(二)加強國資國企法治建設的組織領導。深(shen)入研究(jiu)謀劃(hua)國資國企法治(zhi)(zhi)建(jian)設(she)(she)(she)年度(du)工作,確保法治(zhi)(zhi)建(jian)設(she)(she)(she)與其(qi)他重點工作同步(bu)(bu)部署、同步(bu)(bu)推進、同步(bu)(bu)督促。黨(dang)(dang)委(wei)(wei)會(hui)議專題傳(chuan)達學習中央(yang)政法工作會(hui)議精神,研究(jiu)制(zhi)(zhi)定貫徹落(luo)(luo)實措施。嚴格(ge)依法依規(gui)(gui)(gui)決(jue)(jue)策(ce)(ce),健全重大決(jue)(jue)策(ce)(ce)法律(lv)審核機制(zhi)(zhi),加強對規(gui)(gui)(gui)章(zhang)規(gui)(gui)(gui)范(fan)性文(wen)件(jian)(jian)(jian)和黨(dang)(dang)委(wei)(wei)規(gui)(gui)(gui)范(fan)性文(wen)件(jian)(jian)(jian)的審核把(ba)關(guan)。及(ji)時研究(jiu)解決(jue)(jue)法治(zhi)(zhi)建(jian)設(she)(she)(she)重大問題,國資委(wei)(wei)黨(dang)(dang)委(wei)(wei)會(hui)議、委(wei)(wei)務會(hui)議專題審議立法工作計(ji)劃(hua)、黨(dang)(dang)委(wei)(wei)規(gui)(gui)(gui)范(fan)性文(wen)件(jian)(jian)(jian)制(zhi)(zhi)定計(ji)劃(hua)、重要制(zhi)(zhi)度(du)文(wen)件(jian)(jian)(jian)以(yi)及(ji)法治(zhi)(zhi)建(jian)設(she)(she)(she)年度(du)情況報(bao)告等。統籌部署黨(dang)(dang)內法規(gui)(gui)(gui)制(zhi)(zhi)度(du)建(jian)設(she)(she)(she),組(zu)織研究(jiu)制(zhi)(zhi)定黨(dang)(dang)委(wei)(wei)規(gui)(gui)(gui)范(fan)性文(wen)件(jian)(jian)(jian),確保黨(dang)(dang)內法規(gui)(gui)(gui)各項要求在國資委(wei)(wei)系(xi)統落(luo)(luo)實落(luo)(luo)地。
(三)強化對法治建設具體措施的指導督促。受(shou)國(guo)(guo)務(wu)院委托,向全國(guo)(guo)人(ren)大常委會(hui)報(bao)告國(guo)(guo)資(zi)委系統(tong)監管(guan)企(qi)業國(guo)(guo)有資(zi)產管(guan)理情況,認(ren)真接受(shou)人(ren)大監督。部署推動(dong)重要(yao)法(fa)律法(fa)規研究制(zhi)定工(gong)作,多次對配合(he)做好《中華(hua)人(ren)民共和(he)國(guo)(guo)公司法(fa)》(以(yi)下簡(jian)稱《公司法(fa)》)修訂(ding)等(deng)作出批示,組織(zhi)研究起草《中華(hua)人(ren)民共和(he)國(guo)(guo)公職人(ren)員政(zheng)(zheng)務(wu)處分(fen)法(fa)》(以(yi)下簡(jian)稱《政(zheng)(zheng)務(wu)處分(fen)法(fa)》)有關配套規定。專門就(jiu)中央企(qi)業法(fa)治工(gong)作會(hui)議作出批示,對“十四(si)五”時期法(fa)治央企(qi)建設工(gong)作提出明確要(yao)求(qiu)。堅持重視法(fa)治素養和(he)法(fa)治能力(li)(li)的用(yong)人(ren)導向,推動(dong)將“依(yi)法(fa)依(yi)規辦事、制(zhi)度執行能力(li)(li)”等(deng)納入(ru)干部年度考核指標(biao)。
二、2020年法治建設主要舉措和成效
(一)依法全面行權履職。一(yi)是持(chi)續推(tui)(tui)(tui)進(jin)職(zhi)能(neng)轉變重點任務(wu)。加強(qiang)組織推(tui)(tui)(tui)動(dong),建立健全(quan)職(zhi)能(neng)轉變工(gong)(gong)(gong)作(zuo)(zuo)季(ji)報機制(zhi),定期梳(shu)理匯總工(gong)(gong)(gong)作(zuo)(zuo)進(jin)展。全(quan)面(mian)開(kai)(kai)展權(quan)責(ze)清單運行(xing)評估,梳(shu)理調整(zheng)權(quan)責(ze)事(shi)項(xiang),推(tui)(tui)(tui)進(jin)新版(ban)清單編制(zhi)工(gong)(gong)(gong)作(zuo)(zuo)。加大國(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)(zi)本(ben)投(tou)資(zi)(zi)(zi)(zi)、運營(ying)公司授權(quan)放權(quan)工(gong)(gong)(gong)作(zuo)(zuo)力(li)度,推(tui)(tui)(tui)動(dong)優(you)化(hua)運營(ying)模式和經(jing)(jing)營(ying)機制(zhi),更好服務(wu)實(shi)體(ti)經(jing)(jing)濟和科技創新。