《關于提高國有企業病(bing)退職工待遇修改相關條款的建(jian)議》(第(di)1977號)收悉(xi),經商人力資(zi)源社會保障部、財政(zheng)部,現答復如下:
一、基本情況
黨中央、國務(wu)院歷來高(gao)度重視人民(min)群(qun)眾的(de)(de)醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)保障(zhang)(zhang)工(gong)(gong)作,《中共中央 國務(wu)院關(guan)于(yu)深化醫(yi)(yi)(yi)(yi)(yi)藥衛生體制(zhi)(zhi)改革的(de)(de)意見》(中發(fa)〔2009〕6號)提(ti)出,要加快(kuai)建立和完(wan)(wan)善(shan)以(yi)基(ji)本醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)保障(zhang)(zhang)為(wei)主體,其他多種形式補充醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)保險(xian)和商(shang)業健(jian)康保險(xian)為(wei)補充,覆(fu)蓋(gai)城(cheng)鄉居民(min)的(de)(de)多層(ceng)次醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)保障(zhang)(zhang)體系(xi)。《國務(wu)院關(guan)于(yu)印發(fa)“十三五”深化醫(yi)(yi)(yi)(yi)(yi)藥衛生體制(zhi)(zhi)改革規劃的(de)(de)通知》(國發(fa)〔2016〕78號)規定(ding),要按照保基(ji)本、兜底線(xian)、可持(chi)續的(de)(de)原則,建立起(qi)較為(wei)完(wan)(wan)善(shan)的(de)(de)基(ji)本醫(yi)(yi)(yi)(yi)(yi)保、大(da)病保險(xian)、醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)救(jiu)(jiu)助(zhu)(zhu)、疾(ji)病應急救(jiu)(jiu)助(zhu)(zhu)、商(shang)業健(jian)康保險(xian)和慈(ci)善(shan)救(jiu)(jiu)助(zhu)(zhu)銜接互(hu)動、相(xiang)互(hu)聯通機制(zhi)(zhi)。健(jian)全(quan)重特大(da)疾(ji)病保障(zhang)(zhang)機制(zhi)(zhi),在全(quan)面(mian)(mian)實(shi)施(shi)(shi)城(cheng)鄉居民(min)大(da)病保險(xian)基(ji)礎上,采取降低起(qi)付線(xian)、提(ti)高(gao)報銷比(bi)例、合(he)理確定(ding)合(he)規醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)費用范(fan)圍(wei)等措施(shi)(shi),提(ti)高(gao)大(da)病保險(xian)對(dui)困難群(qun)眾支付的(de)(de)精準性。完(wan)(wan)善(shan)職工(gong)(gong)補充醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)保險(xian)政策,全(quan)面(mian)(mian)開展重特大(da)疾(ji)病醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)救(jiu)(jiu)助(zhu)(zhu)工(gong)(gong)作,將低收入(ru)救(jiu)(jiu)助(zhu)(zhu)對(dui)象(xiang)以(yi)及因(yin)病致貧家庭重病患者納入(ru)救(jiu)(jiu)助(zhu)(zhu)范(fan)圍(wei),發(fa)揮托(tuo)底保障(zhang)(zhang)作用。在國家規定(ding)的(de)(de)政策范(fan)圍(wei)內,各省(區、市(shi))也(ye)(ye)出臺了城(cheng)鄉居民(min)醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)保障(zhang)(zhang)方面(mian)(mian)的(de)(de)政策規定(ding)。這(zhe)些(xie)政策也(ye)(ye)適用于(yu)國有(you)(you)企(qi)業職工(gong)(gong),對(dui)提(ti)高(gao)國有(you)(you)企(qi)業職工(gong)(gong)醫(yi)(yi)(yi)(yi)(yi)療(liao)(liao)(liao)(liao)保障(zhang)(zhang)水平,解決(jue)因(yin)病致貧等問題,具有(you)(you)積極作用。
二、關于國(guo)有企業病退(tui)職工待遇的有關問題
(一)關(guan)于職工患病期間工資待遇問題。
