jian)全(quan)黨(dang)(dang)(dang)內法(fa)規(gui)工(gong)作制(zhi)度。認真開展黨(dang)(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)審查,按(an)要求做(zuo)好(hao)文(wen)(wen)件(jian)(jian)備(bei)案(an)工(gong)作。三是(shi)加強對中央(yang)企業黨(dang)(dang)(dang)內法(fa)規(gui)制(zhi)度建(jian)設(she)(she)的(de)指導督促(cu)。繼續開展部分中央(yang)企業黨(dang)(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(jian)備(bei)案(an)試(shi)點工(gong)作,將8家(jia)企業列入(ru)試(shi)點,推(tui)動企業黨(dang)(dang)(dang)內法(fa)規(gui)制(zhi)度建(jian)設(she)(she)整體水平進一(yi)步(bu)提(ti)升。
三、存在問題和2021年工作打算
2020年,國(guo)(guo)資委法(fa)治建(jian)設(she)取得了積極成效,但(dan)與黨(dang)中央(yang)、國(guo)(guo)務院(yuan)的(de)要(yao)求以(yi)及國(guo)(guo)資國(guo)(guo)企(qi)改革(ge)發展新(xin)形勢新(xin)要(yao)求相比,還存在著(zhu)一(yi)(yi)些(xie)問題和(he)不(bu)足:一(yi)(yi)是(shi)學(xue)習宣傳習近(jin)平法(fa)治思(si)(si)想還需(xu)(xu)要(yao)進一(yi)(yi)步(bu)深入,廣大(da)干(gan)部職(zhi)工法(fa)治意識和(he)法(fa)律(lv)素養仍(reng)需(xu)(xu)持續(xu)提升,運用(yong)法(fa)治思(si)(si)維和(he)法(fa)治方式開展工作的(de)能(neng)力還需(xu)(xu)要(yao)進一(yi)(yi)步(bu)培(pei)養。二(er)是(shi)國(guo)(guo)資監(jian)管領域(yu)法(fa)律(lv)制(zhi)(zhi)度供(gong)給仍(reng)然不(bu)足,一(yi)(yi)些(xie)重大(da)改革(ge)成果尚未及時制(zhi)(zhi)度化(hua)、法(fa)律(lv)化(hua),法(fa)規(gui)制(zhi)(zhi)度體系還不(bu)夠系統科(ke)學(xue)。三(san)是(shi)國(guo)(guo)資監(jian)管體制(zhi)(zhi)仍(reng)需(xu)(xu)進一(yi)(yi)步(bu)健全,職(zhi)能(neng)轉變重點任務有(you)待(dai)持續(xu)落實(shi),差異化(hua)監(jian)管仍(reng)有(you)差距。四是(shi)企(qi)業法(fa)治建(jian)設(she)工作總(zong)體還不(bu)平衡,中央(yang)企(qi)業子企(qi)業和(he)地(di)方國(guo)(guo)有(you)企(qi)業的(de)法(fa)治建(jian)設(she)仍(reng)較薄弱。
2021年,國(guo)資(zi)委(wei)將(jiang)以習近平(ping)法(fa)(fa)治思想(xiang)為指(zhi)導,持續(xu)落實法(fa)(fa)治政府建(jian)(jian)設(she)各項要(yao)求,重(zhong)點做好(hao)以下工(gong)作:一(yi)是深(shen)入(ru)學習貫徹習近平(ping)法(fa)(fa)治思想(xiang)。籌備(bei)成立“八(ba)五(wu)(wu)”普法(fa)(fa)工(gong)作領導小(xiao)組(zu),在國(guo)資(zi)委(wei)系統深(shen)入(ru)學習宣(xuan)傳習近平(ping)法(fa)(fa)治思想(xiang),加大普法(fa)(fa)力(li)度(du),不(bu)斷增強(qiang)干(gan)部職(zhi)(zhi)工(gong)依法(fa)(fa)行權履職(zhi)(zhi)和(he)(he)依法(fa)(fa)辦事(shi)能(neng)力(li)水平(ping)。二是不(bu)斷完善國(guo)資(zi)監管法(fa)(fa)規(gui)制(zhi)(zhi)度(du)體(ti)系。加強(qiang)前瞻性(xing)(xing)研(yan)(yan)究,推動完善相關法(fa)(fa)律法(fa)(fa)規(gui)。認真研(yan)(yan)究起(qi)草《政務處分法(fa)(fa)》配套辦法(fa)(fa),深(shen)入(ru)開(kai)展(zhan)(zhan)規(gui)章規(gui)范性(xing)(xing)文(wen)件清理(li),適(shi)時開(kai)展(zhan)(zhan)文(wen)件匯編。三是持續(xu)深(shen)化國(guo)資(zi)監管職(zhi)(zhi)能(neng)轉變。全(quan)口徑梳理(li)面向中(zhong)央企(qi)業(ye)(ye)(ye)和(he)(he)地方(fang)國(guo)資(zi)委(wei)的工(gong)作事(shi)項,按照中(zhong)央統一(yi)部署,認真做好(hao)權責清單編制(zhi)(zhi)修訂。加強(qiang)國(guo)資(zi)委(wei)對混合所有制(zhi)(zhi)企(qi)業(ye)(ye)(ye)、股權多元化企(qi)業(ye)(ye)(ye)履行股東職(zhi)(zhi)責的研(yan)(yan)究,進(jin)一(yi)步(bu)規(gui)范履職(zhi)(zhi)程序。四是不(bu)斷深(shen)化中(zhong)央企(qi)業(ye)(ye)(ye)法(fa)(fa)治建(jian)(jian)設(she)。制(zhi)(zhi)定(ding)進(jin)一(yi)步(bu)加強(qiang)中(zhong)央企(qi)業(ye)(ye)(ye)法(fa)(fa)治建(jian)(jian)設(she)的指(zhi)導意見(jian),明確“十四五(wu)(wu)”時期法(fa)(fa)治央企(qi)建(jian)(jian)設(she)總體(ti)思路、目標(biao)和(he)(he)舉措。推動中(zhong)央企(qi)業(ye)(ye)(ye)建(jian)(jian)立健全(quan)合規(gui)管理(li)體(ti)系,切實防(fang)范合規(gui)風險。五(wu)(wu)是推動健全(quan)監督(du)追責體(ti)系,加大重(zhong)大違規(gui)案件查辦和(he)(he)警(jing)示力(li)度(du),不(bu)斷提(ti)升監督(du)效(xiao)能(neng)。