二是進(jin)一(yi)步加大監(jian)(jian)(jian)(jian)督工(gong)(gong)(gong)作(zuo)(zuo)力(li)度。完(wan)善業(ye)務(wu)監(jian)(jian)(jian)(jian)督、綜合監(jian)(jian)(jian)(jian)督、責(ze)任追究(jiu)三位一(yi)體(ti)的監(jian)(jian)(jian)(jian)督工(gong)(gong)(gong)作(zuo)(zuo)格(ge)局,指導(dao)(dao)推(tui)(tui)(tui)動(dong)中央企(qi)(qi)業(ye)不斷完(wan)善內(nei)控體(ti)系(xi)、內(nei)部審計等制(zhi)度。深(shen)入開(kai)(kai)展國(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產(chan)(chan)重大損(sun)失(shi)調查及違規經(jing)(jing)營(ying)投(tou)資(zi)(zi)(zi)(zi)責(ze)任追究(jiu),嚴防國(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產(chan)(chan)流失(shi)。三是推(tui)(tui)(tui)動(dong)構(gou)建國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)大格(ge)局。組織召開(kai)(kai)構(gou)建國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)大格(ge)局工(gong)(gong)(gong)作(zuo)(zuo)推(tui)(tui)(tui)進(jin)會(hui),印發年度指導(dao)(dao)監(jian)(jian)(jian)(jian)督地方(fang)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)工(gong)(gong)(gong)作(zuo)(zuo)計劃,全(quan)面(mian)部署年度重點工(gong)(gong)(gong)作(zuo)(zuo)。經(jing)(jing)營(ying)性(xing)國(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產(chan)(chan)集中統(tong)(tong)一(yi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)有(you)序推(tui)(tui)(tui)進(jin),省級國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)比例超過91%,全(quan)國(guo)(guo)(guo)(guo)(guo)(guo)24個地方(fang)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)比例超過95%。四是加快(kuai)建設國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)(guo)企(qi)(qi)在(zai)(zai)線(xian)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)系(xi)統(tong)(tong)。國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)(guo)企(qi)(qi)在(zai)(zai)線(xian)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)系(xi)統(tong)(tong)建設取得實(shi)質性(xing)進(jin)展,基本(ben)建成涉(she)企(qi)(qi)事(shi)項(xiang)網上(shang)服務(wu)大廳,35項(xiang)常(chang)規業(ye)務(wu)實(shi)現網上(shang)辦(ban)理,推(tui)(tui)(tui)動(dong)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)向數字(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)、智(zhi)慧監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)轉變。統(tong)(tong)籌推(tui)(tui)(tui)進(jin)全(quan)國(guo)(guo)(guo)(guo)(guo)(guo)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)(guo)企(qi)(qi)在(zai)(zai)線(xian)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)系(xi)統(tong)(tong)建設,促進(jin)形(xing)成上(shang)下(xia)聯動(dong)的信(xin)息化(hua)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)格(ge)局。