根(gen)(gen)據(ju)原勞(lao)(lao)(lao)動(dong)部(bu)(bu)(bu)《關于(yu)發(fa)布<企業(ye)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)患(huan)(huan)病(bing)(bing)(bing)(bing)(bing)或(huo)(huo)(huo)(huo)非因工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)負傷醫(yi)(yi)療(liao)期(qi)(qi)規(gui)定(ding)(ding)(ding)(ding)(ding)>的(de)(de)(de)(de)(de)(de)通(tong)(tong)知》(勞(lao)(lao)(lao)部(bu)(bu)(bu)發(fa)〔1994〕479號(hao))和(he)(he)(he)《關于(yu)貫徹<企業(ye)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)患(huan)(huan)病(bing)(bing)(bing)(bing)(bing)或(huo)(huo)(huo)(huo)非因工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)負傷醫(yi)(yi)療(liao)期(qi)(qi)規(gui)定(ding)(ding)(ding)(ding)(ding)>的(de)(de)(de)(de)(de)(de)通(tong)(tong)知》(勞(lao)(lao)(lao)部(bu)(bu)(bu)發(fa)〔1995〕236號(hao)),職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)患(huan)(huan)病(bing)(bing)(bing)(bing)(bing)或(huo)(huo)(huo)(huo)非因工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)負傷,根(gen)(gen)據(ju)本人(ren)(ren)實(shi)際參(can)加(jia)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作年(nian)限(xian)和(he)(he)(he)本企業(ye)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)作年(nian)限(xian)長(chang)短,享受3-24個月的(de)(de)(de)(de)(de)(de)醫(yi)(yi)療(liao)期(qi)(qi)。對于(yu)某些患(huan)(huan)特殊疾(ji)病(bing)(bing)(bing)(bing)(bing)(如癌癥、精神病(bing)(bing)(bing)(bing)(bing)、癱瘓等)的(de)(de)(de)(de)(de)(de)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong),在24個月內尚(shang)不(bu)能(neng)痊愈的(de)(de)(de)(de)(de)(de),經企業(ye)和(he)(he)(he)當(dang)(dang)地(di)(di)(di)勞(lao)(lao)(lao)動(dong)部(bu)(bu)(bu)門批準(zhun)(zhun)(zhun),可以(yi)適(shi)當(dang)(dang)延(yan)長(chang)醫(yi)(yi)療(liao)期(qi)(qi)。根(gen)(gen)據(ju)原勞(lao)(lao)(lao)動(dong)部(bu)(bu)(bu)《關于(yu)貫徹執行(xing)<中華(hua)人(ren)(ren)民(min)(min)共和(he)(he)(he)國(guo)勞(lao)(lao)(lao)動(dong)法>若干問題(ti)的(de)(de)(de)(de)(de)(de)意見(jian)》(勞(lao)(lao)(lao)部(bu)(bu)(bu)發(fa)〔1995〕309號(hao)),職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)患(huan)(huan)病(bing)(bing)(bing)(bing)(bing)或(huo)(huo)(huo)(huo)非因工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)負傷治療(liao)期(qi)(qi)間(jian)(jian),在規(gui)定(ding)(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)醫(yi)(yi)療(liao)期(qi)(qi)間(jian)(jian)由企業(ye)按有關規(gui)定(ding)(ding)(ding)(ding)(ding)支付其病(bing)(bing)(bing)(bing)(bing)假(jia)