國務院國資委印發《中央企業工資總額管理辦法》

國(guo)務院國(guo)資委近日印發《中央(yang)企業工資總額(e)管理辦法》(國(guo)資委令第39號,以下簡稱(cheng)《辦法》)。

《辦法(fa)》以(yi)習(xi)近平新(xin)時代(dai)中國特色社會主義思想為(wei)(wei)指引,以(yi)建(jian)立健全與勞(lao)動(dong)(dong)力(li)市場基(ji)本(ben)適應、與企業經(jing)濟(ji)效益(yi)和(he)勞(lao)動(dong)(dong)生產率掛鉤(gou)的工資決(jue)定和(he)正常增(zeng)長機制(zhi),增(zeng)強(qiang)企業活力(li)和(he)動(dong)(dong)力(li),促進企業實現(xian)高質量發展,推動(dong)(dong)國有資本(ben)做(zuo)強(qiang)做(zuo)優做(zuo)大(da)為(wei)(wei)目標(biao),以(yi)出資人管資本(ben)為(wei)(wei)主強(qiang)化激勵約束建(jian)設為(wei)(wei)遵循,按(an)照(zhao)《國務院關于改革國有企業工資決(jue)定機制(zhi)的意(yi)見》(國發〔2018〕16號,以(yi)下簡稱(cheng)《意(yi)見》)精(jing)神,在繼(ji)承以(yi)往(wang)有效經(jing)驗和(he)做(zuo)法(fa)的基(ji)礎上(shang),對現(xian)行中央企業工資總額管理相關制(zhi)度辦法(fa)進行修改和(he)完善。

《辦法》明確對中(zhong)央(yang)(yang)企(qi)業(ye)(ye)工資總額實(shi)行(xing)(xing)分類(lei)(lei)管(guan)理。對主業(ye)(ye)處于(yu)充分競(jing)爭(zheng)行(xing)(xing)業(ye)(ye)和領域的商(shang)業(ye)(ye)類(lei)(lei)中(zhong)央(yang)(yang)企(qi)業(ye)(ye)工資總額預算原則上全部實(shi)行(xing)(xing)備案(an)制(zhi)管(guan)理,由企(qi)業(ye)(ye)董事(shi)會(hui)在依(yi)法依(yi)規(gui)的前(qian)提(ti)下,自(zi)主決定年(nian)度工資總額預算,國(guo)資委由事(shi)前(qian)核準(zhun)轉變(bian)為事(shi)前(qian)引導、事(shi)中(zhong)監(jian)測和事(shi)后監(jian)督;對主業(ye)(ye)處于(yu)關系國(guo)家安全、國(guo)民經濟命脈的重(zhong)要行(xing)(xing)業(ye)(ye)和關鍵領域、主要承擔重(zhong)大專項(xiang)任(ren)務的商(shang)業(ye)(ye)類(lei)(lei)中(zhong)央(yang)(yang)企(qi)業(ye)(ye)和以提(ti)供公(gong)共(gong)產(chan)品或(huo)服務為主的公(gong)益類(lei)(lei)中(zhong)央(yang)(yang)企(qi)業(ye)(ye),工資總額預算繼續實(shi)行(xing)(xing)核準(zhun)制(zhi)管(guan)理;對開展國(guo)有資本(ben)投資、運營公(gong)司或(huo)者混合(he)所有制(zhi)改革等(deng)試點的中(zhong)央(yang)(yang)企(qi)業(ye)(ye),提(ti)出可以探索實(shi)行(xing)(xing)更加靈活高效的工資總額管(guan)理方(fang)式(shi)。