(二)在法治軌道上扎實做好疫情防控和復工復產相關工作。一是(shi)(shi)加強(qiang)組織領導(dao)(dao),健全(quan)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)機(ji)制。第一時間(jian)成(cheng)(cheng)立應對疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)領導(dao)(dao)小組,作(zuo)(zuo)(zuo)出(chu)(chu)(chu)全(quan)面部(bu)署,加強(qiang)對國資(zi)(zi)(zi)委(wei)和(he)中(zhong)央企(qi)業(ye)(ye)(ye)疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)的領導(dao)(dao)。多措并舉確保國資(zi)(zi)(zi)委(wei)機(ji)關(guan)和(he)直屬(shu)單位(wei)零(ling)感染(ran),主(zhu)動(dong)作(zuo)(zuo)(zuo)為,及早成(cheng)(cheng)立醫療(liao)物資(zi)(zi)(zi)保障(zhang)專項(xiang)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)組和(he)境(jing)外(wai)疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)指(zhi)導(dao)(dao)組,指(zhi)導(dao)(dao)企(qi)業(ye)(ye)(ye)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)做(zuo)好(hao)醫療(liao)物資(zi)(zi)(zi)保障(zhang)和(he)境(jing)外(wai)疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)風險(xian)排(pai)查防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)等(deng)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)。舉國資(zi)(zi)(zi)央企(qi)之力,盡銳(rui)出(chu)(chu)(chu)戰,奮力奪取疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)和(he)經營發展(zhan)雙勝(sheng)利。二(er)是(shi)(shi)強(qiang)化疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)復(fu)(fu)工(gong)(gong)(gong)(gong)(gong)復(fu)(fu)產(chan)法(fa)(fa)(fa)(fa)(fa)治保障(zhang)。召(zhao)開(kai)專題(ti)會議,對新冠病(bing)毒疫(yi)(yi)(yi)(yi)(yi)苗研(yan)發、使用、接種有(you)關(guan)法(fa)(fa)(fa)(fa)(fa)律問題(ti)進行研(yan)究分析,指(zhi)導(dao)(dao)監督相關(guan)企(qi)業(ye)(ye)(ye)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)合(he)規(gui)(gui)開(kai)展(zhan)新冠病(bing)毒疫(yi)(yi)(yi)(yi)(yi)苗研(yan)發生產(chan)和(he)使用等(deng)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)。督促企(qi)業(ye)(ye)(ye)在做(zuo)好(hao)全(quan)面防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)和(he)確保依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)合(he)規(gui)(gui)的前提下有(you)序安(an)排(pai)復(fu)(fu)工(gong)(gong)(gong)(gong)(gong)復(fu)(fu)產(chan)。配(pei)合(he)有(you)關(guan)部(bu)門做(zuo)好(hao)動(dong)物防(fang)(fang)(fang)(fang)疫(yi)(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)、傳染(ran)病(bing)防(fang)(fang)(fang)(fang)治法(fa)(fa)(fa)(fa)(fa)修訂工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo),開(kai)展(zhan)野生動(dong)物保護領域(yu)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)、規(gui)(gui)章(zhang)、規(gui)(gui)范(fan)(fan)性(xing)文件(jian)清(qing)理。