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)或(huo)(huo)(huo)(huo)疾(ji)病(bing)(bing)(bing)(bing)(bing)救濟費,病(bing)(bing)(bing)(bing)(bing)假(jia)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)或(huo)(huo)(huo)(huo)疾(ji)病(bing)(bing)(bing)(bing)(bing)救濟費可以(yi)低(di)(di)(di)于(yu)當(dang)(dang)地(di)(di)(di)最(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)標準(zhun)(zhun)(zhun)支付,但不(bu)能(neng)低(di)(di)(di)于(yu)最(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)標準(zhun)(zhun)(zhun)的(de)(de)(de)(de)(de)(de)80%。目前,病(bing)(bing)(bing)(bing)(bing)假(jia)期(qi)(qi)間(jian)(jian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)待(dai)遇(yu)的(de)(de)(de)(de)(de)(de)具體標準(zhun)(zhun)(zhun),由各地(di)(di)(di)人(ren)(ren)民(min)(min)政府(fu)結合(he)當(dang)(dang)地(di)(di)(di)實(shi)際制定(ding)(ding)(ding)(ding)(ding),企業(ye)可根(gen)(gen)據(ju)自(zi)身的(de)(de)(de)(de)(de)(de)經營情(qing)況,在不(bu)低(di)(di)(di)于(yu)當(dang)(dang)地(di)(di)(di)法定(ding)(ding)(ding)(ding)(ding)標準(zhun)(zhun)(zhun)的(de)(de)(de)(de)(de)(de)情(qing)況下(xia),確定(ding)(ding)(ding)(ding)(ding)本企業(ye)的(de)(de)(de)(de)(de)(de)標準(zhun)(zhun)(zhun),如廣東省(sheng)(sheng)(sheng)、江蘇(su)省(sheng)(sheng)(sheng)、北京市(shi)(shi)等省(sheng)(sheng)(sheng)市(shi)(shi)規(gui)定(ding)(ding)(ding)(ding)(ding),勞(lao)(lao)(lao)動(dong)者在國(guo)家規(gui)定(ding)(ding)(ding)(ding)(ding)醫(yi)(yi)療(liao)期(qi)(qi)內的(de)(de)(de)(de)(de)(de),用(yong)(yong)人(ren)(ren)單(dan)位應(ying)(ying)當(dang)(dang)按照勞(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)、集體合(he)同(tong)(tong)的(de)(de)(de)(de)(de)(de)約(yue)定(ding)(ding)(ding)(ding)(ding)或(huo)(huo)(huo)(huo)者國(guo)家有關規(gui)定(ding)(ding)(ding)(ding)(ding),向勞(lao)(lao)(lao)動(dong)者支付病(bing)(bing)(bing)(bing)(bing)假(jia)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)或(huo)(huo)(huo)(huo)者疾(ji)病(bing)(bing)(bing)(bing)(bing)救濟費;陜(shan)西(xi)省(sheng)(sheng)(sheng)、深圳市(shi)(shi)、青島市(shi)(shi)等省(sheng)(sheng)(sheng)市(shi)(shi)規(gui)定(ding)(ding)(ding)(ding)(ding)用(yong)(yong)人(ren)(ren)單(dan)位應(ying)(ying)當(dang)(dang)按照不(bu)低(di)(di)(di)于(yu)本人(ren)(ren)標準(zhun)(zhun)(zhun)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(或(huo)(huo)(huo)(huo)勞(lao)(lao)(lao)動(dong)合(he)同(tong)(tong)約(yue)定(ding)(ding)(ding)(ding)(ding)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)標準(zhun)(zhun)(zhun))的(de)(de)(de)(de)(de)(de)60%-70%支付員工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)病(bing)(bing)(bing)(bing)(bing)傷假(jia)期(qi)(qi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)。