《辦(ban)法》明(ming)確(que)對中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額實行分級(ji)管(guan)(guan)理。按照《中(zhong)(zhong)共中(zhong)(zhong)央(yang) 國(guo)(guo)務院(yuan)(yuan)關(guan)(guan)于(yu)深化國(guo)(guo)有企(qi)業(ye)(ye)改革的指導(dao)意(yi)見》(中(zhong)(zhong)發(fa)(fa)(fa)〔2015〕22號(hao),以下簡稱中(zhong)(zhong)發(fa)(fa)(fa)22號(hao)文件)、《國(guo)(guo)務院(yuan)(yuan)辦(ban)公廳關(guan)(guan)于(yu)轉(zhuan)發(fa)(fa)(fa)國(guo)(guo)務院(yuan)(yuan)國(guo)(guo)資(zi)(zi)委以管(guan)(guan)資(zi)(zi)本(ben)為主推進職(zhi)能轉(zhuan)變方(fang)案的通知》(國(guo)(guo)辦(ban)發(fa)(fa)(fa)〔2017〕38號(hao))要求(qiu),結合當前中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額管(guan)(guan)理實際(ji),強(qiang)調中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額實行分級(ji)管(guan)(guan)理體(ti)制,國(guo)(guo)資(zi)(zi)委與中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)權責清晰、各司其職(zhi),國(guo)(guo)資(zi)(zi)委負責管(guan)(guan)制度、管(guan)(guan)總量、管(guan)(guan)監督,中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)負責管(guan)(guan)內(nei)部(bu)自主分配、管(guan)(guan)預算(suan)分解落實、管(guan)(guan)具體(ti)操(cao)作執行。

《辦法(fa)》緊(jin)緊(jin)圍繞中(zhong)發(fa)22號文件和(he)《意見》關(guan)于(yu)“建(jian)立(li)健全(quan)與(yu)勞動力市場(chang)基本適應(ying)(ying)、與(yu)企(qi)(qi)業(ye)(ye)(ye)經(jing)濟效(xiao)(xiao)(xiao)益(yi)和(he)勞動生產(chan)(chan)率掛鉤的(de)(de)(de)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)決(jue)(jue)定(ding)(ding)(ding)和(he)正(zheng)常增(zeng)長(chang)(chang)機(ji)制”的(de)(de)(de)要求,明確規定(ding)(ding)(ding)中(zhong)央企(qi)(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)額預算(suan)(suan)主(zhu)要按(an)照(zhao)效(xiao)(xiao)(xiao)益(yi)決(jue)(jue)定(ding)(ding)(ding)、效(xiao)(xiao)(xiao)率調(diao)整(zheng)、水(shui)平(ping)(ping)調(diao)控(kong)三個環節決(jue)(jue)定(ding)(ding)(ding)。一是(shi)(shi)中(zhong)央企(qi)(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)額預算(suan)(suan)與(yu)利潤總(zong)額等經(jing)濟效(xiao)(xiao)(xiao)益(yi)指(zhi)(zhi)標的(de)(de)(de)業(ye)(ye)(ye)績考核目(mu)(mu)標值(zhi)掛鉤,并且根據目(mu)(mu)標值(zhi)的(de)(de)(de)先進(jin)程度(du)確定(ding)(ding)(ding)不同(tong)的(de)(de)(de)預算(suan)(suan)水(shui)平(ping)(ping),引(yin)導中(zhong)央企(qi)(qi)業(ye)(ye)(ye)通(tong)過完成(cheng)高(gao)質量發(fa)展目(mu)(mu)標,帶動職工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)額合理有(you)序(xu)增(zeng)長(chang)(chang)。二是(shi)(shi)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)增(zeng)長(chang)(chang)還應(ying)(ying)當(dang)(dang)通(tong)過人工(gong)(gong)(gong)(gong)成(cheng)本投(tou)入產(chan)(chan)出效(xiao)(xiao)(xiao)率、勞動生產(chan)(chan)率等指(zhi)(zhi)標對(dui)標進(jin)行(xing)調(diao)整(zheng),進(jin)一步協調(diao)不同(tong)效(xiao)(xiao)(xiao)率的(de)(de)(de)企(qi)(qi)業(ye)(ye)(ye)之(zhi)間工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)分(fen)(fen)配關(guan)系,提高(gao)企(qi)(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)總(zong)額決(jue)(jue)定(ding)(ding)(ding)機(ji)制的(de)(de)(de)科學(xue)性與(yu)有(you)效(xiao)(xiao)(xiao)性。三是(shi)(shi)注重(zhong)收入分(fen)(fen)配公平(ping)(ping),國資(zi)(zi)(zi)委將按(an)照(zhao)國家有(you)關(guan)部(bu)門(men)發(fa)布的(de)(de)(de)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)指(zhi)(zhi)導線和(he)對(dui)非競(jing)爭類國有(you)企(qi)(qi)業(ye)(ye)(ye)的(de)(de)(de)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)調(diao)控(kong)要求,對(dui)部(bu)分(fen)(fen)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)水(shui)平(ping)(ping)偏高(gao)、過高(gao)的(de)(de)(de)行(xing)業(ye)(ye)(ye)與(yu)企(qi)(qi)業(ye)(ye)(ye),尤其是(shi)(shi)主(zhu)業(ye)(ye)(ye)不屬于(yu)充分(fen)(fen)競(jing)爭行(xing)業(ye)(ye)(ye)和(he)領域(yu)的(de)(de)(de)企(qi)(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)增(zeng)長(chang)(chang)過快(kuai)的(de)(de)(de)情況(kuang)進(jin)行(xing)適當(dang)(dang)約(yue)束(shu),確保企(qi)(qi)業(ye)(ye)(ye)職工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de)水(shui)平(ping)(ping)與(yu)增(zeng)長(chang)(chang)幅(fu)度(du)更加公平(ping)(ping)合理、規范有(you)序(xu)。同(tong)時(shi),對(dui)中(zhong)央企(qi)(qi)業(ye)(ye)(ye)承擔重(zhong)大專項(xiang)任務、重(zhong)大科技創新(xin)項(xiang)目(mu)(mu)等特殊事(shi)項(xiang)的(de)(de)(de),《辦法(fa)》也明確將予以適度(du)支持。