三是(shi)(shi)指(zhi)導(dao)(dao)中(zhong)央企(qi)業(ye)(ye)(ye)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)防(fang)(fang)(fang)(fang)范(fan)(fan)涉疫(yi)(yi)(yi)(yi)(yi)風險(xian)。印發《關(guan)于依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)切實防(fang)(fang)(fang)(fang)范(fan)(fan)法(fa)(fa)(fa)(fa)(fa)律合(he)規(gui)(gui)風險(xian)的通知》等(deng)制度文件(jian),指(zhi)導(dao)(dao)企(qi)業(ye)(ye)(ye)加強(qiang)研(yan)判,切實防(fang)(fang)(fang)(fang)范(fan)(fan)防(fang)(fang)(fang)(fang)疫(yi)(yi)(yi)(yi)(yi)物資(zi)(zi)(zi)出(chu)(chu)(chu)口、境(jing)外(wai)施(shi)工(gong)(gong)(gong)(gong)(gong)等(deng)法(fa)(fa)(fa)(fa)(fa)律合(he)規(gui)(gui)風險(xian)。加強(qiang)對境(jing)外(wai)項(xiang)目(mu)較(jiao)多的能源(yuan)、建筑類企(qi)業(ye)(ye)(ye)依(yi)(yi)(yi)法(fa)(fa)(fa)(fa)(fa)防(fang)(fang)(fang)(fang)控(kong)(kong)(kong)境(jing)外(wai)疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)的調研(yan)指(zhi)導(dao)(dao)。邀(yao)請有(you)關(guan)專家(jia)就疫(yi)(yi)(yi)(yi)(yi)情(qing)(qing)期間(jian)不(bu)可抗力原(yuan)則適用和(he)實務應對等(deng)問題(ti)作(zuo)(zuo)(zuo)專題(ti)培(pei)訓(xun)。
(三)強化對權力的制約和監督。一是嚴格落(luo)實(shi)依(yi)(yi)法(fa)(fa)決(jue)策機(ji)制(zhi)(zhi)。自(zi)(zi)覺落(luo)實(shi)《重大行(xing)(xing)(xing)政(zheng)(zheng)決(jue)策程(cheng)序(xu)暫行(xing)(xing)(xing)條例》,進(jin)(jin)一步規(gui)范(fan)議(yi)事程(cheng)序(xu),推進(jin)(jin)決(jue)策科(ke)學化(hua)(hua)、民主化(hua)(hua)、法(fa)(fa)治(zhi)化(hua)(hua)。強(qiang)化(hua)(hua)對(dui)(dui)規(gui)章(zhang)規(gui)范(fan)性文件、中央(yang)企(qi)業(ye)章(zhang)程(cheng)、改(gai)制(zhi)(zhi)重組(zu)方(fang)案等的(de)(de)法(fa)(fa)律(lv)審核把關,完善公(gong)(gong)平(ping)競爭審查機(ji)制(zhi)(zhi)。聘請11名法(fa)(fa)律(lv)專(zhuan)家擔任法(fa)(fa)律(lv)顧(gu)(gu)問(wen)(wen),發揮法(fa)(fa)律(lv)顧(gu)(gu)問(wen)(wen)制(zhi)(zhi)度(du)積極作(zuo)用。二是自(zi)(zi)覺接(jie)(jie)受(shou)人大監(jian)督。認(ren)真(zhen)落(luo)實(shi)全國(guo)(guo)(guo)人大常委會(hui)對(dui)(dui)企(qi)業(ye)國(guo)(guo)(guo)有資(zi)產管(guan)理(li)(li)情(qing)(qing)況(kuang)(kuang)專(zhuan)項報(bao)告的(de)(de)審議(yi)意見,扎實(shi)推進(jin)(jin)整(zheng)改(gai)落(luo)實(shi)。就(jiu)加(jia)強(qiang)國(guo)(guo)(guo)有資(zi)本經(jing)(jing)(jing)營預(yu)算(suan)編(bian)報(bao)工作(zuo)、完善國(guo)(guo)(guo)有資(zi)本經(jing)(jing)(jing)營預(yu)算(suan)績效管(guan)理(li)(li)問(wen)(wen)題(ti),接(jie)(jie)受(shou)全國(guo)(guo)(guo)人大常委會(hui)問(wen)(wen)詢。配合(he)做(zuo)好(hao)全國(guo)(guo)(guo)人大常委會(hui)領導(dao)同(tong)志(zhi)到(dao)國(guo)(guo)(guo)資(zi)委調(diao)研(yan)工作(zuo),協助組(zu)織(zhi)召開企(qi)業(ye)國(guo)(guo)(guo)有資(zi)產管(guan)理(li)(li)情(qing)(qing)況(kuang)(kuang)座談會(hui)并作(zuo)全面匯報(bao)。