這些規(gui)定(ding)(ding)(ding)(ding)(ding)也(ye)適(shi)用(yong)(yong)于(yu)國(guo)有企業(ye)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)。您在建議中提出的(de)(de)(de)(de)(de)(de)進(jin)一(yi)步(bu)出臺(tai)較為詳細的(de)(de)(de)(de)(de)(de)實(shi)施細則和(he)(he)(he)辦法等問題(ti),我(wo)們(men)將(jiang)積極建議業(ye)務主管部(bu)(bu)(bu)門進(jin)行(xing)研究,在國(guo)家政策(ce)范圍(wei)內,指導國(guo)有企業(ye)合(he)理(li)確定(ding)(ding)(ding)(ding)(ding)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)患(huan)(huan)病(bing)(bing)(bing)(bing)(bing)期(qi)(qi)間(jian)(jian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)待(dai)遇(yu)。同(tong)(tong)時,鼓勵企業(ye)將(jiang)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)患(huan)(huan)病(bing)(bing)(bing)(bing)(bing)期(qi)(qi)間(jian)(jian)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)標準(zhun)(zhun)(zhun)作為集體協商的(de)(de)(de)(de)(de)(de)內容。
(二)關于加強國有(you)企業患病(bing)職工醫(yi)療保險(xian)保障力度問題。
按照目前政策,國(guo)有(you)企(qi)業(ye)(ye)職(zhi)(zhi)工(gong)(gong)(gong)(gong)通過(guo)參加職(zhi)(zhi)工(gong)(gong)(gong)(gong)醫(yi)(yi)保(bao)(bao)(bao)獲得(de)基本醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)障(zhang)。對(dui)(dui)(dui)于職(zhi)(zhi)工(gong)(gong)(gong)(gong)醫(yi)(yi)保(bao)(bao)(bao)報(bao)銷外(wai)的(de)(de)(de)(de)費(fei)用(yong),其所在(zai)(zai)單位還可(ke)通過(guo)為其購買商(shang)業(ye)(ye)醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)險或(huo)(huo)建(jian)立(li)補(bu)充(chong)醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)險等(deng)方式給予補(bu)充(chong)保(bao)(bao)(bao)障(zhang)。企(qi)業(ye)(ye)根據國(guo)家(jia)有(you)關政策規定,為在(zai)(zai)本企(qi)業(ye)(ye)任職(zhi)(zhi)或(huo)(huo)者(zhe)受(shou)雇的(de)(de)(de)(de)全體(ti)員工(gong)(gong)(gong)(gong)支付的(de)(de)(de)(de)補(bu)充(chong)醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)險費(fei),在(zai)(zai)不(bu)(bu)超過(guo)職(zhi)(zhi)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資總額(e)5%標準(zhun)內的(de)(de)(de)(de)部分,在(zai)(zai)計算應納稅所得(de)額(e)時準(zhun)予扣除。