《辦法》在從(cong)宏(hong)觀層面(mian)完善國家(jia)、企(qi)(qi)(qi)(qi)業(ye)(ye)(ye)和職(zhi)工(gong)(gong)(gong)三(san)者工(gong)(gong)(gong)資(zi)(zi)分(fen)(fen)配(pei)關系,加大出資(zi)(zi)人向中(zhong)央企(qi)(qi)(qi)(qi)業(ye)(ye)(ye)董事會(hui)授權(quan)的(de)(de)同(tong)時,也同(tong)步對責任(ren)(ren)(ren)落實和制度配(pei)套進(jin)行了規定(ding)。一是(shi)強調企(qi)(qi)(qi)(qi)業(ye)(ye)(ye)作為內部(bu)分(fen)(fen)配(pei)的(de)(de)責任(ren)(ren)(ren)主體,應(ying)當持(chi)續深化內部(bu)三(san)項(xiang)制度改革,構建企(qi)(qi)(qi)(qi)業(ye)(ye)(ye)內部(bu)管(guan)(guan)理人員能(neng)上能(neng)下、員工(gong)(gong)(gong)能(neng)進(jin)能(neng)出、收(shou)入能(neng)增能(neng)減的(de)(de)市(shi)場化勞動用工(gong)(gong)(gong)和收(shou)入分(fen)(fen)配(pei)管(guan)(guan)理機制,切實承擔起(qi)搞(gao)好、搞(gao)活企(qi)(qi)(qi)(qi)業(ye)(ye)(ye)內部(bu)分(fen)(fen)配(pei)的(de)(de)職(zhi)責。二是(shi)加強監(jian)督(du)檢查(cha),明(ming)確(que)界定(ding)企(qi)(qi)(qi)(qi)業(ye)(ye)(ye)違規責任(ren)(ren)(ren),并(bing)將企(qi)(qi)(qi)(qi)業(ye)(ye)(ye)工(gong)(gong)(gong)資(zi)(zi)總額管(guan)(guan)理情況(kuang)納入各項(xiang)監(jian)督(du)檢查(cha)范圍,與審計、巡(xun)視等工(gong)(gong)(gong)作形成(cheng)合(he)力(li),確(que)保實現權(quan)責對等,監(jian)管(guan)(guan)到(dao)位(wei)。