三是自(zi)(zi)覺接(jie)(jie)受(shou)審計(ji)監(jian)督。成立由主要(yao)負責同(tong)志(zhi)任組(zu)長(chang)的(de)(de)審計(ji)工作(zuo)領導(dao)小組(zu),加(jia)強(qiang)對(dui)(dui)委內(nei)審計(ji)的(de)(de)組(zu)織(zhi)領導(dao)和統籌協調(diao)。積極支持和配合(he)審計(ji)署(shu)對(dui)(dui)國(guo)(guo)(guo)資(zi)委2019年(nian)(nian)預(yu)算(suan)執行(xing)(xing)(xing)和2020年(nian)(nian)政(zheng)(zheng)策跟蹤(zong)的(de)(de)審計(ji),全面提(ti)供資(zi)料、主動(dong)說明(ming)情(qing)(qing)況(kuang)(kuang),及時制(zhi)(zhi)定(ding)整(zheng)改(gai)措施,認(ren)真(zhen)加(jia)以整(zheng)改(gai)。堅持上下(xia)聯動(dong),及時督促(cu)指導(dao)中央(yang)企(qi)業(ye)整(zheng)改(gai)審計(ji)發現的(de)(de)問(wen)(wen)題(ti)。四是自(zi)(zi)覺接(jie)(jie)受(shou)社(she)(she)會(hui)監(jian)督。認(ren)真(zhen)落(luo)實(shi)政(zheng)(zheng)務公(gong)(gong)開有關要(yao)求(qiu),規(gui)范(fan)做(zuo)好(hao)信息(xi)公(gong)(gong)開工作(zuo)。依(yi)(yi)法(fa)(fa)依(yi)(yi)規(gui)公(gong)(gong)開中央(yang)企(qi)業(ye)經(jing)(jing)(jing)濟(ji)運(yun)行(xing)(xing)(xing)情(qing)(qing)況(kuang)(kuang)、經(jing)(jing)(jing)營業(ye)績考(kao)核情(qing)(qing)況(kuang)(kuang)等信息(xi)。加(jia)強(qiang)政(zheng)(zheng)策解讀力度(du),全年(nian)(nian)組(zu)織(zhi)召開13場(次)新(xin)聞發布活動(dong),主動(dong)回應(ying)社(she)(she)會(hui)關切。優化(hua)(hua)信息(xi)公(gong)(gong)開平(ping)臺建設,規(gui)范(fan)政(zheng)(zheng)務咨詢欄(lan)目留言辦理(li)(li)工作(zuo)程(cheng)序(xu)。落(luo)實(shi)國(guo)(guo)(guo)企(qi)改(gai)革(ge)三年(nian)(nian)行(xing)(xing)(xing)動(dong)方(fang)案,部署(shu)推進(jin)(jin)中央(yang)企(qi)業(ye)信息(xi)公(gong)(gong)開全覆蓋(gai)。
(四)完善國資監管法規制度體系。一(yi)是(shi)積極(ji)參與(yu)國(guo)家(jia)立法(fa)(fa)工作。深入開展(zhan)《公司(si)法(fa)(fa)》修改(gai)有關問(wen)題(ti)研(yan)究,組織起草配套辦法(fa)(fa),推(tui)動《政務(wu)處分法(fa)(fa)》規(gui)定落實落地(di)。二是(shi)深入開展(zhan)立改(gai)廢釋工作。編制2020年度立法(fa)(fa)工作計(ji)劃,加大計(ji)劃執行(xing)督促落實力(li)度,圍繞業績考核(he)、章(zhang)(zhang)程管理、風險(xian)防范、產權管理等重點出臺規(gui)范性文(wen)件(jian)16件(jian)。深入開展(zhan)規(gui)章(zhang)(zhang)規(gui)范性文(wen)件(jian)清理。截至(zhi)2020年底(di),國(guo)資委現行(xing)有效規(gui)章(zhang)(zhang)27件(jian),規(gui)范性文(wen)件(jian)221件(jian)。三是(shi)加強重大立法(fa)(fa)課題(ti)研(yan)究。完成完善國(guo)資監管法(fa)(fa)規(gui)制度體系課題(ti)研(yan)究項目,明確“十四五”時期健全國(guo)資監管法(fa)(fa)規(gui)制度體系的目標(biao)任務(wu)。