同(tong)時根據《國(guo)務院(yuan)辦公廳轉(zhuan)發(fa)民(min)政部等(deng)部門關于進(jin)一步完(wan)善(shan)醫(yi)(yi)療(liao)(liao)救(jiu)助(zhu)制度(du)全面開展(zhan)(zhan)重(zhong)(zhong)特(te)大疾病(bing)(bing)醫(yi)(yi)療(liao)(liao)救(jiu)助(zhu)工(gong)(gong)(gong)(gong)作意見的(de)(de)(de)(de)通知》(國(guo)辦發(fa)〔2015〕30號),可(ke)對(dui)(dui)(dui)發(fa)生(sheng)高(gao)額(e)醫(yi)(yi)療(liao)(liao)費(fei)用(yong)、超過(guo)家(jia)庭(ting)承受(shou)能(neng)力(li)、基本生(sheng)活出(chu)現(xian)嚴重(zhong)(zhong)困難(nan)家(jia)庭(ting)中的(de)(de)(de)(de)重(zhong)(zhong)病(bing)(bing)患(huan)者(zhe)實施救(jiu)助(zhu),對(dui)(dui)(dui)重(zhong)(zhong)點救(jiu)助(zhu)對(dui)(dui)(dui)象和低收入救(jiu)助(zhu)對(dui)(dui)(dui)象經基本醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)險、城(cheng)鄉居民(min)大病(bing)(bing)保(bao)(bao)(bao)險及各類補(bu)充(chong)醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)險、商(shang)業(ye)(ye)保(bao)(bao)(bao)險等(deng)報(bao)銷后個人負(fu)擔的(de)(de)(de)(de)合(he)規醫(yi)(yi)療(liao)(liao)費(fei)用(yong),直接予以(yi)救(jiu)助(zhu),多數省(區、市)也相應出(chu)臺了因(yin)病(bing)(bing)致(zhi)貧家(jia)庭(ting)醫(yi)(yi)療(liao)(liao)救(jiu)助(zhu)辦法。此外(wai),對(dui)(dui)(dui)于符(fu)合(he)條(tiao)件的(de)(de)(de)(de)特(te)殊(shu)困難(nan)職(zhi)(zhi)工(gong)(gong)(gong)(gong),還可(ke)申請全國(guo)總工(gong)(gong)(gong)(gong)會(hui)等(deng)開展(zhan)(zhan)的(de)(de)(de)(de)職(zhi)(zhi)工(gong)(gong)(gong)(gong)醫(yi)(yi)療(liao)(liao)互助(zhu)幫扶(fu)。總體(ti)上看,伴(ban)隨著醫(yi)(yi)療(liao)(liao)衛生(sheng)事業(ye)(ye)的(de)(de)(de)(de)發(fa)展(zhan)(zhan)和醫(yi)(yi)療(liao)(liao)改革的(de)(de)(de)(de)深化,我國(guo)醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)障(zhang)體(ti)系不(bu)(bu)斷完(wan)善(shan),現(xian)行制度(du)已經為國(guo)有(you)企(qi)業(ye)(ye)患(huan)病(bing)(bing)職(zhi)(zhi)工(gong)(gong)(gong)(gong)醫(yi)(yi)療(liao)(liao)費(fei)用(yong)提(ti)供了解決(jue)渠道,對(dui)(dui)(dui)保(bao)(bao)(bao)障(zhang)國(guo)有(you)企(qi)業(ye)(ye)職(zhi)(zhi)工(gong)(gong)(gong)(gong)的(de)(de)(de)(de)身體(ti)健康(kang)起到了重(zhong)(zhong)要作用(yong)。您(nin)提(ti)出(chu)的(de)(de)(de)(de)建(jian)立(li)大病(bing)(bing)醫(yi)(yi)療(liao)(liao)救(jiu)助(zhu)基金等(deng)建(jian)議,我們將積極配合(he)業(ye)(ye)務主管(guan)部門,通過(guo)完(wan)善(shan)現(xian)有(you)制度(du),提(ti)升(sheng)包括國(guo)有(you)企(qi)業(ye)(ye)患(huan)病(bing)(bing)職(zhi)(zhi)工(gong)(gong)(gong)(gong)在(zai)(zai)內的(de)(de)(de)(de)參保(bao)(bao)(bao)職(zhi)(zhi)工(gong)(gong)(gong)(gong)基本醫(yi)(yi)療(liao)(liao)保(bao)(bao)(bao)障(zhang)水平,將其個人負(fu)擔控(kong)制在(zai)(zai)家(jia)庭(ting)可(ke)承受(shou)范圍內。
(三)關于完善(shan)國有企業職(zhi)工退(tui)休政策問(wen)題。