(五)深入推進法治央企建設。一是(shi)開展法治(zhi)央(yang)(yang)(yang)(yang)企(qi)(qi)建設總(zong)結(jie)驗(yan)收(shou)。全(quan)面(mian)總(zong)結(jie)5年(nian)來法治(zhi)央(yang)(yang)(yang)(yang)企(qi)(qi)建設成效(xiao),深入查(cha)找短板和(he)不(bu)足,及(ji)時推(tui)動整(zheng)改提升。組(zu)織開展中央(yang)(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)優秀總(zong)法律顧問(wen)、優秀企(qi)(qi)業(ye)(ye)法律顧問(wen)和(he)企(qi)(qi)業(ye)(ye)法律事務(wu)先進工作(zuo)者評比(bi)表彰(zhang),進一步激發(fa)企(qi)(qi)業(ye)(ye)法務(wu)人員工作(zuo)榮(rong)譽感和(he)積極性(xing)。二是(shi)強(qiang)化(hua)重點(dian)領域(yu)合(he)規管理(li)。編(bian)印中央(yang)(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)合(he)規管理(li)指(zhi)南,指(zhi)導企(qi)(qi)業(ye)(ye)切(qie)實(shi)防范合(he)規風險。三是(shi)夯實(shi)糾紛案件(jian)管理(li)。全(quan)面(mian)分析2019年(nian)中央(yang)(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)法律糾紛案件(jian)特點(dian)及(ji)原(yuan)因,針對性(xing)指(zhi)導企(qi)(qi)業(ye)(ye)加大案件(jian)處(chu)置力度。開展建筑(zhu)行業(ye)(ye)企(qi)(qi)業(ye)(ye)案件(jian)管理(li)“壓存(cun)控增(zeng)、提質(zhi)增(zeng)效(xiao)”專(zhuan)項(xiang)行動。印發(fa)重大案件(jian)督(du)辦函(han),指(zhi)導督(du)促企(qi)(qi)業(ye)(ye)切(qie)實(shi)維護合(he)法權益。
(六)扎實開展法治宣傳教育。一(yi)是突出(chu)法(fa)(fa)(fa)(fa)(fa)(fa)治宣傳(chuan)(chuan)教育(yu)重(zhong)(zhong)點(dian)內容。將(jiang)(jiang)學(xue)(xue)(xue)習(xi)(xi)(xi)領(ling)會習(xi)(xi)(xi)近平法(fa)(fa)(fa)(fa)(fa)(fa)治思想作(zuo)(zuo)為(wei)(wei)重(zhong)(zhong)大政治任(ren)務(wu),切實(shi)(shi)發揮“關(guan)鍵(jian)少數”引領(ling)作(zuo)(zuo)用,國資(zi)委黨委帶(dai)頭認真(zhen)學(xue)(xue)(xue)習(xi)(xi)(xi),吃透基本精神、把握核心要義(yi)、扎實(shi)(shi)抓好落實(shi)(shi)。將(jiang)(jiang)《民法(fa)(fa)(fa)(fa)(fa)(fa)典》等重(zhong)(zhong)要法(fa)(fa)(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)(fa)(fa)規納入(ru)國資(zi)委黨委理論學(xue)(xue)(xue)習(xi)(xi)(xi)中心組(zu)學(xue)(xue)(xue)習(xi)(xi)(xi)重(zhong)(zhong)要內容,有力發揮領(ling)學(xue)(xue)(xue)促(cu)學(xue)(xue)(xue)作(zuo)(zuo)用。將(jiang)(jiang)國資(zi)監管法(fa)(fa)(fa)(fa)(fa)(fa)規制度文(wen)件作(zuo)(zuo)為(wei)(wei)法(fa)(fa)(fa)(fa)(fa)(fa)治宣傳(chuan)(chuan)教育(yu)重(zhong)(zhong)要內容,及時通(tong)過(guo)網(wang)站、新媒體(ti)平臺對外公開(kai),采(cai)取多種形式(shi)加強(qiang)(qiang)宣傳(chuan)(chuan)解讀。二是開(kai)展(zhan)法(fa)(fa)(fa)(fa)(fa)(fa)治建設(she)專題培訓(xun)。面向國資(zi)委系統(tong)機關(guan)干部(bu),舉辦法(fa)(fa)(fa)(fa)(fa)(fa)治建設(she)專題培訓(xun)班,提(ti)升干部(bu)法(fa)(fa)(fa)(fa)(fa)(fa)治意識(shi)。面向中央企(qi)業(ye)、地方(fang)國資(zi)委和國有企(qi)業(ye),每兩(liang)月(yue)舉辦一(yi)期(qi)(qi)法(fa)(fa)(fa)(fa)(fa)(fa)治講(jiang)堂,邀(yao)請專家(jia)講(jiang)授《民法(fa)(fa)(fa)(fa)(fa)(fa)典》等法(fa)(fa)(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)(fa)(fa)規,每期(qi)(qi)受眾超過(guo)2萬人。三是創(chuang)新普(pu)法(fa)(fa)(fa)(fa)(fa)(fa)方(fang)式(shi)方(fang)法(fa)(fa)(fa)(fa)(fa)(fa)。持(chi)續提(ti)升“互聯(lian)網(wang)+法(fa)(fa)(fa)(fa)(fa)(fa)治宣傳(chuan)(chuan)”工(gong)作(zuo)(zuo)效能,充分(fen)利用門戶官網(wang)和微信公眾號等新媒體(ti)開(kai)展(zhan)法(fa)(fa)(fa)(fa)(fa)(fa)治宣傳(chuan)(chuan)教育(yu)。豐(feng)富普(pu)法(fa)(fa)(fa)(fa)(fa)(fa)活動,通(tong)過(guo)組(zu)織國家(jia)憲法(fa)(fa)(fa)(fa)(fa)(fa)日知識(shi)競賽、優(you)秀微視頻作(zuo)(zuo)品(pin)征集、班組(zu)學(xue)(xue)(xue)習(xi)(xi)(xi)等形式(shi),引導廣大干部(bu)職工(gong)不斷(duan)增強(qiang)(qiang)法(fa)(fa)(fa)(fa)(fa)(fa)治意識(shi)和法(fa)(fa)(fa)(fa)(fa)(fa)治能力。
(七)持續加強黨內法規制度建設。一(yi)是編制(zhi)(zhi)(zhi)2020年(nian)黨(dang)(dang)委(wei)(wei)(wei)規(gui)(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定計劃(hua),嚴(yan)格(ge)規(gui)(gui)范(fan)新增(zeng)計劃(hua)外項目(mu)的(de)報批程序,不斷(duan)增(zeng)強黨(dang)(dang)委(wei)(wei)(wei)規(gui)(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定的(de)科學(xue)性(xing)(xing)、計劃(hua)性(xing)(xing)和嚴(yan)肅性(xing)(xing)。全(quan)年(nian)制(zhi)(zhi)(zhi)定黨(dang)(dang)委(wei)(wei)(wei)規(gui)(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)6件(jian)(jian)(jian)(jian)(jian)。二(er)是健全(quan)黨(dang)(dang)委(wei)(wei)(wei)規(gui)(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定機(ji)制(zhi)(zhi)(zhi)。落實中央黨(dang)(dang)內法(fa)規(gui)(gui)要求,研究(jiu)起草(cao)《國(guo)資(zi)委(wei)(wei)(wei)黨(dang)(dang)委(wei)(wei)(wei)規(gui)(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定管理辦法(fa)》,進一(yi)步明確征求意見、前(qian)置審核、審議簽批等程序規(gui)(gui)定,不斷(duan)健全(quan)黨(dang)(dang)內法(fa)規(gui)(gui)工作制(zhi)(zhi)(zhi)度。認(ren)真(zhen)開(kai)展(zhan)黨(dang)(dang)委(wei)(wei)(wei)規(gui)(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)審查(cha),按要求做好文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)備(bei)案工作。三是加強對中央企(qi)(qi)業黨(dang)(dang)內法(fa)規(gui)(gui)制(zhi)(zhi)(zhi)度建設(she)的(de)指(zhi)導督促。繼續開(kai)展(zhan)部分中央企(qi)(qi)業黨(dang)(dang)委(wei)(wei)(wei)規(gui)(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)(jian)備(bei)案試(shi)(shi)點工作,將8家企(qi)(qi)業列入試(shi)(shi)點,推動企(qi)(qi)業黨(dang)(dang)內法(fa)規(gui)(gui)制(zhi)(zhi)(zhi)度建設(she)整(zheng)體水平進一(yi)步提升。
三、存在問題和2021年工作打算
2020年,國(guo)資(zi)委(wei)法(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)取得了積(ji)極成效,但與黨中(zhong)央、國(guo)務院的(de)要求以及(ji)國(guo)資(zi)國(guo)企(qi)改革發(fa)展新形勢新要求相比,還存(cun)在著一(yi)些問題和不(bu)(bu)足:一(yi)是學習宣(xuan)傳習近(jin)平(ping)法(fa)(fa)治(zhi)(zhi)思想還需要進(jin)一(yi)步深入,廣大干部職工(gong)法(fa)(fa)治(zhi)(zhi)意識和法(fa)(fa)律(lv)(lv)素養(yang)仍(reng)需持續提升,運用法(fa)(fa)治(zhi)(zhi)思維(wei)和法(fa)(fa)治(zhi)(zhi)方(fang)式(shi)開展工(gong)作的(de)能(neng)力還需要進(jin)一(yi)步培養(yang)。二是國(guo)資(zi)監(jian)(jian)管領域法(fa)(fa)律(lv)(lv)制度供給仍(reng)然不(bu)(bu)足,一(yi)些重(zhong)(zhong)大改革成果尚未及(ji)時(shi)制度化、法(fa)(fa)律(lv)(lv)化,法(fa)(fa)規制度體系還不(bu)(bu)夠系統科學。