社(she)(she)會(hui)保(bao)(bao)險(xian)遵循(xun)權利(li)義務(wu)(wu)相(xiang)對(dui)應(ying)的(de)(de)原則,單位和(he)(he)個(ge)人(ren)應(ying)依法(fa)(fa)繳納社(she)(she)會(hui)保(bao)(bao)險(xian)費,才能享受(shou)相(xiang)應(ying)的(de)(de)社(she)(she)會(hui)保(bao)(bao)險(xian)待遇。《中華人(ren)民共和(he)(he)國(guo)(guo)社(she)(she)會(hui)保(bao)(bao)險(xian)法(fa)(fa)》規(gui)定(ding)(ding),參加基本(ben)(ben)養老保(bao)(bao)險(xian)的(de)(de)個(ge)人(ren),達到法(fa)(fa)定(ding)(ding)退(tui)(tui)休(xiu)(xiu)年齡時(shi)累計繳費滿(man)十五年的(de)(de),按月領取(qu)基本(ben)(ben)養老金。根據1953年修訂的(de)(de)《中華人(ren)民共和(he)(he)國(guo)(guo)勞(lao)(lao)(lao)動(dong)保(bao)(bao)險(xian)條(tiao)例》和(he)(he)《國(guo)(guo)務(wu)(wu)院(yuan)(yuan)關于頒發<國(guo)(guo)務(wu)(wu)院(yuan)(yuan)關于安置老弱(ruo)病(bing)(bing)殘(can)干(gan)部(bu)(bu)暫行辦(ban)法(fa)(fa)>和(he)(he)<國(guo)(guo)務(wu)(wu)院(yuan)(yuan)關于工(gong)人(ren)退(tui)(tui)休(xiu)(xiu)、退(tui)(tui)職(zhi)的(de)(de)暫行辦(ban)法(fa)(fa)>的(de)(de)通知(zhi)》(國(guo)(guo)發〔1978〕104號(hao)(hao)),企業(ye)(ye)職(zhi)工(gong)男60周(zhou)歲(sui)、女(nv)干(gan)部(bu)(bu)55周(zhou)歲(sui)、女(nv)工(gong)人(ren)50周(zhou)歲(sui)應(ying)當退(tui)(tui)休(xiu)(xiu);同時(shi),因(yin)病(bing)(bing)或(huo)非(fei)因(yin)工(gong)致(zhi)殘(can)、由(you)醫(yi)院(yuan)(yuan)證明并經勞(lao)(lao)(lao)動(dong)鑒定(ding)(ding)委員會(hui)確(que)認完全喪失(shi)勞(lao)(lao)(lao)動(dong)能力(li)的(de)(de),退(tui)(tui)休(xiu)(xiu)年齡為(wei)男滿(man)50周(zhou)歲(sui)、女(nv)滿(man)45周(zhou)歲(sui)。參加企業(ye)(ye)職(zhi)工(gong)基本(ben)(ben)養老保(bao)(bao)險(xian)的(de)(de)國(guo)(guo)有(you)企業(ye)(ye)職(zhi)工(gong),符合條(tiao)件的(de)(de)可以辦(ban)理病(bing)(bing)退(tui)(tui),按月領取(qu)基本(ben)(ben)養老金。關于病(bing)(bing)退(tui)(tui)鑒定(ding)(ding)問題(ti),根據原勞(lao)(lao)(lao)動(dong)部(bu)(bu)《關于印發<職(zhi)工(gong)非(fei)因(yin)工(gong)傷殘(can)或(huo)因(yin)病(bing)(bing)喪失(shi)勞(lao)(lao)(lao)動(dong)能力(li)程度鑒定(ding)(ding)標(biao)(biao)準(zhun)(試行)>的(de)(de)通知(zhi)》(勞(lao)(lao)(lao)社(she)(she)部(bu)(bu)發〔2002〕8號(hao)(hao)),勞(lao)(lao)(lao)動(dong)者由(you)于非(fei)因(yin)工(gong)傷殘(can)或(huo)因(yin)病(bing)(bing)后,于醫(yi)療期滿(man)或(huo)醫(yi)療終結時(shi)對(dui)傷殘(can)失(shi)能程度做出判定(ding)(ding)結論的(de)(de)準(zhun)則和(he)(he)依據,統一了(le)分類(lei)標(biao)(biao)準(zhun),明確(que)了(le)病(bing)(bing)退(tui)(tui)條(tiao)件,規(gui)范了(le)病(bing)(bing)退(tui)(tui)鑒定(ding)(ding)工(gong)作(zuo)。您提(ti)出的(de)(de)建立養老保(bao)(bao)險(xian)基金補償機制、改(gai)革病(bing)(bing)退(tui)(tui)工(gong)作(zuo)管(guan)(guan)理模式等建議,我們將(jiang)積(ji)極配(pei)合業(ye)(ye)務(wu)(wu)主管(guan)(guan)部(bu)(bu)門,進一步研(yan)究完善(shan)相(xiang)關政策。