三是國(guo)資(zi)監(jian)(jian)管體制仍(reng)需進(jin)一(yi)步健全,職能(neng)轉變(bian)重(zhong)(zhong)點(dian)任務有(you)待持續落(luo)實,差(cha)異化監(jian)(jian)管仍(reng)有(you)差(cha)距。四是企(qi)業(ye)(ye)(ye)法(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)工(gong)作總體還不(bu)(bu)平(ping)衡,中(zhong)央企(qi)業(ye)(ye)(ye)子企(qi)業(ye)(ye)(ye)和地方(fang)國(guo)有(you)企(qi)業(ye)(ye)(ye)的(de)法(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)仍(reng)較(jiao)薄(bo)弱(ruo)。
2021年,國(guo)資(zi)(zi)(zi)委將(jiang)以(yi)習近平法(fa)(fa)(fa)(fa)治思(si)(si)想為指導(dao)(dao),持(chi)續落實(shi)法(fa)(fa)(fa)(fa)治政府建設(she)各項(xiang)要求,重(zhong)點做好以(yi)下工(gong)作:一(yi)是(shi)深(shen)(shen)入(ru)(ru)學習貫徹習近平法(fa)(fa)(fa)(fa)治思(si)(si)想。籌(chou)備(bei)成立“八(ba)五(wu)”普法(fa)(fa)(fa)(fa)工(gong)作領導(dao)(dao)小(xiao)組(zu),在國(guo)資(zi)(zi)(zi)委系統(tong)深(shen)(shen)入(ru)(ru)學習宣(xuan)傳(chuan)習近平法(fa)(fa)(fa)(fa)治思(si)(si)想,加(jia)大普法(fa)(fa)(fa)(fa)力(li)(li)度,不(bu)斷(duan)增(zeng)強(qiang)干部(bu)職工(gong)依法(fa)(fa)(fa)(fa)行權履(lv)職和(he)依法(fa)(fa)(fa)(fa)辦(ban)事(shi)能(neng)(neng)力(li)(li)水平。二(er)是(shi)不(bu)斷(duan)完(wan)善國(guo)資(zi)(zi)(zi)監(jian)管法(fa)(fa)(fa)(fa)規(gui)制度體系。加(jia)強(qiang)前瞻性(xing)研(yan)究(jiu),推(tui)(tui)動完(wan)善相關法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)。認(ren)真(zhen)研(yan)究(jiu)起(qi)草(cao)《政務處分(fen)法(fa)(fa)(fa)(fa)》配(pei)套(tao)辦(ban)法(fa)(fa)(fa)(fa),深(shen)(shen)入(ru)(ru)開展(zhan)規(gui)章(zhang)規(gui)范性(xing)文件清理,適時開展(zhan)文件匯編。三是(shi)持(chi)續深(shen)(shen)化(hua)國(guo)資(zi)(zi)(zi)監(jian)管職能(neng)(neng)轉變(bian)。全口(kou)徑梳(shu)理面向中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)和(he)地方國(guo)資(zi)(zi)(zi)委的工(gong)作事(shi)項(xiang),按(an)照中(zhong)(zhong)央(yang)(yang)統(tong)一(yi)部(bu)署,認(ren)真(zhen)做好權責(ze)清單編制修(xiu)訂。加(jia)強(qiang)國(guo)資(zi)(zi)(zi)委對混合所(suo)有制企業(ye)(ye)、股權多元化(hua)企業(ye)(ye)履(lv)行股東職責(ze)的研(yan)究(jiu),進一(yi)步規(gui)范履(lv)職程序(xu)。四是(shi)不(bu)斷(duan)深(shen)(shen)化(hua)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)法(fa)(fa)(fa)(fa)治建設(she)。制定進一(yi)步加(jia)強(qiang)中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)法(fa)(fa)(fa)(fa)治建設(she)的指導(dao)(dao)意(yi)見,明(ming)確“十四五(wu)”時期法(fa)(fa)(fa)(fa)治央(yang)(yang)企建設(she)總體思(si)(si)路、目標和(he)舉措。推(tui)(tui)動中(zhong)(zhong)央(yang)(yang)企業(ye)(ye)建立健全合規(gui)管理體系,切實(shi)防(fang)范合規(gui)風險。五(wu)是(shi)推(tui)(tui)動健全監(jian)督追責(ze)體系,加(jia)大重(zhong)大違規(gui)案件查辦(ban)和(he)警示力(li)(li)度,不(bu)斷(duan)提升(sheng)監(jian)督效能(neng)(neng)。
